(1)Packaging destined for reuse means packaging which has been conceived and designed to accomplish within its life cycle, a minimum of 2 trips or rotations and which is subject to operations by which it is refilled or used for the same purpose for which it was conceived with or without the support of auxiliary products present on the market enabling the packaging to be refilled (e.g. milk bottles, beer kegs etc).

(2)Packaging received means all packaging and packaging material (primary, secondary or tertiary) received onto the premises named above in section 5 associated with goods received from within the State.

(3)Packaging received means all packaging and packaging material (primary, secondary or tertiary) received onto the premises named above in section 5 from products associated with goods imported.

(4)Refers to materials supplied to you the producer which may not initially be packaging (like plastic sheeting) but which is then used as a packaging by wrapping products.

(5)Packaging supplied means all packaging, packaging material and packaged goods (primary, secondary and tertiary) supplied at and/or from the premises named above in section 5. “Supply” in relation to packaging material, packaging and packaged products includes in the course of business, to provide in exchange for any consideration other than money and to give as a prize or otherwise make a gift.

ATTACHMENTS WHICH MUST ACCOMPANY THIS APPLICATION.

(a)THE RELEVANT FEE

The prescribed fee under these Regulations is calculated at €15 per tonne of packaging and packaging material supplied (at or from the premises named above in section 5) in the twelve month period prior to the date of this application, subject to a minimum of €500 and a maximum of €15,000 per premises.

(b)PLAN OF ACTION

The three year implementation plan to be submitted with this application should specify the steps to be taken by the applicant in order to comply with the requirements of the Waste Management (Packaging) Regulations including steps which the major producer intends to take to prevent or minimise packaging waste. Please also confirm that a copy of this plan is “made available” free of charge on request to any person and that a public notice advertising the availability of this plan has been affixed in a conspicuous position at or near each entrance to which members of the public have access. (In compliance withArticle15(1). This notice should read as follows:-

Waste Management Acts 1996-2007

A three year implementation plan specifying the steps to be taken by (name of producer) for the purpose of recovering packaging waste is available at these premises or if so requested, will be sent by post, fax or electronic mail.

(c)FIXING OF OTHER NOTICES

Please also confirm that a public notice in compliance with Article 10(1)(a) has been affixed in a conspicuous position at or near each entrance to each premises to which members of the public have access and at or from which such major producer supplies packaging material, packaging or packaged products. This notice should read as follows:-

Waste Management Acts 1996-2007

We are required to accept on these Premises, free of charge, for the purpose of recovery, packaging waste arising from products, packaging or packaging material of a type or brand sold or otherwise supplied on these premises. The products or packaging in question need not necessarily have been purchased from (name of producer).

10.

ADVERTISING OF TAKE-BACK.

Please note under Article 10(5) a major producer must during the months of March and September in each calendar year publish in one or more newspapers circulating in the functional area of the local authority in which its premises is situate a notice complying with the requirements of Part 5 of the Second Schedule and provide copies of all notices published to the local authority within 10 days of the date of publication of such notices.

Registration Guidelines

  • An application is required in respect of each supplying premises.
  • The application form must be completed in full in order to comply with the minimum required for purposes of registration as set out in Part 1 of the Third Schedule.
  • Under Article 14 an application must be accompanied by a fee equivalent to €15 per tonne of packaging supplied annually from the relevant premises, subject to a minimum of €500 and a maximum of €15,000.
  • In accordance with Article 15 each application must be accompanied by a plan, prepared specifying the steps to be taken by the applicant in order to comply with the Regulations. This plan may relate to the overall activities of the major producer concerned within the relevant functional area and must include steps that the major producer intends to take to prevent or minimise packaging. See Part 3 of the Third Schedule for plan requirements.
  • An application must be made for registration to the local authority in whose functional area the premises is situated not later than 31st March 2008 or the date of commencement of business, whichever is later. A major producer must apply for renewal of such registration to the relevant local authority not later than the 31st of January in each year following initial registration subject only that a major producer shall not be required to make such application within four months of initial registration.
  • A major producer shall not be deemed to be registered until a Certificate of Registration has been issued by the local authority to which the application for registration was submitted.
