The minutes of the Woods Cross City Council meeting held February 16, at 6:30 P.M. in the Woods Cross City Hall located at 1555 South 800 West, Woods Cross, Utah.

APPROVAL OF MINUTES

The Council reviewed the minutes of the City Council meeting held February 2, 2016. After their review, Council Member Gertsch made a motion to approve the minutes as written with Council Member Dayley seconding the motion and all voted for the motion through a roll call vote.

REVIEW OF FINANCIAL REPORT

The Mayor gave the floor to the City Administrator who reviewed the financial report with the City Council.

There were no questions from the City Council regarding the financial report.

APPROVAL OF CASH DISBURSEMENTS

The City Administrator continued with the floor and went over the cash disbursements for the period of January 23, 2016 to February 5, 2016.

After the review of the cash disbursements, Council Member Dayley made a motion to ratify the cash disbursements as presented with Council Member Westergard seconding the motion and all voted for the motion through a roll call vote.

OPEN SESSION (BRIEF ITEMS)

The Mayor then opened the meeting to items from those present that they would like to bring before the City Council that were brief in nature. This would be items that would take less than two or three minutes.

Ms. Donna McCormick living at 843 West 1800 South appeared before the Council. She said she had concerns regarding the Woods Cross apartment proposal on 1500 South. Her concerns included water availability, the increase in traffic, safety concerns for school children and pedestrians, lowering of property values, increase in crime and drugs, pollution, trains stopped for long periods of time, emergency vehicles will be slowed, school over population, city budget handling needs for streets and sidewalk repairs, no city infrastructure, non-home owners are not vested in the community, renters don’t pay property taxes, and the police department will need more officers with the increase in population.

She encouraged the City Council to change the zoning for mixed use where the empty Sports Forum building is located. She said it would be a better fit for the community to have apartments located in that area instead.

The Mayor said the proposed apartment project she was discussing had not been approved and they are taking into consideration all questions and concerns from the public, the property owner’s rights, safety and all other issues as they city meets with the developer in the future. He thanked Ms. McCormick for her comments and her concerns she had brought to their attention and said they would be looking at all comments in consideration to this proposal.

This concluded the Chief’s report. Council Member Gertsch then asked the Chief how many child abuse reports were repeat reports and he said not many of them.

The Mayor and Council thanked Chief Butler for his report.

PUBLIC HEARING: NON-CONFORMING USE ENLARGEMENT REQUEST BY SOUTH DAVIS STORAGE LOCATED AT 1411 SOUTH 600 WEST

The Mayor gave the floor to the Community Development Director who went over the following with the City Council:

“Back in the mid to late 1980’s the South Davis Business Park was developed with office/warehouse and self-service storage facility behind it. At the time, self-service storage was permitted in the C-2 General Commercial Zone. However, during the 1990’s the City removed self-service storage facilities as a permitted or conditional use within the C-2 zone. Instead, self-service storage facilities were added as a conditional use only within the I-1 Light Industrial Zone. As such, the South Davis Storage Facility became a legal non-conforming use.

“As you know and as outlined in the applicant’s information given to the Council, our zoning ordinance permits the Planning Commission, and City Council to consider the expansion, enlargement, or alternation of a non-conforming use if certain criteria are met. The criteria are outlined in Section 12-22-104 of the Zoning Ordinance and also reiterated in Mr. Jensen’s material.

“Mr. Jensen would like to expand the self-service storage facility, as noted, to fully use a building on the site which was originally approved partially for self-service storage on the east side and office/warehouse on the west side of the building. Mr. Jensen is proposing they be permitted to expand the existing non-conforming use of self-storage established in half of the building into the rest of the building. It is obvious the expansion into the rest of the building will not have any impacts on surrounding land uses. The second criteria, deals with making the proposed enlargement more compatible with its surrounding area or zoning. In this case expanding the nonconforming use within the existing building, doesn’t make this site any more or less compatible with its surroundings and zoning. Mr. Jensen makes an argument that the building which is the subject of the expansion, is not currently well leased for an office/warehouse, and converting it all to self-storage would resolve the vacancy problem and make a more desirable situation for the community.

“The Planning Commission reviewed this matter several weeks ago with Mr. Jensen and has recommended to the City Council that the proposed nonconforming use enlargement as proposed be approved.”

Mr. Jensen addressed the Commission and explained it was the intent of his client to modify the indoor half of the building into indoor storage units. He said they were not planning on changing the outside of the building but are trying to be as unobtrusive as possible. He said they would be partitioning off various sizes of units to be utilized. He did note they may replace some of the doors with glass but would not be altering the structure of the building itself.

The Mayor then opened the public hearing to take comments from the public regarding this issue. There were no public comments and the Mayor closed the public hearing.

