The following language has been added to on page 14 of the RFQ, Section E. (DELIVERABLES/REPORTS), after Item 6.d.(3):

(a)Exception: Custom wood furniture products fabricated to Project Bid Specifications by a bidder using a millwork fabrication company.

(i)Alameda County reserves the right to reject substitution(s) with custom furniture wood products fabricated from a millwork fabrication company based upon but not limited to one or more of the following criteria: Design, Functionality, Durability, Safety, Appearance, Maintenance, and Warranty. Alameda County’s decision is final.

Page 15 of the RFQ, Section E. (DELIVERABLES/REPORTS), Item 7.a. has been revised as follows:

a.Bidder shall perform an inside building delivery, assembly, and installation at Alameda County Floor Levels Basement, 1, 2, and 3, 4, and 5.

Responses to Questions

Q1)Can the addendum be released sooner than August 5, 2016?

A)No. The addendum will not be released sooner than August 5, 2016.

Q2)Are there any drawings of the furniture?

A)No. Bidders should use EXHIBITS E-1 through E-9, ANCILLARY FURNITURE SPECIFICATIONS BY TAG REPORT, which provide the specifications of each item. The model numbers are provided within the specifications which can then be used within a public domain of the manufacturer.

Q3)Can the County please clarify whether a bidder can click on the model numbers locatedwithin the specifications in Exhibit E and F (e.g. hyperlinks)?

A)No. There are no hyperlinks associated with the model numbers.

Q4)Can the County please clarify why the model numbers do not yield any results when it is entered on the manufacturer’s website?

A)The model numbers are empirical. Not only will the model number be shown in the specifications, but also the product line for that item. Once the product line is selected in the manufacturer’s website, then the bidder will be able to build the item depending on the options that are selected. With each selection of an option, the bidder is adding to the model number and building the item.

Q5)Where can bidders locate the exact specifications, materials, dimensions, etc. for each line item?

A)Every product has a product line associated with it. Those product lines are available in the manufacturers’ price book. In the price book as well as the specifications, bidders will be able to see the dimensions and the description.

Q6)The bid form lists the sales tax directly under the product subtotal. Are freight and all local deliveries and installation non-taxable?

A)Yes, freight and all local deliveries as well as installation are non-taxable. The bid form lists a line for taxable labor and also a line for non-taxable labor. There is a line above the subtotal line for taxable labor.

Q7)The bid form lists freight and all local deliveries and is considered non-taxable. According to the California State Board of Equalization, the Sales Use Tax Law, Chapter 1 (GENERAL PROVISIONS AND DEFINITIONS), Section 6011, Item a. states:

“Sales Price” means the total amount for which tangible personal property is sold or leased or rented, as the case may be, valued in money, whether paid in money or otherwise, without any deduction on account of any of the following: (3) The cost of transportation of the property, except as excluded by other provisions of this section.
Can the County please clarify whether freight is taxable?

A)Freight is not taxable.

Q8)Can the County please clarify whether a bidder must bid on all line items for each exhibit?

A)Yes, a bidder must bid on all line items within that Exhibit. For example, if a bidder would like to bid on items listed in Exhibit E-1, then the bidder must bid on all of the items listed in Exhibit E-1. Note that a bidder is not required to bid on all Exhibits.

Q9)Can a bidder price the item listed but also list a substitution for the item?

A)No. Bidders are to provide their best quality and best priced item to the County. Only one item per line item is allowed.

Q10)Are substitutes allowed for open line products?

A)Yes. Substitutions are allowed under certain terms and conditions. When providing a substitution, it is very important that all accompanied information is submitted to show and establish the substitution being provided by the bidder. Adetailed comparison is needed for all substitutions please refer to page 6 of Exhibit A, REQUIRED DOCUMENTATION AND SUBMITTALS, Item 6.

Q11)When providing substitutions, how close do the substitutions need to be to the specified item in order to avoid being eliminated? Who determines that the substitution is suitable?

