Subject:Sham Contract Case study for consideration by commission

To whom it may concern

On the 16th of October 2013, [Redacted]was taken home by his brother and sister after having a severe mental and physical breakdown in the car park of the Company he was contracted to and had been for eight years. He had been operating under an ABN until April 2013 whereby he was forced to become a company by the Company he was he contracted to.

He was taken to a doctor who advised immediately to see a lawyer as the traumatic assault on his wellbeing had been perpetrated by two senior managers who had held him against his will in a boardroom for two hours under false pretenses.

A contract lawyer and workplace lawyer was seen and after materials supplied and speaking with [Redacted], it was clearly established that the contract was a Sham Contract and what had been done to him by the Managers was indeed unlawful. This was in October and November of 2013.

What transpired since 2013 until this very day can only be described as a serious flaw in the laws, processes and system failure in responding to the reporting of Sham Contracts and the obstacles that exist for the authorities to take swift and decisive actions. My intention of submitting this information is to assist the authorities in removing the red tape and blatant flaws in the system that has tied their hands for far too Long.

The above Attachment provides you with insight as to where this case at this point in time and I have had no feedback or information provided as to “What is being done”

I would like this case to be given consideration for extension. It is my hope that the authorities involved will assist me in providing the appropriate facts and information for the commission.

It is now over 28 days since my last email and I am following up as to what is being done?

Although I sympathize with all concerned and especially [Redacted] that this is a difficult time, I would appreciate that consideration be made to the fact that others are also in challenging and difficult times and not use that excuse as being fair in stretching this matter out any further. If he cares as he says he does and is unable to do it himself, he may need to ask someone else to help him. Asking for help is a good thing to do.

I recently made a comment on LinkedIn whereby all the professionals in the the industry clearly said that it was far better to face it head on, fix the problem and get closure for all concerned. The reverse of this is to continue denying until arrests are made.

I have also been asked to make a submission to the new enquiry and I will be doing so. My intent is to assist the authorities with being empowered to take swift and decisive actions in the near future regarding these matters and others. I have assisted a number of others thus far with similar matters and these will also be included in my submission. I have also volunteered my time to help Wise Angel Foundation, a non profit charity that has been set up to help victims and survivors of domestic violence and now with my assistance has had doors opened to persons that will help transform social enterprise. Too good to be true? Well no, some things are that good that others know it to be possible and actually do what is needed to be done to achieve it.

I trust that this email will be forwarded to [Redacted]directly as you will understand it is better to go to him.

I have waited almost two years to the day that [Redacted] was taken into a boardroom by [Redacted]and [Redacted]for you to accept that you failed to follow your own policies regarding investigating serious allegations that your legal counsel Tracey Brewer knows to be true and stated in a phone conversation with me that she could not put to you as you would not accept reality.

Further to this, the payment that was made for $15000.00 to [Redacted]was in fact only for two accounts that I told [Redacted]is was owed already and had again been held back by the management for no reason as the contracts and delivery had already been made. The irony of the fact that when she sent the deed as if this was a settlement for what she knew to be true but denied is rather bizarre , don’t you think.? Further to this the names of those two accounts amazingly never appeared on the ridiculous offers sent to [Redacted]to put this matter to bed.

In April when that money arrived , this was also Suzie Bretts further insult to INJURY as it was made clear to her via text and email that this payment was accepted only because it was owed amongst the many others that management was withholding based on their unethical, unlawful bias and prejudice and outright discrimination that started with the former state manager [Redacted]from the first day they met when he took over the branch and turned it into a toxic and unlawful environment to work in. All the emails and texts sent to all parties during the last two years inclusive of the authorities and Stopline clearly state legitimate experience of this by [Redacted]. This so called acceptance of money to settle all allegations is a lie. The only reason that money was used is because our children who were suffering so much due the medical condition both their parents were suffering from and also due to witnessing their father screaming in my arms in front of them the day he was bought home by his brother and sister and whereby your own personnel and even [Redacted]himself witnessed the horrific outcome of what occurred that day, needed to be fed. That’s right your lies and cover-up of the truth of what had occurred left a family in extreme hardship and relying on food vouchers, ST Vincent de Paul whom even had to help to provide uniforms for school for them. This is on record of course.

The good news is I am no longer on the medication that I was taking when I spoke to [Redacted]. As a matter of fact I am now healthy and can return to work when I am ready my doctors have informed me only recently. So you see the confusion and emotional state that was always used against us during this whole ordeal was in fact inflicted upon us by you all and your failure to uphold the very values you so actively promote.

Where do I stand on this matter now? I stand against Liars, cheaters and those who abuse the rights of others and always will.

This email to you today is a second chance for [Redacted]to ask [Redacted]and [Redacted] to state the truth and show him all the correspondence about this case. That way he can save himself a whole lot of trouble by finally knowing that it is far better to settle in a legal manner with [Redacted]directly, than allow the authorities and courts to do it for him. This way at least he will also know in his own mind why many things with the Company did not add up and have clearer vision and foresight for the future of KM. This way we can all move forward with our lives.
