Short Term Rental Agreement

This Short Term Rental Agreement (the “Agreement”) is made by and between Moose Lodge at Crooked Creek, LLC (“Moose Lodge at Crooked Creek”) and Tenant(“Tenant” or “Tenants”) as of the date last set forth on the signature page of this Agreement. For good and valuable consideration, the sufficiency of which is acknowledged, the parties hereby agree as follows:

  1. GENERAL

While Moose Lodge at Crooked Creek is a lodge that we rent to guests, it is also ourfamily’s home. We hope that you and your guests will enjoy it immensely, while respecting that it is our home.

PROPERTY. The property is located at: 441 County Road 5174, Fraser, CO 80442.

TERM OF SHORT TERM RENTAL. The lease begins at 4 p.m. ondate (the “Check-in Date”) and ends at 10 a.m. on date(the “Checkout Date”).

  1. PAYMENTS AND CANCELLATIONS

PAYMENT. The appropriate deposit is due upon the signing of this agreement and will ensure your reservation. 50% of the remaining balance is due two months prior to first day of rental. The final payment is due one month prior to rental. Payments by personal check or major credit card only. If you would like to pay via credit card, please contact Nancy at 720-878-8782.

CANCELLATIONS. A sixty (60) day e-mail notice is required for cancellation. Cancellations that are made more than sixty (60) days prior to the arrival date will be fully refunded with the exception a 5% of total rental charge cancellation fee or $100, whichever is greater. Cancellations that are made within 60 days of the arrival date forfeit any advanced payments. No-shows or early departure do not warrant refund of rent.

STORM POLICY/ROAD CONDITIONS. No refunds will be given for storms. Mountain roads can be curvy and steep. The driveway is well maintained, however it is highly recommended to have four wheel drive during the snow months. If I-70 or Berthoud Pass is closed due to a storm and delays your arrival, we will come to a suitable agreement.

  1. SECURITY/DAMAGE AGREEMENT

SECURITY DEPOSIT. A security deposit of $1500 ($3000 for wedding rentals) shall be paid to Moose Lodge at Crooked Creek, in the form of a personal check, to be held in trust, uncashed as security for the performance by the Tenants of the terms under this Agreement. Moose Lodge at Crooked Creek may use part or the entire security deposit to repair any damage to the Lodge caused by Tenants. However, Moose Lodge at Crooked Creek is not limited to just the security deposit. Tenants remain liable for any balance that may be due in order to repair any damage or replace any missing items. Any unused portion of the security depositshall be returned to Tenant within (14) days of departure, provided the following provisions are met:

  • No damage is done to Moose Lodge or its contents, beyond normal wear and tear. Please note, there are items that are tempting for young children to touch and play with. You will be responsible for breakage to any of these items.
  • No charges are incurred due to smoking in the home, and stains on carpeting, pets or collection of rents or services rendered during the stay.
  • No linens or other property in the unit are lost or damaged.
  • No early check-in or late check-out, unless negotiated and approved in writing by Moose Lodge at Crooked Creek.
  • The Tenant or tenant’s guest are not evicted by the Moose Lodge at Crooked Creek (or representative of the Moose Lodge at Crooked Creek) or the local law enforcement.
  • Proper Usage and Closing instructions are followed including but not limited to:
  • All debris, rubbish and recycles are disposed of as instructed in visitor instructions
  • Dirty dishes are placed in the dishwasher and the dishwasher run
  • All beds stripped down to the mattress pad and dirty linens put in the laundry room
  • The heat is turned down per lock up instructions
  • The key is left in the lock box and all exterior doors are locked
  • Hot tub instructions are followed including treatment with chemicals and the cover strapped down

If excessive time is required to arrive at an agreement on fees, obtain bids and oversee work to return the home to the pre-damaged condition, a management fee based on time spent by the manager will be assessed.

DAMAGE CHARGE. Any damage charges incurred by the Tenants not covered by the security deposit listed above shall be assessed to the Tenant.

  1. OCCUPANCY AND STAY REQUIREMENTS

MAXIMUM OCCUPANCY. The maximum number of guests is limited to eighteen (18) persons. Upon management approval of additional persons, an additional charge or $10 per extra person per night will be assessed.

