TheSecretaryofState,inexerciseofthepowersconferredonhimbysection302oftheMerchantShippingAct1995([a])andarticle35oftheHovercraft(General)Order1972([b]),andwiththeconsentoftheTreasury,makesthefollowingRegulations.
Citation,commencementandexpiry
- —(1)TheseRegulationsmaybecitedastheMerchantShipping(Fees)Regulations2017andcomeintoforceon6thApril2017.
(2)Theyceasetohaveeffectattheendoftheperiodofsevenyearsbeginningwiththedayonwhichtheycomeintoforce.
Interpretation
- IntheseRegulations—
“theAct”meanstheMerchantShippingAct1995;
“theAgency”meanstheMaritimeandCoastguardAgency,anexecutiveagencyoftheDepartmentforTransport;
“inspection”includesaudit,surveyandtest;
“issue”includesamendment,endorsement,re-issueandrenewal;
“localoffice”means—
(i)oneoftheAgency’sMarineOffices([c]),
(ii)anofficeoftheMarineManagementOrganisation([d]),
(iii)anofficeofMarineScotland([e]),or
(iv)anofficeoftheDepartmentofAgricultureforNorthernIreland([f]);
“premiumservice”,inrelationtoafee,meansaserviceperformedforanapplicantattendinginpersonatalocalofficeorattheofficewheretheregisterofBritishshipsiskept;and
“vessel”hasthesamemeaningas“ship”intheAct.
FeespayabletotheAgency
- —(1)ThefeepayableinrespectofaserviceorotherfunctiondescribedinSchedule1isthefee—
(a)specifiedinthatScheduleinrelationtothatserviceorfunction,or
(b)otherwisedeterminedunderthatSchedule.
(2)Whereafeeispayableinrespectoftheissueofacertificate,theAgencyisnotrequiredtoissuethecertificateuntilthatfeehasbeenpaid.
Paymentfortravel,subsistenceandotherexpenses
- —(1)Whereafeeisdeterminedbyreferencetotheamountofworkinvolved,thefeeincludesanamountforthetimespenttravelling,exceptthattravellingtimeinexcessof—
(a)4hoursforeachvisittoashipintheUnitedKingdom,and
(b)10hoursinanyperiodof24hoursfortravelfromtheUnitedKingdomtoashiplocatedabroadandbacktotheUnitedKingdom,
istobedisregarded.
(2)ThereasonablecostoftravelandsubsistenceincurredinvisitingashipoutsidetheUnitedKingdomistobereimbursedtotheAgencyinadditiontothefeepayableundertheseRegulations.
(3)Paragraph(4)appliestoexpensesreasonablyincurredinrespectofanyassistanceprovidedtotheAgencybyapersonnotemployedbyit.
(4)Totheextentthattheexpensesreferredtoinparagraph(3)relatetoaserviceorfunctionoftheAgencyforwhichafeeispayableundertheseRegulations,theyaretobereimbursedtotheAgencyinadditiontothatfee.
Transitionalprovisions
- —(1)Subjecttoparagraph(2),whereanapplicationforaserviceorotherfunctionforwhichafeeispayableundertheseRegulationsismadebeforethedaytheycomeintoforce,buttheserviceorfunctionisprovidedonorafterthatdate,thefeepayableinrespectofthatserviceorfunctionisthefeeprescribedimmediatelybeforethecomingintoforceoftheseRegulations.
(2)Paragraph(3)applieswhere—
(a)anapplicationforaserviceorotherfunctionismadebeforetheseRegulationscomeintoforce,
(b)thefeepayableinrespectofthatserviceorfunctionistobecalculatedbyreferencetoanhourlyrate,and
(c)anyworktoconductthatsurveyorfunctioniscarriedoutaftertheseRegulationscomeintoforce.
(3)ThehourlyrateprescribedundertheseRegulationsappliesforthepurposeofcalculating—
(a)thefeeinrespectoftheserviceorotherfunctioncarriedoutafterthedatetheseRegulationscomeintoforce,and
(b)anyadditionalfeewhichbecomespayableunderPart14ofSchedule1byreasonofaneventoccurringafterthatdate.
Revocation
- TheRegulationsspecifiedinSchedule2arerevoked.
Review
- —(1)TheSecretaryofStatemustfromtimetotime—
(a)carryoutareviewoftheseRegulations,
(b)setouttheconclusionsofthereviewinareport,and
(c)publishthereport.
(2)Thereportmustinparticular—
(a)setouttheobjectivesintendedtobeachievedbytheregulatorysystemestablishedbytheseRegulations,
(b)assesstheextenttowhichthoseobjectivesareachieved,and
(c)assesswhetherthoseobjectivesremainappropriateand,ifso,theextenttowhichtheycouldbeachievedwithasystemthatimposeslessonerousregulatoryprovision.
(3)ThefirstreportunderthisregulationmustbepublishedbeforetheendoftheperiodoffiveyearsbeginningwiththedayonwhichtheseRegulationscomeintoforce.
(4)Reportsunderthisregulationareafterwardstobepublishedatintervalsnotexceedingfiveyears.

Interpretation
- InthisPart,“thestatutoryrequirements”meansrequirementsimposedbyorunder—
(a)theAct,and
(b)thestatutoryinstrumentslistedintheTablebelow.
ApplicationofPart1
- —(1)Subjecttoparagraph3,thisPartappliesto—
(a)theinspectionofaship,itsequipmentormanagement,fortheissueof—
(i)acertificate;or
(ii)aletterofacceptanceinlieuofacertificate;
(b)theapprovalandappointmentofasurveyornotemployedbytheAgencytoundertakeaninspectionmentionedinsub-paragraph(a),theconsiderationoftheresultsthereofandtheissueofacertificateorletterofacceptanceinlieuofacertificate;
(c)anapplicationforexemptionfromanyofthestatutoryrequirements(andtheissueofanexemption,ifapproved);
(d)aninspectionpursuanttothestatutoryrequirementswhichresultsinthedetentionofashiptowhichPartIoftheMerchantShipping(PortStateControl)Regulations2011([g])applies,andanysubsequentinspectionrelatingtothedeficiencieswhichledtothedetention;
(e)asurveyorinspectionpursuanttothestatutoryrequirementswhichresultsintheissueofapreventionofoperationnoticeinaccordancewithregulation9oftheMerchantShipping(MandatorySurveysforRo-RoFerryandHighSpeedPassengerCraft)Regulations2001([h])andanysubsequentsurveyorinspectionrelatingtothedeficiencieswhichledtotheissueofthatnotice.
(2)Inthisparagraphandparagraph3,“certificate”meansacertificateofcompliancewithanyofthestatutoryrequirements.
- WhereafeeisprescribedunderanotherPartofthisScheduleinrespectofanapplicationfortheissueofacertificate,thatfeeappliesandnotthefeeprescribedunderthisPart.
Depositandtimeforpayment
- —(1)Apersonapplyinginrespectofaservicementionedinparagraph2(1)(a)or(c)shall,beforecommencementofthework,payadepositonaccountofthefeecalculatedbyreferencetoanestimateofthedurationoftheworklikelytoberequiredandtheprescribedhourlyrate.
(2)Theamountofdepositissubjecttoreviewduringthecourseofthework,andtheapplicantshallpayanyadditionalsumcalculatedbyreferencetoanyincreasedestimateoftheworklikelytoberequired.
(3)Attheconclusionofthework,thefeeistoberecalculatedbyreferencetotheactualdurationandthedifferenceistobepaidby,orasthecasemaybe,refundedto,theapplicant.
Feesforsurveysandinspections,etc.
- SubjecttoanyadditionalfeewhichmaybepayableunderPart14ofthisSchedule,thefeeforaserviceorfunctiontowhichthisPartappliesperformedbyapersonemployedbytheAgencyistobedeterminedbyreferencetothetimespentindoingthenecessaryworkandcalculatedatthehourlyrateof£147.

TheseRegulationsprovideforthefeestobepaidforvariousfunctionscarriedoutbytheMaritimeandCoastguardAgencyrelatingtothesurvey,inspectionandtestingofshipsandhovercraftandtheirequipmentandtotheexaminationof,andissuingofcertificatesofcompetenceetc.to,seafarers.Feesarealsoprescribedinrelationtomortgagesofships,seafarers’documents,certificatesofcompulsoryinsurance,wastemanagement,exemptionsfromstatutoryrequirementsandothermiscellaneousfunctionsoftheAgency.
TheRegulationsreplacetheMerchantShipping(Fees)Regulation2006,asamended.Forfeescalculatedbyreferencetotheamountofworkinvolved,thehourlyrateisincreasedfrom£94to£147.Otherfeessetoutinthe2006Regulationshave,inthemain,beenincreasedbyapplyingasimilarrevalorisation.Somefeeshavenotbeenincreased.
TheRegulationsaretoceasetohaveeffectsevenyearsaftertheycomeintoforce(Regulation1).
Regulation2containsdefinitions.
Regulations3and4provideforthefeesspecifiedin,orascertainedunder,Schedule1tobepaidforthespecifiedservices,andfortheMaritimeandCoastguardAgencytorecovertravelandotherexpensesassociatedwithprovidingthoseservices.
Regulation5containstransitionalprovisions,andregulation6providesfortherevocationofthe2006andotherRegulations,whicharelistedinSchedule2.
