Procurement INSTRUCTION
according to the Section 82 of the Public Procurement Law
“Purchase of testing equipment”

3. Procurement subject and requirements (technical specification):
Purchase of testing equipment according to the requirements of the Annex No.1 “Technical Specification” (CPV classification code – 38900000-4).
4. Procurement organization and implementation:
Procurement is organized and implemented by the commission (hereinafter – Commission), established according to the CRPC 02.09.2015 decree No.15-v.
5. Place of performance:
Brivibas street 55, Riga, LV-1010, Latvia.
6. Contract period:
2 (two) months from the conclusion of the Contract.
7. Deadline and procedure for the submission of tenders:
7.1. Tender with the reference ““Purchase of testing equipment”, identification No. PTAC 2015/06MI”, shall be submitted to the CRPC, Brivibas street 55, Riga, LV-1010, Latvia, room 222 (entrance II, circle at the church).
7.2. Tender shall be submitted until 10:00 a.m. September 18, 2015.Tender may be submitted electronically (), using safe electronic signature (only Applicants from Latvia, Lithuania and Estonia) or by fax (fax number: +371 67388634), or by regular mail, or personally. If tender is submitted by regular mail, Applicant undertakes the responsibility for the receipt of the tender until the date and location specified in the Instruction (hereinafter – Instruction). Tenders submitted after the mentioned date will not be evaluated. If tender is submitted by fax, the tender must be sent out also by regular mail in order to confirm the legal force of documents.
8. Validity period of the tender:
60 (sixty) calendar days from the submission day of the tender, including it.
9. Tender conditions:
9.1. The text of the tender shall be in Latvian or English language, in one original copy, pages shall be numbered, in sealed envelope. Applicant name, legal address, phone and fax number, as well as the reference “Do not open until 10:00 a.m. September 18, 2015” shall be written on the envelope.
9.2. Tender can be submitted for the entire scope of the procurement subject or for the separate parts of it: Part I – Cylindrical measuring rods and conical probes, Part II – The child's body parts mimicking probes and test templates, Part III – Different testing equipment and Part IV – Measuring equipment. Each Applicant may submit only one variant of the tender.
9.3. Tender signatories are responsible for the truthfulness and accuracy of the given information. The Applicant undertakes all costs connected to preparation and delivery of the tender, and will not raise any claims against the client in this regard.
9.4. The tender consists of:
9.4.1. Application letter (see Instruction, Annex No.2);
9.4.2. Selection documents (see Instruction, points 10.);
9.4.3. Technical and financial tender (see Instruction, points 12. and 13., and Annex No.1).
9.5. The tender documents shall be clearly legible, without erasures, block-outs, unstipulated corrections, deletions or additions.
10. Terms and requirements for the Applicants
Applicant shall submit:
10.1.1. A written confirmation that the Applicant is not a subject to the conditions of the Paragraph 5 of the Section 82 of the Public Procurement Law;
10.1.2. If Applicant is registered as legal entity in foreign country - a copy of Registration Certificate issued by Commercial Register or equivalent competent authority in the corresponding country. In the case of Applicant registered as legal entity in the Republic of Latvia Commission will examine the information of the Business Register homepage. The Applicant has the right to submit the copy of Registration Certificate issued by Enterprise Register of the Republic of Latvia or Commercial Register;
10.1.3. Original or certified copy of warrant signed by applicant, if the tender documents are signed by applicant's authorized representative.
10.2. Applicant shall bear all costs associated with preparation and submission of the offer to the Client. Client shall not be liable for those costs of Applicant, and they are not reimbursed. Submitted offers are property of the Client and will not be returned to Applicants.
11. The rights of the Client:
The Client retains the right to terminate the procurement due to insufficient funding.
12. Requirements for technical tender:
The price for each service type shall be specified according to the Technical Specification (Annex No.1).
13. Financial tender, tender price:
13.1. The tender shall be expressed in EUR excluding value added tax (hereinafter - VAT) and it shall include procurement price, as well as other expenses, if any.
13.2. If any type of the expenses is not included in the tender price, it shall be specified separately.
14. Payment conditions:
Non-cash payment will be done according to the concluded contract.
15. Evaluation of the tender and decision making:
15.1. Tenders complying with all the requirements specified in the Instruction and Technical Specification will be recognized as appropriate. The tender with the lowest price excluding VAT will be selected out of the tenders that comply with all specified requirements in the Instruction and Technical Specification;
15.2. Commission will declare winner the applicant, which is chosen according to stated requirements and criteria, and is not excluded from participation in procurement under Part 5 of Article 82 of Public Procurement Law;
15.3. The tender applicants will be informed about the decision within 3 (three) business days from the decision making.
