NOTE: This proximity card number is the only card that will open the cabana on the designated date
  1. This Cabana Usage Agreement is between Bettencourt Ranch (‘Association”) and myself, OWNER/TENANT of Record (print name)______, and subject to the resolution of the Board of Directors, Adopting a Collection and Fine Procedure Adopted June 10, 1997.
  2. A Deposit Fee of $325, and Usage Fee of $75 are enclosed. These checks, along with a completed Cabana Usage Agreement are required to lock-in the rental request date. Rental request dates are made on a first-come-first-serve basis, and may not be made earlier than 90 calendar days.
  3. IMPORTANT: If this rental request date is cancelled for any reason, other than for Acts of God, equipment failure, or vandalism, or use by others, an administrative fee of $20, PLUS the cost of janitorial service (if BRHOA is charged for the service call) will be deducted from the Usage Fee. If BRHOA is able to rent the Cabana all monies will be refunded.
  4. If OWNER/TENANT is not able to use the facility due to vandalism, acts of God, or equipment failure or use by other users, OWNER/TENANT will receive a credit for a future use providing OWNER/TENANT notify the Association by voicemail naming the extent of the damages. OWNER/TENANT must complete the CABANA USAGE INVENTORY AND CONDITION CHECKLIST and mail to the assigned representative within 48 hours.
  5. Renting the facilities is for social purposes only, and DOES NOT provide exclusive usage of the rest rooms, tot lot, small cabana room, tennis courts, pool, and basketball area, etc. Renting of the facility is for usage of the large cabana function room, and kitchen only.
  6. The pool and pool area are NOT available for rental, and may NOT be used by OWNER/TENANT or guests during the rental request date.
  7. OWNER/TENANT is a member in good standing, and all dues, special assessment and fines are paid to date.
  8. OWNER/TENANT has received a copy of the 1.) CABANA USAGE RULES, 2.) PROMIXITY PASS CARD OPERATION & LOCKUP INSTRUCTIONS, and, 3.) CABANA USAGE INVENTORY & CONDITION CHECKLIST and agrees to abide by them. The CABANA USAGE INVENTORY & CONDITION CHECKLISTmust be completed andreturned to the assigned representativeby 48 hours. Failure to return the form may result in loss of privileges and fines.
  9. The OWNER/TENANT must be present at all times during the rental period.
  10. The maximum occupancy for use of the facilities is 60 persons. This includes children and adults.
  11. Any use above the normal wear and tear, or the cleaning or repair costs required resulting from damage, abuse, or neglect as a result of this Agreement is fully recoverable by the Association. This includes and is not limited to labor, materials, administrative costs, and court fee costs to restore the property to a like manner before the rental period.
  12. The OWNER/TENANT is responsible for all persons using the facilities during the rental period, and shall hold harmless from and defend the Association against any and all claims or liability for any injury or damage shall be caused in whole or in part by the act, neglect or fault of the Owner, their tenant, his/her agents, servants, employees or guests. I hold harmless the Association in the event of injury, accident or death on the premises.
  13. Failure to exit the facilities or to secure the facilities by the curfew period will automatically result in forfeiture of the Deposit Fee.
  14. OWNER/TENANT agrees to abide by the terms of this Agreement, and the attachments provided.
