A CHARTER RESOLUTION

OF THE MAYOR AND CITY COUNCIL OF LAUREL AMENDINGARTICLE 400 “ADMINISTRATION” OF THE CHARTER OF THE CITY OF LAUREL TOREFLECT A REORGANIZATION OF THE CITY BY AMENDING SEC. 465 “DIRECTOR OF THE DEPARTMENTOF DEVELOPMENT MANAGEMENT”AND ADDING SEC. 466 “DIRECTOR OF THE DEPARTMENT OF THE FIRE MARSHALL AND PERMIT SERVICES” TO REFLECT THE DIVISION OF THE DEPARTMENT OF PLANNING AND ZONING INTO THE DEPARTMENT OF ECONOMIC AND COMMUNITY DEVELOPMENT AND THE DEPARTMENT OF FIRE MARSHALL AND PERMIT SERVICES

Sponsored by the President, at the request of the Administration.

WHEREAS,the City recently underwent a reorganization which resulted in the creation of the Department of Economic and Community Development and the Department of Fire Marshall and Permit Services, which Departments together had constituted the Department of Planning and Zoning; and

WHEREAS, the Sec. 465 of the Charter of the City of Laurel, referred to the predecessor of the Department of Planning and Zoning, the Department of Development Management; and

WHEREAS, the Mayor and City Council believe that it would be in the best interest of the City to amend City Charter, Article 400 as set forth herein so as to accurately reflect the existing Departments of the City.

NOW, THEREFORE, BE IT RESOLVED that City Charter,Sec. 465entitled “Director of the department of development management” be and hereby is amended to read as follows:

Sec. 465. - Director of the department of economic and communitydevelopment [management].

(a)There shall be a director of the department of economic and communitydevelopment [management] appointed by the mayor, subject to the confirmation of the city council. His or her compensation shall be determined by the city council. The director of the department of economic and communitydevelopment [management] shall serve at the pleasure of the mayor, and shall devote full time and attention to his or her duties and responsibilities as such.

(b)The director of the department of economic and communitydevelopment [manage-ment]shall be responsible, under the direction of the city administrator, for organizing, supervising and administering that department, including any specific duties and responsibilities as directed by the mayor and city council.

Sec. 466. - Director of the department of fire marshal and permit services.

(a)There shall be a director of the department of fire marshal and permit services appointed by the mayor, subject to the confirmation of the city council. His or her compensation shall be determined by the city council. The director of the department of fire marshal and permit services shall serve at the pleasure of the mayor, and shall devote full time and attention to his or her duties and responsibilities as such.

(b)The director of the department of fire marshal and permit services shall be responsible, under the direction of the city administrator, for organizing, supervising and administering that department, including any specific duties and responsibilities as directed by the mayor and city council.

AND, BE IT FURTHER RESOLVED, that any provision of the City Charter that is inconsistent with the amendments contained in this Charter Resolution are hereby repealed.

AND, BE IT FURTHER RESOLVED, that the date of adoption for this Charter Resolution is the 26th day of September, 2016, and that the amendment to the Charter of the City as herein adopted, shall be and become effective on the 15thday of November, 2016 unless on or before the 7thday of November, 2016, a Petition for Referendum on this Charter Resolution meeting the requirements of §4-304 of the Md. Local Government Code Ann. is filed in writing, with the Mayor or City Administrator by 5:00 p.m. on the 7th day of November, 2016.

AND BE IT FURTHER RESOLVED,that a complete and exact copy of this Resolution shall be posted at the City of Laurel City Hall for a period of at least forty (40) days following its adoption.

AND BE IT FURTHER RESOLVED, that a fair summary of the proposed Charter Amendment contained in this Resolution shall be published in a newspaper of general circulation in the City of Laurel not less than four (4) times, at weekly intervals, within a period of at least forty (40) days after adoption of this Resolution.

AND BE IT FURTHER RESOLVED, that as soon as the Charter Amendment hereby enacted shall become effective, either as herein provided or following a Referendum, the Mayor shall promptly deposit with the Maryland Department of Legislative Reference, a complete copy of this Resolution including:

1.The date of the Referendum election, if any;

2.The number of votes cast for or against this Resolution whether by the City Council or in referendum; and

3.The effective date of the Charter Amendment contained herein.

The transmittal to the Maryland Department of Legislative Reference shall be in accordance with the provisions of §4-109 and Division II, Title 4, Subtitle 3 of the Local Government Article of the Annotated Code of Maryland, and any other applicable law.

ADOPTED AND ENACTED BY THE CITY COUNCIL OF THE CITY OF LAUREL, MARYLAND, this day of , 2016.

AND, BE IT FURTHER RESOLVED, that this Resolution shall take effect fifty (50) days from the date of its passage, unless on or before the fortieth day a petition for referendum is filed in accordance with the applicable provisions of Division II, Title 4, Subtitle 3 of the Local Government Article of the Annotated Code of Maryland.
