Conclusions of Law: The above facts constitute a repeat violation of code of ordinances of the Town of Lantana. The case law presented by counsel for the Respondent to utilize a public street or alleyway in a manner as presented by the evidence.
Order finding repeat violation and imposing fine (CE15-0814) dated 09/18/2015
In consideration of the factors enumerated in Sections 162.09 (2) (b), Florida Statutes, and in particular in consideration of the gravity of the violations in obstructing a public street and alleyway, the lack of actions taken by respondent to correct the violations and the previous violations committed by respondent, it is the order of the special magistrate that a fine of $2100.00 is hereby assessed for the repeat violations. The fine is levied in a daily amount of $300.00 per day for the violations of Section 13-5 that existed on the property on the 7 dates referenced above
