WINDSOR LOCKS INLAND WETLANDS & WATERCOURSES COMMISSION WEDNESDAY August 7, 2013, 7:00 PM.

Ms. Dulka called the meeting to order at 7: 05 PM.

Approval of 6-5-2013 minutes: Ms. Dulka asked for a motion to approve the 6-5-2013 minutes. Motion to accept made by Mr. Courtney, seconded by Mr. Crochetiere, Motion carried.

Old Business: Dibble Hollow: Mr. Tim Westbrook representing CT Property Engineering discussed the work which had been carried out since May 2013 as covered by Ms. Robie's Wetland Agent Report dated 8/7/2013. The work had been approved by Town Engineer Paul Steele. Ms. Dulka asked Ms. Robie if she had reviewed all that had been done. Ms Robie then replied that she had approved with certain conditions as stated in her Wetland Agent Report. Ms Dulka called for a motion to approve. Mr. Courtney made a motion to accept the application, seconded by Mr.Crochetiere. Motion carried .

2, Ella Grasso Turnpike: Ms. Robie spoke to the commission addressing her visit to the site on 6/17/2013 as outlined in her Wetland Agent Report 8/7/3013. Ms. Dulka asked her if she was satisfied with what is going on, and when her next visit is planned. Ms. Robie replied that she is satisfied, and will probably be visiting next week. Asked if she will have another report ready for next month's meeting, she said yes.

Permit Violations: 3 Industrial Road: Mr. Paul Smith came forward to represent the client, and to introduce Ms. Kate Bednarz as Soil Scientist on the project. Ms. Bednarz spoke at length, stating that the current wet weather conditions had helped define what needed to be done. What followed was a repeat of an update sent to Ms. Robie on 7/29/2013 and reported in Wetland Agent Report dated 8/7/2013. Ms. Robie followed by saying much of Katie Bednarz presentation is covered in her report. She stated that she had visited the site on 6/17/2013 and seen plantings on site but no evergreens. Further progress was reported by Ms. Bednarz as stated in the Wetland Agent Report. Ms. Dulka asked what were the reasons for the violation. Ms. Robie said she believed the silt fences were installed incorrectly with gaps under them. They were not installed where the plan required them to be, and she was not informed at the proper time. Ms. Dulka asked if all of it had been corrected, and was told it had been. Mr. Crochetiere asked if they planned to reseed in the Fall, and was told they did. Ms Dulka asked Mr. Russo if he had anything to add. Mr. Russo responded that he had nothing to add.

26 Megway: Ms. Robie received two inspection reports from Ms. Bednarz on 7/20/2013 with an email comment that Mr. Vavanan is very willing to satisfy the Agency as stated in Wetland Agent Report 8/7/2013. Ms. Bednarz spoke highly of the quality of the condition of the site and the willingness of the owner to comply. When asked by Ms. Dulka if there would be a report in October, she said probably there would be.

296 South Center Street: Ms. Robie stated that Ms. Dulka was called out on 7/3/2013 to investigate tree cutting in a conservation area, while she was unavailable as stated in Wetland Agent Report 8/7/2013. Ms. Dulka said that she was called in the day following the tornado regarding the report of a violation. The owner was cutting down a huge tree, and putting it into a conservation area. She told him he couldn't put the tree debris in the Conservation area. He had to either get rid of it or put it on his own land. He agreed that he would remove the debris from the Conservation area. She asked if Ms. Robie was satisfied with the outcome. Ms. Robie said that she had been told by the resident at 310 South Center Street, that he had cut the tree down himself before the storm, Ms. Dulka said that the tree company was there the day she visited., and she told them to stop cutting, as they were dumping into the conservation area. She asked how much of the tree was in the conservation area, and Ms. Robie told her she was unable to get in to see much. Ms. Dulka said she would not get into ' he said, . she' said between neighbors. Ms Dulka would rely on what she saw at the site when she was there. She advised Ms. Robie to leave the material where it was, as it would cause more of a disturbance to try to remove it than to leave it there.

310 South Center Street: On 7/3/2013, Ms. Dulka saw an illegal fence and yard waste in a conservation area during a site visit to 296 South Center Street.On 7/12/2013 Ms. Robie sent a certified letter to resident Mr. Peter Swanson telling him to remove the fence or apply for a permit. Also included was a copy of a letter written by Jen Rodriguez on May 22, 2007 which stated that the fence would need to be removed.. Ms Robie called Mr. Swanson on 8/7/2013, and he agreed to remove the fence and clippings by 11/1/2013, stating that there was concern about poison ivy until that time. Ms. Katie Swanson complained about her neighbor at 296 dumping in the conservation area. Ms Dulka reminded her that they had themselves been in violation since 2007. Ms. Dulka repeated that she was not going to enter into a neighbor's dispute and she would rely on what she saw when she was at 296 South Center Street. Ms. Robie said she is at ease with waiting till November. Ms. Dulka asked the Commission if they had any issue with waiting for the debris and the fence to be removed until 11/1/2013 and they did not have any objection. Ms. Dulka granted Mr. and Mrs. Swanson's request for the extension.

Other Business 29 Webb Street: On 6/12/2013Ms. Dulka had spoken to Ms. Robin Wusterbath about cutting down a dead tree next to a stream behind her house. Jen Rodriguez had already previously approved , but asked her to call first. She asked Ms. Robie to go take a look, which Ms. Robie did on 6/19. It was a very large tree in the middle of the property behind a fence next to a stream. The wood was all cleaned up with very little impact.

314 Center Street: Ms Robie was notified by the town of emergency tree cutting in a conservation easement area due to tornado damage.

Budget: none .
