CAUCUS MEETING

SEPTEMBER 16, 2008

9:30 A.M.

Members Present: Present were Mayor William Henfey, President of Council Patrick Rosenello, Councilpersons Robert McCullion, Edwin Koehler, Joseph Duncan, Kellyann Tolomeo, Richard Ogen and Robert Maschio. Also present were City Administrator Raymond Townsend and Solicitor William Kaufmann.

RESOLUTION:

RE: Closed Meeting – Litigation

The above resolution was offered by Duncan, seconded by McCullion, the roll being called, all voting in the affirmative, the President of Council declared the resolution duly adopted.

On a motion by Koehler, seconded by Duncan, that Council now return to open session. Carried. 9:36 AM

COUNCIL PRESIDENT ROSENELLO noted the new ordinance for today regarding feeding wildlife already lists wildlife and does not feel the animals need to be listed separately. New Ordinance #1552 was brought up with CFO Ross Versaggi noting State Legislation recently adopted that as of July 1, 2008 certain appointments must be enrolled in DCRP instead of PERS. Versaggi stated we must send an adopted Ordinance to DOP to create a list. Persons already in PERS can stay but new persons hired must be placed in DCRP. Versaggi stated we were supposed to have this Ordinance adopted in June. Koehler asked what will the State do if we wait for a month with Henfey noting we are currently paying for pensions to the State such as attorney, prosecutor, planning/zoning attorney. Townsend noted changes will be made in future hiring of these positions. Mayor Henfey questioned why the Park Superintendent is not included but the Public Works Superintendent is included. Versaggi was asked to get a final determination as to who is included from the State pension Department and then we will send our paperwork to the State. Rosenello stated we will hold this introduction of this Ordinance today (Ordinance #1552).

COUNCILPERSON OGEN asked to amend the paperwork for introduction of Ordinance #1547 today to include “or any vacate lot”. Solicitor will make that amendment.

ADMINISTRATOR TOWNSEND mentioned the Trash – Waste Management Contract and would like to extend their contract with us until December 2009. No objections were noted and Townsend was asked to move forward with extending as permitted by law. Also resolution #3 (Grant from NJ Historic Trust) has been hanging for two years and finally needs to move forward at this meeting. Townsend noted the bench program is moving forward and progressing.

On a motion by Koehler, seconded by Duncan, Council now close the Caucus meeting and go to open session for the regular meeting. Carried. 10:10 AM

10:15 A.M.

A regular meeting of the North Wildwood City Council was held on the morning of the above date in the City Hall. The President of Council stated that “The meeting is now open. Adequate notice of this meeting has been provided by posting a copy of the notice of the time and place of this meeting on the City Clerk’s bulletin board and by mailing a copy of the same to The Herald, The Press and Wildwood Leader on January 3, 2008.”

Also present were City Administrator Raymond Townsend, Solicitor William Kaufmann and Engineer Ralph Petrella.

MINUTES: On a motion by Maschio, seconded by McCullion, that the minutes of the regular meeting of September 2, 2008 and the special meeting of September 11, 2008 be approved as read. Carried, with Rosenello abstaining on the September 2, 2008 meeting.

The Clerk read Ordinance No. 1548 by its title, as required by Law, known as “An Ordinance Amending And Supplementing Those Ordinances That Have Been Codified In Chapter 402, Taxicabs, Of The Code Of The City Of North Wildwood.”

This Ordinance has been published according to Law, posted on the City Clerk’s bulletin board with copies available in the City Clerk’s Office on request.

The President of Council stated this was the time and place to hold a public hearing on Ordinance No. 1548 and asked if anyone present had any objections to the passage of this Ordinance. Jim Koch, 1301 Surf Avenue, asked if the State Public Utilities (PUC) oversees Taxi’s with the answer no. Mayor Henfey reviewed the new taxi charges adding also additional passengers are $1.00 extra. Council President Rosenello stated these fees must be posted in the cabs and also the amount charged must be confirmed before the start of ride. Koch noted Atlantic City has signage posted on their cabs. Maschio noted inside posting and also outside posting. Police Chief and Police Captain has met with the cab companies regarding the signage needed. Maschio asked where does Wildwood and Wildwood Crest stand with the Mayor stating they are currently reviewing their ordinances. Council President Rosenello then asked the Clerk if she had received any objections in writing, the Clerk stated none, the President of Council declared the hearing closed.

On a motion by Duncan, seconded by Koehler, that Ordinance No. 1548 be passed on its second reading and published according to Law, the roll being called, all voting in the affirmative, the President of Council declared Ordinance No. 1548 duly adopted.

ORDINANCE NO. 1547 - On a motion by Ogen, seconded by Koehler, that Ordinance No. 1547 be placed on its first reading. Carried.

The Clerk read Ordinance No. 1547 by its title, known as “An Ordinance Repealing And Replacing Those Portions Of Ordinance 1393 And Those Portions Of Any Other Ordinances That Have Been Codified At Section 276-34b(9) Of The Code Of The City Of North Wildwood.”

On a motion by Ogen, seconded by Koehler, that Ordinance No. 1547 be passed on its first reading and published according to Law, the Clerk called the roll, all voting in the affirmative, the President of Council declared Ordinance No. 1547 passed on its first reading.

ORDINANCE NO. 1549 - On a motion by Duncan, seconded by Tolomeo, that Ordinance No. 1549 be placed on its first reading. Carried.

The Clerk read Ordinance No. 1549 by its title, known as “An Ordinance Amending §322-4l Of The Code Of The City Of North Wildwood Concerning Prohibited Activities In Public Parks.”

On a motion by Duncan, seconded by Tolomeo, that Ordinance No. 1549 be passed on its first reading and published according to Law, the Clerk called the roll, all voting in the affirmative, the President of Council declared Ordinance No. 1549 passed on its first reading.

ORDINANCE NO. 1550 - On a motion by Koehler, seconded by McCullion, that Ordinance No. 1550 be placed on its first reading. Carried.

The Clerk read Ordinance No. 1550 by its title, known as “An Ordinance Amending Ordinance 1511 as Codified at Chapter 126 Article V of the Code of the City of North Wildwood.”

On a motion by Koehler, seconded by McCullion, that Ordinance No. 1550 be passed on its first reading and published according to Law, the Clerk called the roll, all voting in the affirmative, the President of Council declared Ordinance No. 1550 passed on its first reading.

On a motion by Koehler, seconded by McCullion, that Ordinance No. 1551 be passed on its first reading and published according to Law, the Clerk called the roll, all voting in the affirmative, the President of Council declared Ordinance No. 1551 passed on its first reading.

ORDINANCE NO. 1552 was pulled for a introduction at a later meeting.

ORDINANCE NO. 1553 - On a motion by Koehler, seconded by Ogen, that Ordinance No. 1553 be placed on its first reading. Carried.

The Clerk read Ordinance No. 1553 by its title, known as “Bond Ordinance Providing For Sanitary Sewer Improvements Project (Phase Ii) In And By The City Of North Wildwood, In The County Of Cape May, New Jersey, Appropriating $6,100,000 Therefor And Authorizing The Issuance Of $6,100,000 Bonds Or Notes Of The City To Finance Part Of The Cost Thereof.”.

On a motion by Koehler, seconded by Ogen, that Ordinance No. 1553 be passed on its first reading and published according to Law, the Clerk called the roll, all voting in the affirmative, the President of Council declared Ordinance No. 1553 passed on its first reading.
