In accordance with your recent application and on behalf of the Council, as Highway Authority, I am pleased to grant consent for the construction of a vehicle crossing at the Works Location shown above. I would bring your attention to the following items:

  • This licence expires on the date shown above, but may be extended for 6 months subject to a further payment of £75.
  • Your contractor must comply with the attached standard and site specific conditions
  • Only contractors listed on the attached Buy With Confidence list will be permitted to undertake the works on your behalf.

LICENCE

Pre-Commencement Conditions

1)The licensee shall ensure that the works consented under this licence are only be undertaken by a suitable contractor who is registered under the Council’s Trading Standards ‘Buy With Confidence’ scheme.

2)It is the licensee’s responsibility to obtain quotations for the works and to select and appoint his own contractor accordingly. Payment terms must be agreed between the licensee and the contractor. The Council will have no responsibility or liability for any disputes arising.

3)The contractor is required to give the Council a minimum of 7 days notice prior to commencing works, using Form N.

4)The contractor must not start work until plans detailing the statutory undertakers’ and utility companies’ apparatus have been issued to him by the Council.

5)The contractor shall indemnify The Council and Licensee from and against all liability for personal injury, loss or damage to property and any other loss, damage , costs and expenses however caused.

Highway Works Conditions

6)The contractor shall undertake to keep all highway work properly protected and, during the hours of darkness, properly lit and to take every precaution to ensure the safety of the public at all times until the opening or access has been permanently reinstated and the site cleared and regularly maintained during periods of no activity.

7)The contractor shall supply, erect and maintain signing, lighting and guarding of the works in the public highway in accordance with the Safety At Street Works and Road Works Code of Practice (red book), and in accordance with the current edition of Chapter 8 of the Traffic Signs Manual, Traffic Safety Measures and Signs for Road Works and Temporary Situations. This is required to satisfy the client and contractor's responsibilities under the Construction (Health, Safety and Welfare) regulations 1996, the New Roads and Street Works Act 1991 and the Construction (Design and Management) Regulations 2007.

8)All waiting/loading/parking restrictions within the vicinity of the works must be observed at all times. The contractor should seek our advice in advance of the works where this is not possible.

9)No spoil, material or other detritus arising from the works must be permitted to enter into any highway drainage in the area of works.

10)When working on footways, the contractor must maintain a safe passage for pedestrians at all times.

11)The contractor will be held solely liable for any damage they may cause to the highway surface, street furniture, ironwork and overhead/underground services. The Council reserves the right to recover its costs from the contractor in conjunction with any such damage.

12)The contractor must ensure that residents in the immediate vicinity of the works have access to their premises maintained at all times.

13)The contractor must keep his working space clear of all detritus and leave it in a safe and tidy condition at all times. Materials and plant must always be stored within the working space and not on the footway wherever possible.

14)The Council may require to see delivery tickets for materials used in the works and reserves the right to take away material samples for random testing.

15)The contractor shall at all times have at least one operative on the site who has the NRSWA qualification to carry out excavation and reinstatement of the highway.

Post-Construction Conditions

16)The contractor shall upon completion of the works, leave and maintain the site in a safe condition to the satisfaction of the Council.

17)On completing his works, the contractor must notify the Council of such within 3 working days using Form R, along with a good quality, dated, digital photograph of the works.

18)Upon satisfactory completion of the works, the Council will issue a Completion Certificate to the licencee, upon which his obligations under this licence will have been discharged. The Council will also supply a copy of the Certificate to the contractor.

Maintenance of the Works

19)The contractor is responsible for a 12 month maintenance period for the works, which starts upon the issue date of the Completion Certificate, and undertakes to guarantee his workmanship and materials against any defects that may arise.

Adoption of Works

20)Provided that the works are kept defect free, the Council will automatically assume responsibility for the works at the end of the maintenance period.

21)If any of these conditions or special conditions are contravened the Council may withdraw the license and reserves the right prosecute the contractor and/or licensee.
