Definition of user / The definition of a ‘user’ is regarded as being “an employee who habitually uses a computer workstation as a significant part of their normal work”.If it is still not possible to decide who is a ‘user’ under the above definition, then the following additional guidance is provided:
· The individual uses the computer to do their work and no alternative is available.
· The individual has no discretion as to the use of a computer.
· The individual requires training and/or particular skills to use the computer.
· The computer is used for continuous spells of one hour or more at a time.
· The computer is used more or less daily.
· Fast transfer of information between the user and the screen is an important part of the job.
· Use of the system requires a high level of concentration.
· The computer is normally used for at least 3-4 hours per day.
Eye & eyesight testing / Operators of DSE who are classed as ‘users’ under the Regulations are entitled to:
· An eyesight test in relation to the use of DSE. Initial costs for eye testing should be initially borne by the employee (unless other local arrangements for payment are in place) and receipts kept to allow claims to be made back via payroll.
· Reimbursement of the cost of the lenses as prescribed by the practitioner, provided the optician’s receipt is endorsed that the lenses are solely for DSE use at work. If it is shown that the employee requires spectacles for DSE use at work but also requires them for other purposes, then those required for DSE use at work must be a separate pair.
· Please also be aware that the cost of any lens coatings (e.g. tints, react-to-light) must be paid by the employee and will not be reimbursed.
· A maximum of £50.00 for the frames. If employees wish to select frames at a greater cost they may do so. However the extra cost above £50.00 must be met by the employee.
· All receipts should be properly itemised clearly showing all individual details.
The optician should determine the period for eye testing.
Persons not classed, as ‘users’ are not entitled to the aforementioned.
An employee classed as a ‘user’ under the Regulations cannot be forced to have an eyesight test. They must be informed of their rights and arrangements made for suitable testing where requested by the employee.