CONSIDERATION TO APPROVE A NON-CONFORMING USE ENLARGEMENT REQUEST BY SOUTH DAVIS STORAGE LOCATED AT 1411 SOUTH 600 WEST

After the Mayor and Council had listened to the above information, Council Member Dayley asked if she had understood correctly that there would be no changes to the exterior of the building changing the look and feel of the building. Mr. Jensen said they would not be changing the exterior of the building in constructing these storage units. He did say they may change out some of the doors for glass panels but that would not change the structure of the building. Mr. Jensen said that building is vacant now and is off the street front so it is not seen so people do not know it is available and they would like to be able to get something in there that would utilize the building. The Council asked if there is an onsite manager for the storage units and the answer was yes there was.

Council Member Gertsch made a motion to approve the non-conforming use enlargement request by South Davis Storage located at 1411 South 600 West with Council Member Westergard seconding the motion and all voted for the motion through a roll call vote.

CONSIDERATION TO ADOPT A RESOLUTION ENTERING INTO AN INTERLOCAL COOPERATION AGREEMENT WITH THE SOUTH DAVIS METRO FIRE SERVICE AREA, DAVIS COUNTY, BOUNTIFUL CITY, CENTERVILLE CITY, NORTH SALT LAKE CITY, AND WEST BOUNTIFUL CITY ESTABLISHING THE FINANCIAL PRACTICES AND POLICIES OF THE SOUTH DAVIS METRO FIRE SERVICE AREA

The Mayor gave the floor to the City Administrator who explained to the City Council:

“Given to the Council is a copy of the Interlocal Agreement entered into between the South Davis Metro Fire Service area and the other members of the service area. This Interlocal agreement memorializes the previous agreement between the entities of the Fire Agency and clarifies any changes due to the creation of the new Fire Serve Area.”

The City Administrator reviewed some of the details of the agreement with the City Council and some of the points that will be covered by this Interlocal Agreement. The Mayor also noted there is going to be a transition period that will take place as the two agencies change over to become one fire service area.

After the review by the City Administrator, Council Member Westergard then made a motion to adopt resolution 2016-611, a resolution entering into an Interlocal Cooperation Agreement with the South Davis Metro Fire Service Area, Davis County, Bountiful City, Centerville City, North Salt Lake City, and West Bountiful City establishing the financial practices and policies of the South Davis Metro Fire Service Area. Council Member Dayley seconded the motion and all voted for the motion through a roll call vote.

REVIEW OF PROPOSED INTERLOCAL AGREMEENT BETWEEN WOODS CROSS CITY AND THE REDEVELOPMENT AGENCY OF WOODS CROSS CITY PROVIDING CITY FUNDS TO CARRY OUT THE PURPOSES OF THE 2600 SOUTH COMMERCIAL DEVELOPMENT AREA

The City Administrator said this Interlocal Agreement was a review of what was discussed with the Council at the last City Council meeting and this is just a formal agreement but none of the points have changed from what was discussed previously.

The Council did asked if there had been any further traffic studies, and the Community Development Director outlined some of the discussions that had taken place the past week regarding the traffic studies with the Council. He said the preferred solution would be to put in a protected left turn at the intersection in question but they are still looking into the traffic with the studies for the best solutions.

SAFETY ACCOUNTAABILITY REPORT

The City Administrator reviewed the Safety and Accountability report with the Council. He noted the following:

“Given to the Council is a report for the January 2016. We had a couple of minor incidents in the Police Department where some wires were chewed between the kennel and the vehicle by a canine and a broken mirror due to weather conditions. Both incidents were minor and have been reviewed and corrective action has been taken to ensure future incidents do not happen. We have also set our annual goals for the year.”

OPEN SESSION

Council Member Dayley said she was at the open house for the storage sheds proposed on Redwood Road and there were no negative comments from the neighbors. The HOA president did have some concerns about hours of operation but the owner noted they would be willing to restrict hours of operation.

It was also noted there was an open house for the townhomes project. He said only one couple came out and they did have some written comments and the Council would be receiving them.

The Council thanked the Youth City Council for their Valentine’s Day surprise.

Council Member Westergard said he had had several people ask what was going on at 1500 South and 1100 West. The City Administrator said he would check with the Public Works Director but he suspected it was the relining of the sewer lines.

The Mayor asked how the pickle ball courts were coming along. The City Administrator said the demolition is starting. He also asked about the drilling for the subsidence and it was noted they have not started the drilling yet.

MOSQUITO ABATEMENT REPORT

It was noted that Council Member Sheldon was excused so the report was tabled to the next meeting.

SOUTH DAVIS METRO FIRE AGENCY REPORT

The Mayor noted they had approved the resolution and asked other cities to approve it as well.

SOUTH DAVIS RECREATION DISTRICT REPORT

The Mayor reported that lifeguards and first responders had been honored for their assistance in helping with the recent suicide at the recreation center.

He also said they will be training the snack bar and front desk attendants in first aid.

MAYOR’S REPORT

The Mayor said he had been asked to speak on behalf of Senator Orrin Hatch at the Republican Fundraiser dinner on Friday Night. He said he was a little nervous about it but was also excited to be asked to do that.
