ARTISTS IN FLIGHT PHOTO / VIDEO RELEASE FORM
1. General Release and Indemnification:
(a) YOU understand and agree that at least one of the performances will be filmed or recorded for promotional purposes, and still photos will be taken during rehearsals and during performances. YOU understand that YOU shall have the opportunity to gain a copy of the portion of the performance containing YOUR work and the work of YOUR performers. YOU also understand and agree that Catherine Mancuso, as the producer of the [3/31 Artists in Flight Showcase] will own and possess the master video files (or other media) of the entire performance.
(b) YOU understand and agree that the copyright in the [3/31Artists in Flight Showcase] program, memorialized on DVD (or in any other media now known or invented in the future) is owned exclusively by Catherine Mancuso [producer] and Chris Oglio [videographer]. You understand that neither YOU nor any of YOUR performers has the right to sell for profit or use for any commercial purpose whatsoever, in whole or in part, as a sampling, audio or video or both, whether in the form “AS IS” or edited post-production, the video file(s) provided to YOU of the 3/31Artists in Flight Showcase. Such prohibited use may be subject to criminal and/or civil penalties.
2. Personality and Publicity Rights
YOU hereby grant Catherine Mancuso and Aries In Flight the right to use YOUR name, approved likeness, voice and professional biography without compensation to YOU in credits, advertising, publicity and marketing materials concerning YOUR services, Catherine Mancuso and the Artists In Flight Showcase [3/31Artists in Flight Showcase], so long as no endorsement or testimonial is attributed to YOU. YOU further grant Catherine Mancuso the right to use, publish, re-use, re-publish and/or reproduce in any manner and in any media whatsoever YOUR voice and likeness as YOU appear in performance on any visual media now known or created in the future, including but not limited to, film, video, tape, CD-ROM, digital imaging, DVD, and
sound recordings of any type in any medium without any payments or residuals to YOU. YOU agree to be available for publicity purposes to Catherine Mancuso and Aries In Flight, as these purposes may occur prior to performance dates. YOU also agree that YOU shall not unilaterally issue any publicity or make any statements concerning Catherine Mancuso or the 3/31Artists in Flight Showcase without Catherine Mancuso’s prior written consent, with the exception of incidental, non-derogatory references to Catherine Mancuso, YOUR connection to Catherine Mancuso and YOUR appearance in the 3/31Artists in Flight Showcase.
3. Permitted Uses of the Artists In Flight Video Footage and Photos (or other Media)
YOU will receive a copy of your company’s performance(s) in the 3/31Artists in Flight Showcase via dropbox which will include both video footage and digital photos. YOU agree that YOU may use the copy for marketing of YOUR skills and talents and job-seeking purposes (e.g., auditioning, seeking grant money). After the 3/31Artists in Flight Showcase has completed all performances, additional Permitted Uses may be negotiated separately with Catherine Mancuso under separate agreement.