A)The specifications are driven by the users, which in this case are the Superior Court and the Hall of Justice. Any substitution or alternate to the specifications that are listed as performance specifications must be an “or equal” substitution as well as being accepted by the County as being an acceptable replacement for the original specifications.

Q12)In Exhibit E-1 ANCILLARY FURNITURE SPECIFICATION BY TAG REPORT, the specifications for the case goods are easier to duplicate; however, the specifications for the lounge chairs and task chairs are difficult to duplicate. If a Bidder meets the specification requirements for the case goods and does not meet the exact specification requirements for the lounge chairs and task chairs, then will the bidder be disqualified?

A)Regarding the task chairs, the details on the task chairs should be able to be substituted by an equal quality task chair with the same attributes that are shown in the specifications. The bidder must be able to bid on all the items listed within the Exhibit in order for the County to accept that Exhibit’s bid.

Q13)If the bidder substitutes a closed line manufacturer such as Knoll, is the bidder restricted to use only one substituted manufacturer or can multiple manufacturers be used as alternatives or substitutions?

A)Where an Exhibit lists a single manufacturer all proposed substitutions shall be from a single manufacturer.

Q14)Will the contract be awarded to multiple contractors?

A)Per page 24 of the RFQ, Section M (AWARD), Item 5 states:

5.The County reserves the right to award to a single or multiple Contractors.

Q15)Is there a specific pricing contract that the County prefers to use or does not want to use?

A)Per page 21 of the RFQ, Section L. (PRICING), Item 1 states:

1.Prices quoted shall be firm for the first 36 months of any contract that may be awarded pursuant to this RFQ.

Q16)Is the County requiring the labor to be prevailing wages for the labor to receive, place, and install all products?

A)Please refer to page 23 of the RFQ, Section L. (PRICING)Item 12 which states:

12.Prevailing Wages: Pursuant to Labor Code Sections 1770 et seq., Contractor shall pay to persons performing labor in and about work provided for in Contract not less than the general prevailing rate of per diem wages for work of a similar character in the locality in which the work is performed, and not less than the general prevailing rate of per diem wages for legal holiday and overtime work in said locality, which per diem wages shall not be less than the stipulated rates contained in a schedule thereof which has been ascertained and determined by the Director of the State Department of Industrial Relations to be the general prevailing rate of per diem wages for each craft or type of workman or mechanic needed to execute this contract.

Q17)Should the unit of measure on the bid form be listed as “each” rather than “lot”?

A)Yes. Please use the REVISED BID FORM.

Q18)Per the bid form, Exhibit E-1, can it be assumed that Gunlocke Light Walnut should be used for all wood components?

A)The finish is specified for Exhibit E-1 in each FF&E Tag Specification.

Q19)Per the bid form, Exhibit E-1, are locks required on all the storage units?

A)Yes. Locks are required and are to be keyed per the RFQ, Section D. (SPECIFIC REQUIREMENTS), Item 9. FF&E Requiring Lock and Key System.

Q20)Per the bid form, Exhibit E-1, Item 20, Gunlocke Moti, the model number GK9931 is not a valid part number. Does the County wish to use model number GK9913 instead?

A)Gunlocke Moti Model No. GK9931 is a valid model number and can be located in the Gunlocke Molti Lounge Seating Price Book 01/16 on page 122.

Q21)Per the bid form, Exhibit E-2, Item 1, Tag CH-17, Haworth Collaborate Disk Base Lounge Chair, the Customer’s Own Material (COM) surface material of Architex, Leatheretta, and Toddy has been tested and has not been approved on the Haworth Collaborate product line. Will the County be replacing this with another option that is COM approved?

A)If Haworth determines that the specified fabric MFG: Architex, Pattern: Leatheretta, and Color: Toddy, is not approved for CH-17 then the County will reselect an approved fabric from the same price grade prior to fabrication.
