APPLICATION FOR EQUIVALENCY ASSESSMENT

REG.8OF THE LAWYERS AND CONVEYANCERS ACT (CONVEYANCERS: REGISTRATION AND PRACTICE) REGULATIONS 2008

INFORMATION TO APPLICANTS

  1. If you wish to become registered as a Conveyancerand have over 10 years conveyancing experience, but do not hold a Diploma of Conveyancing, you may apply to the Society for an equivalency assessment to determine the extent to which your qualifications, training or experience (of which 2 years must be obtained within New Zealand or Australia) is the equivalent of the Diploma, and if not then what additional training or course of study is required to attain equivalency.
  1. You may be required to undergo an examination or other sort of assessment to determine this. If you are from overseas then you may be required to undertake a test or series of tests to establish whether you can communicate effectively in spoken and written English. You will be responsible for the cost of any examination, assessment, test, training, or course of study that you may be required to undergo to determine your equivalency and to complete it.
  1. Once the Society, or an approved provider acting on its behalf, has carried out the assessment you will be advised whether or not equivalency has been achieved or whether any additional training or study is required and if so what that is. If there is any further training or course of study required then this must be completed within 3 years of obtaining the equivalency assessment. If no further training or course of study is considered necessary the Society will advise that you are eligible under the equivalency assessment.
  1. When you have received advice from the Society that you are eligible under the equivalency assessment, you may then apply to the Society to be registered as a Registered Conveyancer.
  1. Information that you provide under this assessment will be held valid by the Society for 12 months, when applying to become a Registered Conveyancer.

Information to be provided:

In order to allow the Society to consider your application you must ensure that the following information is included in the application form or appended to it:

  1. Completed Application form (enclosed);
  1. Completed Statutory Declaration (enclosed);
  1. Photo identification (certified copy passport or drivers licence) andverification of residential address;
  1. Copy of your Curriculum Vitae;
  1. A written statement outlining your prior experience - ourPrior ExperienceGuidelines enclosed;
  1. Two references from your current and past employers

(Note: Your referees must have known you for a minimum of 2 years and hold a position of responsibility. Your referees cannot be from the same Firm).

Your referees should provide the following information in their reference:

  • Their full name, address and occupation
  • How long they have known you and in what capacity
  • Information relating to your character to satisfy the fit and proper person requirement and, if appropriate, any reasons why they consider you should not be registered as a conveyancer.
  • Subject to the provisions of the Criminal Records (Clean Slate) Act 2004, advise whether, to their knowledge, you have been convicted, discharged without conviction or been subject to diversion for any offence, or have any court action pending or been under medical attention which may reflect on your fitness as a registered conveyancer.
  1. The attached Ministry of Justice Criminal Request by Third Party is to be completed and returned to the Society for forwarding to the Ministry of Justice.
  1. Payment of non-refundable fee.

Please post all documents back to the Society for consideration by our Registration Authority.

NB That all of the information requested above must be submitted together with this form and Statutory Declaration. If you do not provide all of this information, it will take longer for your application to be processed.

Equivalency Assessment Fee = $845.50(incl. GST)

Please note you will be sent an invoice for this fee once the Society has received your Application for Equivalency Assessment.

I consent to the making of inquiries of, and the exchange of information with, the authorities and relevant professional bodies in New Zealand and or in any other jurisdiction regarding matters relevant to this application including criminal history, and any complaints or disciplinary action that may have been drawn to the attention of a relevant professional body.

I accept that my applicationwill be assessed and determined within 28 days from the date received by the Society and that the fee paid by me will not be refunded if my application is unsuccessful.
