NOTICE OF ELECTION

OF THE QUALIFIED VOTERS OF THE

ALLEGANY JOINT FIRE DISTRICT

IN THE TOWN OF ALLEGANY,

CATTARAUGUS COUNTY, NEW YORK

TO THE QUALIFIED VOTERS OF ALLEGANY JOINT FIRE DISTRICT, in the Town of Allegany , Cattaraugus County, New York:

PLEASE TAKE NOTICE that the Board of Fire Commissioners of the Allegany Joint Fire District, in the Town of Allegany, Cattaraugus County has scheduled a special election of the qualified voters of said District to be held at the Allegany COMMUNITY CENTER188 W. Main Street, Allegany, New York 14706, on July 11, 2017at 6:00 p.m. on that day, with polls to be open between the hours of 6:00 p.m. and 9:00 p.m. for the purpose of voting upon the following resolutions;

Resolution #1

RESOLUTION TO ESTABLISH THE

“ALLEGANY JOINT FIRE DISTRICT BUILDING AND FACILITIES CAPITAL RESERVE FUND”

BE IT RESOLVED, that pursuant to §6-g of the General Municipal Law, the Allegany Joint Fire District ( Fire District ) does hereby establish the “Allegany Joint Fire District Building and Facilities Capital Reserve Fund”, a capital reserve fund, to finance all or part of the cost of acquisition of the construction, reconstruction, remodeling, refurbishment, acquisition or upgrading of existing fire district buildings or facilities; to pay or provide for structural improvements thereto; to pay or provide for upgrades to or the replacement of the HVAC systems, plumbing, lighting, electrical, base radios , security systems , surveillance systems, smoke and fire protection services for those building or facilities and any miscellaneous incidental equipment related thereto,

BE IT FURTHER RESOLVED,

  1. This reserve fund will accumulate monies to pay for all or part of the cost of the buildings, facilities, and the purposes as above described.
  2. The Allegany Joint Fire District currently on two buildings, located at 10 North First Street, Allegany, New York 14706, and the Fire Hall, located at 186 W. Main Street, Allegany, New York 14706.
  3. The Fire District Treasurer is hereby directed to deposit moneys of this reserve fund in a separate bank account to be known as the “Allegany Joint Fire District Building and Facilities Capital Reserve Fund”
  4. The Fire District Treasurer is authorized to invest, from time to time, the moneys of this fund pursuant to Section 6-g of the General Municipal Law.
  5. No expenditure shall be made from this fund, except upon authorization of this Board subject to a permissive referendum.

BE IT FURTHER RESOLVED, that this resolution modifies the prior resolution of the Board on May 11th, 2017.

BE IT FURTHER RESOLVED, that this resolution is subject to the affirmative vote of a majority of the electors of the Allegany Joint Fire District, qualified to vote at an annual election of the Fire District Officers, which vote will be held on July 11th, 2017 between the hours of 6:00 p.m. and 9:00 p.m. at the located at AlleganyCommunity Center, 188 W. Main Street, Allegany, New York 14706.

BE IT FURTHER RESOLVED, that the proposition to be voted upon by the electors of the Allegany Joint Fire District, shall be in substantially the following form;

Shall the resolution of the Board of Fire Commissioners of the Allegany Joint Fire District adopted on the 8th day of June, 2017 , authorizing the establishment of the “Allegany Joint Fire District Building and Facilities Capital Reserve Fund”, a capital reserve fund, to finance all or part of the cost of acquisition of the construction, reconstruction, remodeling, refurbishment, acquisition or upgrading of existing fire district buildings or facilities; to pay or provide for structural improvements thereto; to pay or provide for upgrades to or the replacement of the HVAC systems, plumbing, lighting, electrical, base radios , security systems , surveillance systems, smoke and fire protection services for those building or facilities and any miscellaneous incidental equipment related thereto, be approved .

RESOLUTION TO ESTABLISH THE

“ ALLEGANY JOINT FIRE DISTRICT VEHICLE AND EQUIPMENT CAPITAL RESERVE FUND”

BE IT RESOLVED, that pursuant to Section 6-g of the General Municipal Law, the Allegany Joint Fire District (Fire District ) does hereby establish the “ Allegany JointFire District Vehicle and Equipment Reserve Fund” , a capital reserve fund, to finance the cost of acquisition of new and replacement fire fighting vehicles; the acquisition of additional fire fighting vehicles needed to add to the existing fleet of fire fighting vehicles of the Allegany Joint Fire District; refurbishment , and reconstruction of the fire district vehicles, including but not limited to, ladder trucks, pumpers, tankers, rescue vehicles, squads, vans, trailers,and command vehicles. This reserve fund includesin addition to the above , the acquisition of new or used replacement equipment and apparatus for these fire fighting vehicles, including but not limited to vehicles radios, ladders, pumps, hose, nozzles, light bars or any other equipment necessary to make the vehicles functional for firefighting purpose. This reserve fund will accumulate monies to pay for all or part of the cost of such fire fighting vehicles and necessary equipment.
