CONDITIONS
This Equivalency Certificate authorizes Power Tech Industries to handle, offer for transport or transport, and authorizes any person to handle or transport on behalf of the certificate holder, by road or railway vehicle, or by ship on a domestic voyage, dangerous goods that are included in Class3, Packing GroupII or Packing GroupIII, in a means of containment that does not comply with Part5 (Means of Containment) of the Transportation of Dangerous Goods Regulations, if:
(a) the means of containment:
(i) is not permanently mounted on a truck chassis or trailer, is not intended for the transportation of dangerous goods, and the presence of dangerous goods is due only to the use of the means of containment for the processing, storage or use of the dangerous goods at fixed locations,

CONDITIONS
(ii) prior to moving, is emptied to the maximum extent possible, and the residual amount of the dangerous goods never exceeds the lesser of the following volume in content when in transport:
(A) 500 L, or
(B) 5% of the capacity of the means of containment,
(iii) is designed, constructed, closed, secured, and maintained so that under normal conditions of transport, including handling, there will be no accidental release of dangerous goods that could endanger public safety, and
(iv) when inverted, will not release dangerous goods;
(b) the means of containment is loaded and secured on the means of transport in such a way as to prevent, under normal conditions of transport, damage to the means of containment or to the means of transport that could lead to an accidental release of the dangerous goods;
(c) the means of containment covered by this Equivalency Certificate are removed from service before January1st,2020;
(d) in addition to the requirements of Part 6 (Training) of the Transportation of Dangerous Goods Regulations, the certificate holder ensures that the personnel handling, offering for transport or transporting the dangerous goods is trained in regards to the conditions of this Equivalency Certificate;
(e) the shipping document that accompanies the dangerous goods includes the following information legibly and indelibly printed:

CONDITIONS
(f) the equipment used to heat and circulate production fluids such as petroleum crude oil, in oilfield applications are excluded from the application of this certificate.
Note: The issuance of this Equivalency Certificate in no way reduces the certificate holder's responsibility to comply with any other requirements of the Transportation of Dangerous Goods Regulations, the Technical Instructions for the Safe Transportation of Dangerous Goods by Air, the International Maritime Dangerous Goods Code, and the Canadian Aviation Regulations not specifically addressed in this certificate.

Explanatory Note
This Equivalency Certificate authorizes the transportation of dangerous goods that are included in Class3, Packing GroupII or Packing GroupIII, in means of containment that do not comply with the requirements set out in Part 5 (Means of Containment) of the Transportation of Dangerous Goods Regulations. The means of containment may contain residual amounts of dangerous goods due to storage, processing or use of dangerous goods at fixed locations. They must be emptied to the maximum extent possible prior to being transported. Any means of containment permanently mounted on a truck chassis or trailer, such as a highway tank, is considered to be intended for transportation and is not covered by this Equivalency Certificate.
The Transport Dangerous Goods Directorate has revised its policy on the transportation of non-specification means of containment. Over the past few years, Equivalency Certificates have been issued to authorize the use of non-specification tanks for the transportation of fuels. These Equivalency Certificates were required when no existing specification referenced in the Transportation of Dangerous Goods Regulations were adequate for a particular use.

Two new standards have recently been adopted in the Transportation of Dangerous Goods Regulations. These standards are CSA Standard B625-08, “Portable tanks for the transport of dangerous goods”, July 2008 and CSAStandard B626-09, “Portable tanks specification TC 44”, February 2009. With these two new standards, there are now several options available for the transportation of fuel in specification tanks:
1) Intermediate Bulk Containers (IBC) having a volume of 5 000 L or less under National Standard of Canada CAN/CGSB-43.146-2002, “Design, Manufacture and Use of Intermediate Bulk Containers for the Transportation of Dangerous Goods”, January 2002;
2) Portable tanks having a volume of more than 450 L under CSA Standard B625-08, “Portable tanks for the transport of dangerous goods”, July2008;
3) Portable tanks of specification TC 44 having a volume of 3 000 L or more under CSA Standard B626-09, “Portable tank specification TC 44”, February 2009.
The Transport Dangerous Goods Directorate has revised its policy on the issuance of certificates for the use of tanks which are not authorized for the transportation of fuels. It has determined that after January 1st, 2020, the use of non-specification tanks to transport fuels will no longer be authorized. Users of non-specification mobile tanks should therefore consider replacing their tanks with standardized tanks built to specifications authorized by the Transportation of Dangerous Goods Regulations.
This certificate will not be renewed beyond January 1st, 2020.
