Declarations of interests by representatives on the Compact Executive

In ensuring openness and transparency, the Compact Executive has agreed that all members of the Compact Executive should declare where they have a personal or ‘business / provider’ interest in any business of the Compact. Representatives will have the option at the beginning of each Compact Executive meeting to declare the existence and nature of any interest prior to consideration of the particular item and this will be recorded in the minutes. Where possible it is asked if declarations of interest can be emailed to the Compact Governance and Business Support Office in advance of the meeting. Proforma available via:

Personal Interest:

Where you have a personal interest in any business of the Compact you also have a prejudicial interest in that business where the interest is one which a member of the public with knowledge of the relevant facts would reasonably regard as so significant that it is likely to prejudice your judgement.

Where you have a prejudicial interest in any business of the Compact you may be asked to withdraw from the room where a meeting considering the business is being held. You must not exercise executive functions in relation to that business and you must not seek improperly to influence a decision about that business.

‘Business / Provider Interest’:

Representatives should declare any links they have with companies or organisations (including schools as providers) from which the Compact may wish to buy goods or services. It is important for anyone involved in spending money to demonstrate that they do not benefit personally from decisions that they make.

A ‘business interest’ is defined as a situation where the person concerned, their family (immediate family and other relatives) or close friends have a connection with a potential supplier, or where there is any other business connection (as employer, employee or major shareholder), or where a family member or partner of a person concerned could be advantaged or disadvantaged by a decision of the Compact Executive or supporting Leadership Group.

Confidentiality:

Representatives must not disclose information or papers given to you in confidence by anyone, or information acquired by you which you believe, or ought reasonably to be aware, is of a confidential nature, except where:

  1. you have the consent of a person authorised to give it;
  2. you are required by law to do so;
  3. the disclosure is made to a third party for the purpose of obtaining professional advice provided that the third party agrees not to disclose the information to any other person; or
  4. the disclosure is:

(a)reasonable and in the public interest; and

(b)made in good faith and in compliance with the reasonable requirements of the authority.
