The Lieutenant-Governor as the Governor's Deputy with the advice of the Executive Council makes the following Regulations:

1. Objective
The objective of these Regulations is to prescribe the restrictions that are to apply to the advertising of tobacco products at the 2005 Australian Motorcycle Grand Prix at Phillip Island and the 2006 Foster's Australian Grand Prix at Albert Park.
2. Authorising provision
These Regulations are made under section 43 of the Tobacco Act 1987.
3. Definitions
In these Regulations—
"Australian Grand Prix" means—
(a) the 2006 Foster's Australian Grand Prix; or
(b) a function or event associated with the 2006 Foster's Australian Grand Prix—
to be held at Albert Park at any time on or after 30 March 2006 and before 3 April 2006.
"Australian Motorcycle Grand Prix" means—
(a) the 2005 Australian Motorcycle Grand Prix; or
(b) a function or event associated with the 2005 Australian Motorcycle Grand Prix—
to be held at Phillip Island at any time on or after 14 October 2005 and before 17 October 2005.
4. Restriction of displays at Australian Motorcycle Grand Prix

Displays of the whole or part of a trademark or brand name of a tobacco product or the name of the manufacturer or distributor of a tobacco product in connection with the Australian Motorcycle Grand Prix comply with section 10(1) of the Tobacco Act 1987 if the displays are restricted to—
(a) signs or objects—
(i) on or within the site of the Australian Motorcycle Grand Prix; or
(ii) on the outside of any road, sea or air vehicle used in the Australian Motorcycle Grand Prix or on any participant in the Australian Motorcycle Grand Prix—
that are permitted by section 18 of the Tobacco Advertising Prohibition Act 1992 of the Commonwealth; and
(b) the period from and including 9 October 2005 to and including 19 October 2005.
5. Restriction of displays at Australian Grand Prix

Displays of the whole or part of a trademark or brand name of a tobacco product or the name of the manufacturer or distributor of a tobacco product in connection with the Australian Grand Prix comply with section 10(1) of the Tobacco Act 1987 if the displays are restricted to—
(a) signs or objects—
(i) on or within the site of the Australian Grand Prix; or
(ii) on the outside of any road, sea or air vehicle used in the Australian Grand Prix or on any participant in the Australian Grand Prix—
that are permitted by section 18 of the Tobacco Advertising Prohibition Act 1992 of the Commonwealth; and
(b) the period from and including 25 March 2006 to and including 4 April 2006.
6. Expiry
These Regulations cease to have any force or effect on 30 April 2006.
