BOOKING TERMS AND CONDITIONS
1. The cottages situated at Kerhotten are offered for holiday rental subject to confirmation by the Owners Garry and Jackie to the Hirer (The Client)
2. To reserve a cottage the CLIENT should after confirmation of availability with the Owners, complete and return the Booking Form together with a the initial deposit of 20%of the total cost of the holiday. Following safe receipt of the deposit the Owners will confirm in writing formal acceptance of the booking, and the client agrees to be bound by these conditions. Any amendments to the party, once confirmed, must be agreed in writing by the Owners.
3. The balance of the cost of the holiday is payable not less than 8 weeks before the commencement of the holiday period. Should payment not be received by the due date then the Owners reserve the right to give due notice in writing that the reservation is cancelled. The CLIENT remains liable to pay the balance of the rental unless the Owners are able to re-let the cottage (In such event clause 5 of the conditions apply.) Reservations made within 8 weeks of the start of the rental period require full payment to be made when booking.
4. A security deposit of £200.00 per cottage booked is required in case of, for example, but not limited to damage to property or its contents and extra cleaning accrued. However in circumstances where the deposit is retained by the Owners, it shall not limit the CLIENTS `s liability to the OWNERS. The OWNERS will account to the CLIENT for the security deposit and refund the balance due.
5. Subject to Clauses 2 & 3 above, in the event of a cancellation, refunds of deposits paid will be made where the OWNERS are able to re-let the cottage. Any expenses or losses incurred in so-doing may be deducted from the Refundable amount. The CLIENT is strongly recommended to arrange Comprehensive Travel Insurance (including cancellation cover) and to have Full Cover for the Party’s Personal Belongings, Public Liability etc. as these are not covered by the OWNERS insurances.
6. Unless otherwise agreed, rentals are for a minimum of one week, although other requirements may, at the Owners discretion be arranged in low/mid season. The rental period shall commence at 4PM on the first day and finish at 10AM on the final day. The owners shall not be obliged to offer the accommodation before the arrival time stated nor shall the Client be entitled to remain in occupation after the departure time stated above.
7.The number of people occupying the property may not exceed the number on the booking form. The maximum number to reside in the cottage must not exceed the capacity number stated in the brochure unless theowners have provided prior written permission.
8. The Client agrees to be a considerate tenant and to take care of the cottage, its contents and all other equipment, and to leave it in a clean and tidy condition. On changeover days there is only time for a superficial check and a general clean that is included in the rental fees. We rely upon the goodwill of our guests whose co-operation we greatly appreciate. Should the property be left in a poor condition, requiring more intensive cleaning, then this will be charged at £30 per hour or part of and deducted from the security deposit.The Client further agrees not to act in any way, which could cause disturbance tothose residents in neighbouring properties.
9. The rental charge includes all bed linen, gas, water and 100 units’per week electricity.
10. The Client shall report to the owners immediately any breakages/defects, breakdown in equipment, machinery or appliances in the cottage, garden furniture or in the swimming pool who will arrange as soon as possible for suitable repair/replacement.
11. The Owner shall not be liable to the Client
a)for any temporary defect or stoppage of public service to the cottage nor in respect of any equipment, plant, machinery or appliances in the cottage, garden or swimming pool.
b)For any loss damage or injury which is the result of adverse weather conditions, riot or other matters beyond the control of the Owners
c)For any loss, damage or inconvenience caused by or suffered by the Client if the property shall be destroyed or substantially damaged before the start of the rental period and in any such event the Owners shall, within 10(Ten)days of notification to the Client , refund to the Client all sums previously paid in respect of the rental.
12. Under no circumstances shall the Owners liability to the Client exceed the amount paid to the Owners for the rental period.
13. Under no circumstances are children under the age of 16 to be left unattended in the cottages.
14.In the interest of health, safety and comfort of all our guests we operate a no-smoking policy within the cottages. In addition we regret that dogs are only welcome out of high season with prier notice and subject to agreement with the owners.Dogs must be kept under strict close supervision at all times within the grounds of Kerhotten, any fowling must be cleaned up immediately.
15. There shall be no variations to these conditions unless agreed in writing by the Owners.This contract shall be governed by English Law in every particular including formation and interpretation and shall be deemed to have been made in England. Any proceedings arising out of or in connection with this contract may be brought in any Court of competent jurisdiction in England.
SWIMMING POOL TERMS AND CONDITIONS
1. The Pool is unsupervised and guests using it do so at their own risk. No children under the age of 14 or non-swimmers will be allowed within the pool area unless under the supervision of a responsible adult. Further more parents/guardians must accept responsibility at all times for the constant supervision,
2. The pool is open from 10 am until 7pm. The key for the gate is available from us between those hours. The gate must be kept locked at all times when the pool is not in use.
3. Children must be restrained from climbing on/over the fence and gate.
4. Diving and dive bombing is strictly prohibited, irrespective of the competence of the individual concerned.
5. Absolutely no breakables i.e. Glass, beer/wine bottles, pottery, china and brittle plastics etc. are to be taken onto the pool area. Nor is food or drink (with the exception of plastic bottles of water) to be taken onto the patio area surrounding the pool.
6. Only inflatable’s in the pool area. No large inflatable and hard balls.
7. The pool area (including the solar heating panel) is not a general play area. It is for use solely for swimming or Sun bathing.
8.Excessive use of suntan cream/oil can have a disturbing effect on the quality of the water, which my result in the pool being closed down for extra cleaning. We would ask that such products are “toweled off” before entering the water, and re-applied after swimming. Should you wish your child to wear a T-Shirt whilst swimming, this must be a dye proof (white preferably).Only suitable swimwear (i.e. not such garments as cut-off jeans) is allowed.
9. Parents must ensure that their children do not throw gravel into the water or take into the water any other sharp object or toy which may possibly damage the liner and/or filtration system.
10. The pool will normally be open from Mid May to Mid September, however the owners reserve the right to close the pool for cleaning purposes due to adverse weather conditions, excessive use of sun tan creams and oils: blockage of the filtration system due to gravel/toys or other objects: and occasional agricultural activity e.g. dust caused by harvesting in the surrounding fields.
11. Pool equipment, especially the leaf nets are not toys.We would ask that they be used solely for the purpose for which they are intended.
12. Footwear must be clean and of a light colour as dark colours tend to discolour the copings.
13. For the health, safety and comfort of all guests using the pool, the owners reserve the right to request anyone contravening the above Terms and Conditions to leave the pool area immediately.
14.No smoking is allowed in the pool area
15. The swimming pool is for use solely by our Guests.
