AGREEMENT

This AGREEMENT, made and executed in duplicate at Jefferson, Iowa, as of June 1, 2007, by and between GreeneCountyMedicalCenter, Public Health Department, hereinafter referred to as “Public Health”; and the Greene County Sheriff’s Office, hereinafter referred to as “Sheriff’s Office”.

WHEREAS, Public Health has qualified licensed personnel capable of providing nursing services; and

WHEREAS, the Sheriff’s Office is interested in obtaining the services of qualified personnel of Public Health for nursing service; and

WHEREAS, the parties desire to provide a statement of their agreement in connection with the provision of services by Public Health to the Sheriff’s Office during the term of this agreement.

THEREFORE, in consideration of mutual covenants and agreements of this contract, it is understood and agreed by and between the parties hereto as follows:

FIRST: The Public Health Department shall employ agents or employees, who are licensed by the State of Iowa, to provide nursing services to the Sheriff’s Office.

SECOND: The Sheriff’s Office reserves the right to refuse the service of any individual agent or employee of Public Health, while Public Health reserves the right to terminate any agent or employee. The agents or employees of Public Health shall comply with the policies, rules, and regulations of the Sheriff’s Office at all times.

THIRD: The Sheriff’s Office shall make available during the terms of this agreement adequate space for the nursing staff to interview and/or examine inmates. In addition, the Sheriff’s Office will provide jailers for inmate supervision during all contacts that the nursing staff has with the inmates.

FOURTH: Public Health will supply equipment such as blood pressure cuffs, stethoscopes, and thermometers. The Sheriff’s Office will supply a first aid kit, gloves, and other materials to meet Bloodborne Pathogen standards.

FIFTH: Sheriff’s Office will call Public Health for nursing services as the need arises. Public Health will inquire about the inmate’s complaints, make a decision regarding the urgency of the problem, and work with the jailer to set a time to visit the inmate. Inmates will be seen as soon as possible, and no longer then two (2) working days from the time of notification. Public Health may decline to visit, if it is more appropriate for the inmate to seek medical or emergency treatment. The nurse will be available for visits during office hours, Monday-Friday, 8:00 a.m. to 4:30 p.m. If consultation is needed during the evening hours or weekends, the nurse on call will be available by phone at 386-2114.

SIXTH: Specific duties of Public Heath include but are not limited to: review of health records, screening and interviewing inmates related to the health concern, assisting to give injections or complete other nursing procedures ordered by a physician, and making appropriate referrals as needed.

SEVENTH: Sheriff’s Office shall pay Public Health the sum of $XX.XX per hour for each hour that the employees or agents of Public Health visit the jail for the purpose of assessing inmate health problems or concerns for services Monday through Friday 8:00 AM to 4:30 PM. A minimum of $XX.XX will be charged for each visit but partial hours will be prorated after the first hour.

Sheriff’s Office shall pay Public Health the sum of $XX.XX per hour for each hour of service outside of the normal business hours of 8:00 AM to 4:30 PM, Monday through Friday. There will be no charge for phone consultations.

Public Health will bill the Sheriff’s Office monthly; the Sheriff’s Office will pay Public Health in full within sixty days of receipt of the statement.

EIGHTH: The Sheriff’s Office hereby acknowledges that Public Health is the sole and exclusive provider of nursing service on the premises of the jail while this agreement is in force.

NINTH: HIPAA Compliance. GCMC as a business associate agrees to:

  1. Use and disclose Personal Health Information (PHI) only as required by law.
  2. Use appropriate safeguards to prevent use or disclosure of PHI.
  3. Report to Sheriff’s Office any unauthorized use or disclosure of PHI within twenty-four (24) hours of discovery by GCMC, together with any remedial action taken or proposed to be taken with respect to such improper use or disclosure. GCMC shall cooperate with Sheriff’s Office in mitigating any harmful effects of such use or disclosure.
  1. Upon the termination of the Services Agreement, return to Sheriff’s Office all PHI in

its possession.

TENTH: This agreement shall remain in full force and effect from the 1st day of July, 2007, provided, however, that either Public Health or the Sheriff’s Office shall have the right and privilege of canceling and terminating this agreement on thirty (30) days written notice to the other; and upon expiration of the said, notice, this agreement shall be and become of no further force or effect whatsoever, and each of the parties hereto shall be relieved and discharge therefrom.

IN WITNESS WHEREOF, Public Health has caused this agreement to be executed by its officer thereunto duly authorized and the Sheriff’s Office has caused this agreement to be executed by its office thereunto duly authorized as of the day and year first written above.