MINIMUM STAY. A two night minimum is required. Longer minimum stays are required during holiday periods.

  1. RATES AND INCLUSIVE FEES

INCLUSIVE FEES. Rates include a one-time linen-towel setup for up to 18 guests. A sheet set and towel will be placed on each bed for your use while at Moose Lodge. This lets you know that the linens are clean for your use. Beds must be made up with sheets and pillowcases rather than sleeping directly on the mattress cover and under the duvet. If sheets are not used, a substantial charge will be made for dry-cleaning the duvet covers and washing bulky mattress covers. Moose Lodge requests that towels not be taken from the lodge. You may want to bring your own beach towels if you are going to one of the nearby lakes or streams.

AMENITIES. Rates include the use of many amenities including but not limited to a hot tub, gas grill, media systems, appliances, laundry facilities, etc.

HOUSEKEEPING. Your stay includes cleaning of the lodge following your stay, covering customary cleaning due to your group’s stay at the Lodge, including linen washing. There is no daily maid service provided, although management can arrange this for you if you desire. Tenants shall be responsible for covering any undue and/or unreasonable cleaning of the unit due to their stay at the rate of $50 per hour per cleaner, with a one (1) hour service minimum.

RATE CHANGES. Rates subject to change without notice prior to the signing of the rental agreement.

  1. CHECK-IN/CHECK-OUT PROCEDURE

CHECK IN. Check in time is 4:00 pm on the day Tenant’s scheduled reservation begins. No early check-in or late check-out without prior written (e-mail) approval by management. Upon final payment, Tenants will be given a detailed map to the property, access codes to the home as well as visitor instructions to the Lodge.

CHECK OUT. Check-out is at 10:00 am. Any delay in check-out from the customary time, absent written management approval, shall result in Tenants being charged $150 per hour or any portion of an hour. Please follow closing-up instructions as provided at time of final payment.

  1. USE AND ENJOYMENT OF PROPERTY

USE OF PREMESIS. Tenants shall only use the Premises as a vacation residence. Tenants will comply with all laws, rules, ordinances, statutes and orders regarding the use of the premises.

SMOKING. Smoking is NOT allowed in the Lodge or on the premises.

PETS. Pets are not allowed in the Lodge and may not be kept in the garage during stays.

USE OF GRILLS. Grilling is permitted using grill provided only.

FIRE-PIT. Fire-pit in the valley used only under responsible adult supervision with a hose from the home hooked up and accessible from the fire-pit. Local no-burn sanctions MUST be obeyed.

HOT TUB. Children under the age of 12 must be supervised at all times while using the hot tub. There are certain health risks associated with hot tub use. Use at your own risk.

  • The hot tub takes quite a few hours to warm up so it is best not to plan to use it the first night.
  • Hot tub covers are for insulation purposes and are not designed to support a person or persons. PLEASE do not sit or stand on the hot tub cover. It will break and you will be charged for the replacement. Leave cover on when not in use so hot tub will stay warm. The latches for the hot tub must be fastened when not in use to prevent the hot tub cover from blowing off, damaging it and nearby lighting/windows.
  • Service personnel may come out during your stay to service the hot tub. They will access the hot tub by going around the home.
  • If the hot tub needs to be serviced due to your lack of following protocol, an assessment of $150 for draining, cleaning and refilling will be made.

TRASH. It is imperative that you utilize the trash compactor to decrease trash. Excessive trash due to not using trash compactor may result in added expenses assessed to Tenant.

GARAGE. The garage is heated. Please leave the garage door closed so as doing so will make it exceedingly hard for the house to stay heated.

LOCKED AREAS. Areas that are locked, such as Moose Lodge at Crooked Creek’s storage spaces, for which Tenants are not provided a key, are off-limits to the Tenants. Tenants will be liable for any damage and/or missing items at full replacement value.

RECREATIONAL VEHICLES. Use of snowmobiles and 4-wheelers on the property is NOT allowed.

SLEDDING. Sledding on the hill in front of the lodge should only be used with full assumption of the risks inherent in that activity.

