We are writing to inform you of the situation of our zapotec brother Pablo López Alavés, who was kidnapped on August 15th of this year and one day later put in prison in Etla on fabricated charges of aggravated murder and attempted murder. The charges were brought by paramilitary members of the PRI, with the support of SEMARNAT, CONAFOR, and in turn government, as these are the people who benefit from the sale of forest resources. They do not care that the forest is dying, or that every day there is less water and more parasitic worms brought about by the disruption of ecological balance in this region that has for generations been cared for by the people of San Isidro Aloapam.

It is because our brother Pablo López Alavés has distinguished himself in his defence of the forest that the clear-cutters of San Miguel Aloapam are inventing serious charges so that he will never get out of prison. Because of this a petition for legal protection (1158/2010) against the committal for trial that the judge of Etla, Lucero Hernández Melchor, brought on August 18th, 2010. In this petition were mentioned irregulrities found in the dossier 102/2007, which demonstrate that there was not a real investigation, and Carlos Alberto Monterrubio Bohórquez of the Public Prosecution Officer (Ministerio Publico) asserts that authorities and witnesses from San Miguel have said that there is no basis in proof for the case brought against our brother.

We would like to thank all those who have accompanied us to audiences as well as those who helped bring the case to the third Third District judge of the State of Oaxaca, Amando Chiñas Fuentes, who on October 15th accepted the petition. This means that the bais of the committal to prison on the part of the judge of the Judicial District of Etla is being challenged as there is insufficient evidence of his responsibility.

We will have to wait until November 2nd for the sentence to be confirmed, which will happen unless the federal Public Prosecution Officer appeals the sentence, and the judge of Etla will have 24 hours to provide a basis for imprisoning our brother Pablo López Alavez. If on the other hand the Public Prosecution Officer appeals, this will mean a longer process during which our brother will stay imprisoned unjustly.

We call on each and every goodhearted man and woman, on the organs of defence of human rights, and on environmental organizations to support us by sending letters, making calls to the responsible institutions to ask that the Public Prosecution Officer (Ministerio Publico Federal) abstain from appealing the sentence, and that judge Lucero Hernández Melchor gives in to truth and justice, setting free our brother Pablo López Alavez, and also to call for punishment of the responsible authorities, like the Public Prosecution Officer (Ministerio Publico del Segundo Turno de Etla).
