Automobile Insurance Reporting Information

Definitions

1.In this Regulation,

“automobile insurance reporting information” means the information prescribed by subsection 2 (2);

“Minister” means the Minister of Transportation.

Prescribed persons and information

2.(1)Every person who is an insurer within the meaning of subsection 1 (1) of the Act is prescribed for the purposes of subsection 13 (3) of the Act.

(2)The following information concerning automobile insurance with respect to a motor vehicle is prescribed for the purposes of subsection 13 (3) of the Act:

1.The vehicle identification number of the motor vehicle.

2.Whether the motor vehicle is insured under a contract of automobile insurance.

3.The effective date of the contract of automobile insurance with respect to the motor vehicle.

4.The expiry date of the contract of automobile insurance.

5.Information on any renewal and new expiry date of the contract of automobile insurance with respect to the motor vehicle.

6.Information on any cancellation, expiration or termination of the contract of automobile insurance with respect to the motor vehicle.

7.Information on any deletion or change in coverage which results in the motor vehicle ceasing to be insured for any mandatory coverage required under a contract of automobile insurance.

8.Information on the addition of a motor vehicle to a contract of automobile insurance or the deletion of a motor vehicle from a contract of automobile insurance.

9.Any change to any automobile insurance reporting information described in paragraphs 1 to 8 that has been previously provided with respect to the motor vehicle or the contract of insurance.

10.The name of the insurer submitting the automobile insurance reporting information.

Compliance time limits

3.(1)Every insurer shall provide automobile insurance reporting information in accordance with the following requirements with respect to every motor vehicle in a class of motor vehicles specified in the Minister’s request that is insured under a contract of automobile insurance issued by the insurer:

1.Automobile insurance reporting information described in paragraphs 1, 3 and 4 of subsection 2 (2) must be provided,

i.on or before the day specified in the request with respect to motor vehicles insured under contracts of insurance in effect on the day of the request,

ii.as soon as practicable after the effective date of any new contract of automobile insurance issued before December 1, 2011, and

iii.no later than 14 days after the effective date of any new contract of automobile insurance issued after November 30, 2011.

2.Automobile insurance reporting information described in paragraphs 5, 6, 7 and 9 of subsection 2 (2) that includes the vehicle identification number of the motor vehicle must be provided as soon as practicable after the effective date of any of the following, if the effective date is before December 1, 2011, and no later than 14 days after the effective date of any of the following, if the effective date is after November 30, 2011:

i.Any renewal, cancellation, expiry or termination of the contract of insurance with respect to the motor vehicle.

ii.Any deletion or change in coverage described in paragraph 7 of subsection 2 (2) with respect to the motor vehicle.

iii.Any other change to the automobile insurance reporting information previously provided with respect to the motor vehicle.

3.Automobile insurance reporting information described in paragraph 8 of subsection 2 (2) that includes the vehicle identification number of the motor vehicle must be provided,

i.as soon as practicable after the date the insurer is notified of the addition or deletion described in that paragraph, if the insurer is notified before December 1, 2011, and

ii.no later than 14 days after the insurer is notified of the addition or deletion described in that paragraph if the insurer is notified after November 30, 2011.

(2)Despite subparagraph 1 i of subsection (1), an insurer that, before receiving the request from the Minister, has already provided automobile insurance reporting information to the Registrar, or to a person authorized under subsection 13 (4) of the Act to collect and keep the information, with respect to a motor vehicle in a class of motor vehicles specified in the Minister’s request,

(a)is not required to provide the same information again after receiving the request; and

(b)is required to provide, on or before the day specified in the request, any applicable automobile insurance reporting information required under paragraph 1, 2 or 3 of subsection (1) that has not been provided with respect to the motor vehicle.

Commencement

4.This Regulation comes into force on the latest of,

(a)the day section 34 of the Keeping the Promise for a Strong Economy Act (Budget Measures), 2002 comes into force;

(b)the day subsection 35 (2) of the Keeping the Promise for a Strong Economy Act (Budget Measures), 2002 comes into force; and

(c)the day this Regulation is filed.
