1.0  General Information

1.1  Invitation

GWL Realty Advisors Inc. acting as the property managers for the subject buildings as listed below and in the schedule, is requesting proposals from selected firms for work as per the schedule of work and attached Engineering documents as prepared by GWL Realty Advisors Inc. All associated work including any code upgrades is to be included. Provide a complete replacement to meet existing system performances, materials and configuration in addition to any further instructions outlined in section 4.

1.2  Acceptance of Proposals

GWLRA reserves the right to reject any or all proposals received and also reserves the right if it is in its interest to do so, waive informalities in the Proposal or failure to comply with all bidding requirements. The lowest Proposal will not necessarily be accepted.

Bids will not be accepted from any other bidder other than those invited.

1.5  Invited Bidders:

This tender is open to invited bidders.

Bids will be opened and reviewed in private. GWLRA may retain the services of an engineering consultant as required to review all submissions.

2.0 General

This is a turnkey proposal with all required work included in the fixed price bid.

Successful bidders will be required to enter in to a contract with GWL Realty Advisors Inc.

CCDC2 will be used for this project.

2.2  Site Contacts/Visits

A group site tour has been arranged for Monday, August 21st, 2017 at 2:00 PM. All bidders to meet on site at 6943 68 Ave NW.

2.3  Consultants

GWLRA will act as the Consultant for this project. Project documents are as per attached Appendix III.

All communications and inquiries are to be directed through GWL Realty Advisors Inc at the above noted address and phone numbers.

2.4  General

Before bidding the contractor is to perform a thorough site visit and investigation to determine the extent and nature of all conditions affecting work. Bids are to include costs of all permits required, freight, government duties and taxes. Bidders are to be fully responsible for all work required ensuring the system is fully operational, performs to the required standards and meets all existing capacities and system performances. Any discrepancies between bid information and conditions on site are to be communicated to GWLRA ensuring clarification can be issued to all bidding parties if necessary.

The proposal is all inclusive, there will be no extras.

4.1 General

4.1.1  Before bidding the contractor is to perform a thorough site visit and investigation to determine the extent and nature of all conditions affecting the work including disposal methods, rough openings, work site staging areas, section reinforcement, linkages, rods, framing, etc.

4.1.2  Bids to include costs of all permits required, freight, government duties and taxes.

4.1.3  Bidders are to be fully responsible for all work required ensuring the system is fully operational and performs to the required standards.

4.1.4  Contractor shall arrange for initial startup meeting with GWLRA to confirm construction schedule to include start dates, equipment deliveries and expected completion dates.

4.1.5  Contractor to provide full safety accreditation to GWLRA, conduct regular “tool box” safety meetings and provide minutes of such to GWLRA

The proposal is all-inclusive there will be no extras.

Construction Rules & Regulations

1.0  General

1.1 The Property Manager and staff are available to help the contractor. Written approval from the property manager as per call for proposal must be obtained prior to commencing any work.

1.2 All revisions and changes during construction must be approved by GWLRA prior to implementation and be clearly incorporated on record drawings.

1.3 GWLRA will be entitled to inspect the premises to ensure compliance with these regulations. The ultimate responsibility for ensuring compliance shall rest solely with the contractor.

1.4 All Contractors are to ensure that an above standard of verbal communication and documented reporting is developed and maintained with the Property Manager, as may be required by the Manager. The contractor will conduct weekly site meetings with the owner during this project.

1.5 All noise generated by the contractor work that may be objectionable to the building tenants is to be performed after hours

2.0 Approval for Construction

2.1 No construction may commence without the following:

2.1.1 Obtaining permits as required and supplying a copy to the Landlord.

2.1.2 Providing a copy of insurance minimum of 5 (five) million dollars naming “GWL Realty Advisors Inc” as insured.

2.1.3 Vehicle Insurance with minimum 3 (three) million dollars naming “GWL Realty Advisors Inc” as insured.

2.1.4 Providing copy of Workers Compensation Board registration for Contractor.

2.1.5 Providing completed Access Permit Form. (Appendix I).

2.1.6 Contractors Safety Procedures Manual is submitted and approved by GWLRA.

2.1.7 A construction start-up meeting is held with the Property Manager or his representative.

Contractors starting construction prior to the above, or not adhering to the provided methods or procedures, will be removed from the job site at the discretion of GWL Realty Advisors Inc.


3.0 Codes and Regulations

3.1 Contractors must meet all requirements of the public authorities that have jurisdiction over the work being performed.

3.2 All codes, ordinances, rules and regulations as they apply and will affect the building must be adhered to. Items that affect the building must be brought to the attention of the Operations Manager for approval.

