EXPLANATORY STATEMENT
Defence Determination 2010/60
This Determination amends Defence Determination 2005/15, Conditions of Service (the Principal Determination), made under section 58B of the Defence Act 1903 (the Act). Chapter 15 of the Principal Determination deals with employment conditions for members of the Australian Defence Force (ADF) living on a long-term posting overseas.
This Determination implements revised post indexes that apply to the overseas locations where ADF members serve, as a result of a price review conducted in September 2010. The review is conducted in accordance with subclause 15.2.8.3 of the Principal Determination. The review is distinct from and additional to the routine monthly adjustment process, in which an exchange rate movement in the national currency of 2 per cent or more over two pay periods then prompts an amending determination to vary the post index.
Clause 1 of this Determination sets out the manner in which this Determination may be cited.
Clause 2 of this Determination provides that this Determination commences on 23 December 2010.
Clause 3 specifies that the amendment is made to the Principal Determination, as amended.
Clause 4substitutes Annex 15.2.A of the Principal Determination. The new Annex changes post indexes at a range of posting locations. The changes are due tothe results of a six-monthly price review. The post indexes are used to calculate the amount of overseas living allowance a member of the ADF is paid during a long-term posting overseas.
The review data allows the post indexes to more accurately reflect the cost of living at that posting location and takes into account movements in the exchange rate. This process results in a closer relationship between members’ allowances and the actual economic conditions at their posting location.
The applied post indexes increased for Canada,China, Cook Islands, Israel, Kiribati, Korea, Papua New Guinea, Singapore, Solomon Islands, Turkey, UK London, USA locations Alaska, California, Hawaii, Manhattan and New YorkState excluding Manhattan and Vanuatu.
The applied post indexes decreased for Belgium, France, Germany, Japan, Netherlands and Spain.
Ethiopia and New Zealand – Christchurch have been added as posting locations.
The applied post indexes in Marshall Islands, Palau andTuvaluremained at current index due to no published price review data being available. No other changes are made for applied post indexes in other locations.
Clause 4 adjusts the index in Column 3 of Annex 15.2.A for 32 locations with published indexes of less than 100. Where this figure is less than 100 it is not used in working out overseas living allowance, so benefits for members in those locations remain unchanged. The third column shows the index published for the posting location by the data service provider.
