Significant Excerpts from the Undersecretary of the Treasury Circular on the Records for Traffic Accident with Material Damage (# 2007/27, dated 28 December 2007)
Pursuant to Turkish Highway Traffic Law # 2918, a Traffic Accident Record form will be filled in in the event of a traffic accident resulting in material damage only, provided that the parties agree to draw up a joint record of the way in which the accident occurred. The Traffic Accident Record will be prepared IAW the following rules:
1. For traffic accidents resulting in material damage only, if the parties agree to draw up a record of the way in which the accident occurred, they will fill in and sign the “Record for Traffic Accident with Material Damage” attached to this circular, by following the instructions given in the same attachment.
2. Records not filled in by all the parties involved in the accident will not be deemed valid.
3. Several forms may be used for traffic accidents in which more than two motor vehicles are involved, or when required. Records may be reproduced when completed.
4. Record forms are provided free of any duty charges. You may use the sample forms provided together with the insurance policy or obtain them by visiting and or use the attached form.
5. The record thus drawn up is valid as a Traffic Accident Record drawn up by the Traffic Police.
6. When possible, take photographs of the vehicles involved in the accident before removing them from the scene of accident. Photographs will be examined together with the record.
7. When submitting a claimto the insurance company issuing the other party’s Traffic Insurance (Compulsory Financial Liability Insurance) policy or the Comprehensive Motor Vehicle Insurance policy of your vehicle, also submit the Traffic Accident Record drawn up by both parties IAW the provisions of the above paragraphs, and the photographs, if any.
8. TRAMER (Turkish Traffic Insurers Data Centre) will keep the claimants informed, via Internet, of the stages of their claims’ review by the insurance company.
10. The Traffic Accident Record, amplification on how to fill in the form and the sample forms will be provided by the insurance company free of charge, together with the insurance policy.
11. This circular will come into effect as of 01 April 2008.

This form will be filled in by the driver(s) involved in a traffic accident resulting in material damage only, provided that they agree to fill in a record form explaining the way in which the accident occurred.

ATTENTION!!! This form WILL NOT BE FILLED IN in the following cases. In such cases, call the Traffic Police on 154.

If one or more of the drivers does not have a driving licence/valid driving licence,

If one of the drivers is a minor,

If one of the drivers is suspected to be intoxicated or mentally ill,

If one or more of the vehicles involved in the accident belongs to governmental institutions,

If damage has been caused to government property of public institutions,

If the traffic accident results in damage to the belongings of third persons only,

If one or more of the vehicles involved in the accident does not have the compulsory traffic insurance,

If the traffic accident results in death and/or injury.

Where possible, take photographs of the vehicles from different angles before removing them from the scene of accident.

One copy of the records should be provided, together with the photographs of the vehicles to the insurance company issuing the traffic insurance policy of the other party or the insurance companyissuing the comprehensive motor vehicle insurance policy of your vehicle.

 Several forms may be used for traffic accidents in which more than two vehicles are involved. In such case, each form should be signed by all drivers involved. The empty space at the bottom of the form may be used for signatures.

Enter the date and place of the accident in Section 1 and 2 of the form.

Section 3 is reserved for the statement of eyewitnesses, if any. A separate blank sheet of paper may be used if more space is needed for eyewitnesses’ comments.

Enter the information on the driver, vehicle and the Traffic Insurance Policy in Sections 4, 5 and 6.

Remember to mark the first point of impact on the vehicle in Section 7 of the form.

Tick the appropriate box (x) in Section 8. This section is optional but you are advised to fill it in for quicker assessment by the insurance company.

Remember to draw a sketch of the accident and the scene of accident in Section 9. Indicate street names, the direction in which the vehicle was travelling, as well as the road lines. The vehicles should be indicated as Vehicle A and Vehicle B.

Section 10 is reserved for the drivers’ comments on the accident. A separate blank sheet of paper may be used if more space is needed for driver’s comments.

After filling in Section 10, the drivers MUST sign Section 11. Unsigned forms will be deemed invalid.
