FENCE AFFIDAVIT

The undersigned, being duly sworn, hereby depose and say:

1.That deponent(s) is/are the owner(s)/seller(s) of real property known as ______(the “Premises”).

2.That her/his attention has been directed to an Instrument Survey Map of the Premises prepared by ______, dated ______, 200__, a copy of said map being attached hereto and made a part hereof, which shows a fencelocated _____feet (inside) (outside) the ______boundary line of the Premises.

3.This fence is owned and maintained by me/us and I/wehave access to the Premises regardless of the fence placement. I/we maintain the grass and the evergreen trees that lie between the fence and the boundary line.

4.To the best of my/our knowledge the fence was originally erected in its present location for privacy between the two houses and was placed inside the ______boundary line so as not to disturb the evergreen trees.

5.Also to the best of my/our knowledge,no dispute exists as to the present location of the fence(s) as surveyed and no demand has been made to remove the fence.

6.This Affidavit is made to induce the Purchaser to accept title to the Premises, to induce any bank/lender to grant a mortgage loan, and to the title insurance company issuing a title policy knowing that the truth of these statements will be relied upon.
