AGREEMENT TO PROVIDE OUTFITTING SERVICES

THIS AGREEMENT, between Red Top Mountain Outfitters (“Jared Taylor”), whose registration number is O-3970 and whose address is 281 A Naranjo Creek Road La Jara, New Mexico 87027 and (X ______)

is made in La Jara, New Mexico, and is entered into as of the date of final execution of this Agreement.

IN CONSIDERATION OF THE PROMISES AND MUTUAL OBLIGATIONS HERIN, OUTFITTER AND HUNTER MUTUALLY AGREE AS FOLLOWS:

  1. FEES. Hunter shall pay to Outfitter amount determined after license draw. A deposit of $0 shall be paid upon booking of hunt. The balance shall be paid in cash or certified check prior to the first day of the hunt. New Mexico gross receipts tax will be applied to all hunts.
  2. HUNT SPECIES, PERIOD ANDLOCATION. Outfitter shall provide services to Hunter for a big game hunt (s) to take place in Game Management Unit Determined by draw results. The period of this hunt will be determined by draw results. Duration of archery hunts is 6 days. Duration of all firearm hunts will be 5 days.
  3. SERVICES. Outfitter shall provide the following service:
  4. Provision of and supervision of guide services that meet or exceed all legal requirements concerning number and licensure
  5. Meals and lodging beginning the evening prior to and ending evening of last day of hunt.
  6. Field dressing and field care of all harvested big game.
  7. Completion of the license application upon execution of a Power of Attorney and delivery of necessary fee amount.
  8. TERMINATION. Hunter may cancel the hunt at any time prior to commencement. Outfitter shall keep the amount of deposit as liquidated damages if hunter has a.) Drawn a tag in state draw b.) Given authorization to outfitter to purchase landowner permit for hunter (verbally or otherwise) c.) Chosen to roll deposit over from one year to next due to unsuccessful draw results.
  9. ASSIGNMENT. Hunter may not assign or transfer any interest in this Agreement without prior written approval by the Outfitter.
  10. SCOPE OF AGREEMENT. This Agreement incorporates all the agreements, covenants and understandings between the parties hereto. No prior agreement or understandings, verbal or otherwise, of the parties shall be valid or enforceable.
  11. APPLICABLE LAW. This agreement shall be governed by the laws of the State of New Mexico
  12. OTHER PROVISIONS. The parties agree to the following additional provisions.
  13. Hunter will require access to Rio Chama and San Pedro Wilderness areas.
  14. Any video footage obtained while hunting with Outfitter will recognize Red Top Mountain Outfitters as provider of Outfitting services.
