By-law 145-05

BEING A BY-LAW OF THE VILLAGE OF CARMACKS IN THE YUKON TERRITORY TO AMEND THE OFFICIAL COMMUNITY PLAN BY-LAW 135-05

WHEREAS the Municipal Act 1999, requires that Council act by by-law to amend the Official Community Plan By-law 135-05; and

WHEREAS the Council desires to provide for community use on lots now designated as urban residential; and

NOW THEREFORE the Council of the Village of Carmacks in an open meeting duly assembled enacts as follows:

Section 1 Short Title

1.1 This by-law may be known as the “Carmacks Official Community Plan Amendment By-law”

Section 2 General Provisions

2.1 The map of the Official Community Plan shall be amended to show Lots 5, 6, 7, 8, 9 and 10 Plan 31862 to be designated “community use”, and said lots to be incorporated with Lots 1, 2, 3, 4, 11, 12, 13 and 14 and the portion of municipal highway closed by Bylaw 143-05 to form a single “community use” parcel.

2.2 The annotated area is currently designated as “Urban Residential” and shall be henceforth designated and developed as “Community Use”, the land use to comply with the current applications defined in the Zoning By-law.

2.3 A public hearing was advertised then held on the 21st day of September, 2005, to allow for public intervention, discussion and review of written submissions, immediately preceding the regular meeting of council.

Section 3 Enactment

3.1 By-law 135-05 is hereby amended.

3.2 This by-law shall come into force and effect upon the final passing thereof.
