Accessible Apartments Addendum

This addendum dated______, is attached to and made a part of the Lease dated ______by and between ______referred to as the Landlord, and ______, referred to as the Tenant for apartment number ______, in the project known as ______.

  1. Persons With Disabilities in Accessible Apartments: The tenant acknowledges that should an apartment with accessible features be requested and if the household member needing the accessible features moves out of the apartment, then the remaining household members will be required to move to a non-accessible unit in accordance with the Rehabilitation Act of 1973 Section 504, paragraph 8.27 and Chapter 3-23. I of the HUD Handbook 4350.3. REV 1 Change 2.

  1. Persons Without Disabilities in Accessible Apartments: Persons without disabilities may be offered an accessible apartment in a manner consistent with the property’s tenant selection policy with the understand that moving to a non-accessible unit of the appropriate size within the same property will be required should the accessible unit be required by a household with a person(s) with disabilities.

Tenant will be notified by Landlord and will be required to transfer to the first available apartment of appropriate size at their own expense, thus allowing the household with a person(s) with disabilities to be house in the accessible apartment, in accordance with the Rehabilitation Act of 1973 Section 504, paragraph 8.27, by initialing this paragraph and Chapter 2-23. C-2 of the HUD Handbook 4350.3. REV 1 Change 2. ______(INITIAL IF APPLICABLE)
