Termination and Release of Environmental Covenant

This Termination and Release of Environmental Covenant (“Termination”) is made this

day of , 20 by the Georgia Environmental Protection Division (hereinafter “GAEPD”).

WHEREAS, Owner/Grantor, Grantee/Holder and GAEPD entered into that certain Environmental Covenant dated {{date}} which was recorded in the Official Records Book {{book#}}, Page{{page#}} of the Public Records of {{name of county}} County, Georgia (the “Covenant”) affecting that certain real property situated at {{address}} in the City of {{name of city}} in the County of {{name of county}}, State of Georgia, moreparticularly described as Tax Parcel Number {{Parcel #}}. A complete legal description of the area is attached in Exhibit “A” and made a part hereof (hereinafter “Property”).

WHEREAS, GAEPD desires to terminate the Covenanton this Property in accordance with OCGA §§ 44-16-9 and 44-16-10 because {{reason for termination}}, and therefore the Property no longer needs to be restricted against the Activity and Use Limitations described in theCovenant.

NOW THEREFORE, GAEPD hereby terminates the Covenant on this Property, and the Property is hereby released from the restrictions in the Environmental Covenant. This Termination will be recorded in the Public Records of {{name of county}} County which will terminate the Covenant on the Property. Nothing contained in this Termination is intended nor shall be construed to terminate or release any restriction or condition affecting any other property than the Property more particularly described in this Termination and Release of Environmental Covenant.

GAEPD has caused this Environmental Covenant to be terminated pursuant to The Georgia Uniform Environmental Covenants Act,OCGA §§ 44-16-1 et seq.