ADJACENT PROPERTY.Crooked Creek Ranch, a Young Life camp property, is located to the west on County Road 517. This is a private camp for middle and high school students. For the safety of the campers, only invited guests are allowed on camp property. To honor our commitment to be good neighbors, Moose Lodge renters need to respect that this property is entirely off-limits. Please honor your agreement with Moose Lodge by not walking, biking or driving through this property.

  1. WEDDING VENUE ADDITIONAL INSTRUCTIONS

TRASH. All rental debris, rubbish and recycles must be disposed of as instructed in visitor instructions. Extra rubbish due to wedding MUST be removed by caterer OR arrangements must be made for an extra trash pick-up by Moose Lodge Trash removal ($75-$150).

TENT. If a tent is going to be put in the driveway, utilities MUST be located by a locating service to prevent putting a stake through the electrical or gas service lines. That would really crimp your festivities as well as produce additional repair charges.

SOUND.Please be aware that the Grand County Outdoor Sound Ordinance prohibits amplified sound after 9:30 p.m. Out of respect for our adjacent neighbors outdoor receptions must be moved indoors by 11:00 p.m.

  1. HOLD HARMLESS
  • Moose Lodge at Crooked Creek expresses no guarantees, express or implied, regarding suitability for any particular purpose, except that Tenant shall enjoy quiet possession of the premises. It is Tenant’s responsibility to immediately notify Moose Lodge at Crooked Creek of any issues that occur during their stay so that the repair and/or replacement may be promptly taken care of. Moose Lodge at Crooked Creek is not responsible for any situation management has no immediate control. No refunds or rebates will be made for inconveniences that may include, but are not limited to, the following: breakdown of TV’s or other media units, hot tub, non-essential appliances or devices, power outages, adverse weather and/or road conditions and construction in the area. In the event of the mal-function of the heating system and essential kitchen appliances (stove, oven and refrigerator), Moose Lodge and Tenant will come to an agreement for partial refund based on the situation.
  • Moose Lodge at Crooked Creek shall not be held liable, or otherwise take any responsibility for any injuries that may occur to Tenant, and or Tenant’s invitee, that is caused or permitted to be caused by the intentional, unintentional, negligent, or careless acts of said Tenants, and/or invitees. By the written or electronic endorsement of this Agreement, Tenant agrees to forever hold-harmless and indemnify Moose Lodge at Crooked Creek from any liability and/or responsibility arising there from.
  • Moose Lodge at Crooked Creek is not responsible for the loss of personal belongings or valuables of the guest.
  • WRITTEN EXCEPTIONS – Any agreed upon exceptions to the above mentioned policies must be added to this document in advance, with the exception of later documented exceptions to check-in and check-out times.

MISC.. THIS AGREEMENT, COMBINED WITH ANY AND ALL LAWFUL REGULATIONS, SERVES AS THE ENTIRE AGREEMENT. NO ADDITIONAL PROVISIONS ARE EXPRESSED OR IMPLIED. THIS AGREEMENT SUPERCEDES ANY AND ALL PREVIOUS ORAL AND/OR WRITTEN, EXPRESS AND/OR IMPLED AGREEMENTS. UPON WRITTEN OR ELECTRONIC ENDORESMENT, TENANTS AGREE THAT THEY HAVE READ AND UNDERSTOOD THIS AGREEMENT, AND ACCEPT ALL TERMS, CONDITIONS, COVENANTS AND RESTRICTIONS, WITHOUT EXCEPTION. In the event Tenant or Moose Lodge at Crooked Creek fails to perform any of its obligations under the Agreement, or in the event a dispute arises concerning the meaning or interpretation of any provision of the Agreement, the defaulting party, or the party not prevailing in such dispute, as the case may be, shall pay any and all costs and expenses incurred by the other party in enforcing or establishing its rights hereunder, including, without limitation, court costs and reasonable attorneys’ fees. Venue shall be proper in Boulder County, CO. If there is more than one person as Tenant, they shall be jointly and severally liable. This Agreement may only be revised in writing signed by both the Moose Lodge at Crooked Creek and Tenant.

The parties agree to the terms of this Short Term Rental Agreement, as evidenced by the signatures set forth below.
