Board Chairman Tyler called the Board of Supervisors meeting to order; the Invocation was offered by Vice Chairman Caple.

Commission Chairman White called the Planning Commission meeting to order.

PUBLIC HEARING

ON MOTION OF SUPERVISOR CAPLE, seconded by SUPERVISOR COLLINS and carried: RESOLVED that the Sussex County Board of Supervisors shall enter public hearing to consider Conditional Use Permit #2007-02, Sussex Service Authority, applicant.

Conditional Use Permit #2007-02

Statement

Pursuant to Sections 16-22(19.2) and 16-72(8) of the Zoning Ordinance, the applicant Sussex Service Authority (SSA) seeks a conditional use permit to allow construction of new 4” sewer force main, 6” waterline and associated facilities. The proposed water and sewer lines serve approximately thirty-six (36) residential dwellings.

Location

The project area is located in the Wakefield Election District and begins at the intersection of Route 31 (Birch Island Road) and Route 617 (Rocky Hock Road) and continues north along Route 31 for approximately 8,300 linear feet (see attached map).

Findings

The general area of the project may be characterized as rural residential. Surrounding land use includes single family dwelling units, open land and woodlands. The proposed water and sewer pipelines will be located underground outside of VDOT’s right-of-way in an easement dedicated to the Sussex Service Authority and will extend approximately 8,300 linear feet.

The project will be funded utilizing “Self-Help” grant monies awarded to the Town of Wakefield from the Virginia Department of Housing and Community Development (DCHD). The project will benefit households along Route 31 with failing wells and septic systems. Under the Self-Help Program, volunteers from the community perform the majority of the physical labor while guided by the technical expertise of the Sussex Service Authority (SSA).

FutureLand Use Designation

The Comprehensive Plan has the site in question designated for future residential development.

Recommendation

Staff recommends approval of Conditional Use Permit Application #2007-02 for the following reasons:

1)The proposed water and sewer utilities are consistent and compatible with existing land uses in the area.

2)The impacts due to installation of the water and sewer utilities will be minor and temporary.

3)The water and sewer utilities will not alter the character of the surrounding area.

4)The water and sewer utilities are needed to address a local public health and safety concerns and will serve to improve the quality of life of residents in the project area.

To date, staff has received no objections to Conditional Use Permit Application #2007-02.

Overview of Comprehensive Plan/Land Use Ordinance

Mr. William Turner, of Community Planning Collaborative gave a presentation of the Comprehensive Plan and Land Use Ordinance to the Planning Commission and Board of Supervisors. Copies of the proposed changes had been distributed to the members prior to the meeting. Public Hearings must be scheduled. Mr. Andre M. Greene, Director of Planning, addressed the Planning Commission and Board of Supervisors with changes to the Zoning Ordinance and Subdivision Ordinance regarding minimum lot size and family division of land.