3.3 The Contractor personnel may be working in areas in the Building where security is vital. The Contractor shall not permit any personnel to enter the Building who has a prior conviction for any offense involving theft, fraud or other dishonesty for which such person has not received a pardon under the Criminal Records Act Canada without the Manager’s prior written consent, which consent may be withheld in the Manager’s sole discretion. The Contractor shall take all reasonable steps to comply with this provision and shall properly notify the Manager of the arrest of conviction of any Contractor personnel who is working in the Building.

3.4 The Contractor shall procure keys and pass cards for the performance of Services by submitting a request to the Operations Manager representative. The Manager will hold them accountable for keys and pass cards issued to them during this Agreement. In addition, the Contractor shall not duplicate or attempt to duplicate keys that are issued by the Manager and any such duplication or attempt to duplicate keys shall be cause for termination of this Agreement by the Manager without prior notice. All personnel shall sign the “Building Register Sheet” each and every time they enter or leave the Building. The log will be kept at the Manager’s designated Security office or such other location as the Manager determines.

3.5 The Contractor is responsible for the safety of all Personnel and for assuring continuing safe conditions in the Building in connection with the Services. They shall at all times comply with all federal, provincial and local laws, statures, rules, regulations, notices, orders and amendments thereto respecting occupational health and safety, worker’s compensation and the safe condition of the Building and any licensing, bonding and permit requirements in connection with the Services.

3.6 The Contractor shall defend, indemnify and hold harmless the Manager, Owner, Affiliates and the respective present and former directors, officers, agents, servants and employees of the Manager of Affiliates from and against any and all claims, demands, liens, encumbrances, orders and awards (all of which collectively referred to as “Claims”) by any Person, together with all legal fees and disbursements, on account of, or arising as a result of: (1) injury to, or death of, any Person, including but not limited to Contractor Personnel; (2) loss of, or damage to any property; or (3) the employment of, or performance of Services by, Contractor Personnel and the termination, constructive or otherwise, of such employment or performance of Services; but all of the foregoing shall apply only to the extent that the foregoing relate to or result from or are caused by the performance or non-performance of the Services or a product supplied or to be supplied under or in connection with this Agreement.

3.7 In the event that any action, suit, or other proceeding is instituted to remedy, prevent, or obtain relief from a breach of this Agreement, or arising out of a breach of this Agreement, the prevailing party shall recover from the non-prevailing party all of its legal fees incurred in each and every such action, suit, or other proceeding.

3.8 In the event that any provisions of the Agreement should be held to be void, void able or unenforceable, the remaining portions hereof shall remain in full force and effect.

3.9 No officer, director, shareholder, employee or other agent of the Manager or its Affiliates shall have any personal liability in connection with this Agreement. In the event of a sale of the Building while this Agreement is in effect, the purchaser shall be deemed to have assumed this Agreement, and the Manager shall hereafter be released from any liability hereunder accruing after the date of such sale.

4.0 Insurance

4.1 All Contractors shall at all times during the Term, and any extension of this Agreement, at its sole cost and expense, obtain and maintain the following insurance which shall name the Manager and Owner expressly as an additional insured, and which shall insure The Manager and the Contractor against all of the various claims, liabilities and legal feels including (1) comprehensive, general liability, automobile liability and business interruption; (2) contractually assumed liability to cover the liability assumed by the Contractor; (3) applicable Workers’ Compensation; (4) completed operations; and (5) any other insurance requested by the Manager and related to such services. Unless expressly specified to the contrary in this Agreement, such insurance shall be in the sum of at least $5,000,000.00 (five million) per occurrence for injury to, or death of persons, and $5,000,000.00 (five million) per occurrence for property damage. The Contractor shall deliver to the Manager, prior to the commencement of any services hereunder; the Manager shall approve copies of policies of such insurance and each such policy. No policy shall be cancelable or subject to reduction of coverage except after sixty (60) days prior written notice to the Manager. The Contractor shall provide the Manager with a fidelity bond providing coverage up to $100,000.00 (one hundred thousand) on each Contractor Personnel for losses resulting from the fraudulent or dishonest acts of all Contractor Personnel. Valid copies of all insurance certificates shall be supplied to the Manager during the term of this contract. The Contractor is notified that the Manager can from time to time, revise the above insurance requirements, as it deems necessary. The Contractor agrees to waive all subrogation rights in favor of the Manager in regards to the above insurance in effect. The Contractor must submit a Letter of Good Standing from Worker’s Compensation before the expiration of the then current certificate.
