RULES AND REGULATIONS

THESE RULES AND REGULATIONS SUPERSEDE AMU PREVIOUSLY PUBLISHED RULES AND REGULATIONS.

Because of the necessity for a large group of people confined to a small area to abide by certain regulations in order to live in harmony, the Board of Directors of Vestavia Knolls has established the following rules, effective August 16, 2004, and the corresponding penalties thereof.

GENERAL

  1. Loud music and noisy parties must not disturb the other residents.
  1. Hammering, power sanding or drilling is not permitted after 9:00 PM or before 8:00 AM.
  1. Guns, bows and arrows, sling shots and fireworks will not be discharged on the premises.
  1. Assessment fees are due on the 1st of the month and are delinquent after the 10th of the month. Failure to pay by the 10th of the month will incur a $10.00 late charge. All returned checks are subject to a $10.00 charge. Any homeowner who is 60 days or more delinquent in payment of assessment fees and/or special assessments shall automatically lose all privileges until such time as all delinquent charges are paid in full.
  1. There will be a $50.00 charge for filing a lien and a $50.00 charge for removing a lien.
  1. In accordance with the Laws of the State of Alabama the Board of Directors prohibits the consumption of alcoholic beverages by anyone under legal drinking age within the confines of Vestavia Knolls.

CLUBHOUSE:PUBLISHED ON FRONT DOOR OF CLUBHOUSE

SWIMMING POOL:EVERYDAY 10:00 AM – 9:00 PM

(Opening and closing to be announced each year.)

TENNIS-PLAYGROUND: EVERYDAY 8:00 AM – DARK

Definitions:Homeowner – That person who owns a home. (A homeowner who leases or rents his entire townhouse relinquishes his homeowner privileges to use the facilities, herein described, to the renter and the renter’s family.)

House Guest – Any guest who remains at the homeowner’s home overnight.

RULES

  1. PLAYGROUND

Use of the playground is limited to the playground equipment and small hand toys only. Abuse of the equipment will not be permitted.

  1. Playground will be open from 8:00 AM until dark each day.
  1. Children under 6 years of age must be accompanied by a responsible older person.
  1. No walking up slide.
  1. No throwing of objects near play equipment.
  1. Keep gates closed.
  1. No bicycles, tricycles, skates, etc. allowed on playground.
  1. TENNIS COURT
  1. Open from 8:00 AM until dark each day.
  1. Tennis only can be played on the court. Shoes should be cleaned before entering the court.
  1. No hard soled shoes or bare feet allowed on court.
  1. The court may be reserved by any homeowner of adult member of the family for himself or any family member for one hour per day on a first come first serve basis. Schedules will be placed on the bulletin board in the Clubhouse at 6:00 PM each day for the following day. There will be no reservations made by telephone. Reservations shall be made between 6:00 PM and 9:00 PM only, for the following day.
  1. When others are waiting, play without reservation will be limited to one set of tennis or 45 minutes, whichever is shorter.
  1. To retain use of the court without reservation while others are waiting, there must be at least two people playing tennis.
  1. No animals allowed on court.
  1. No food or beverages allowed on court except water.
  1. When a scheduled court time is rained out, the homeowner may reschedule another time, if available.
  1. Each player is responsible for the court and equipment while using it and will be held liable for any damage he, she or guests have caused.
  1. SWIMMING POOL

The association assumes no responsibility for accidents in the pool area. All persons using the pool or pool area do so at their own risk and responsibility.

Owners, members of their families and guests are permitted to use the pool ONLY during scheduled hours. Guests other than house guests must be limited to four per unit. Under no circumstances may a guest bring his or her own guest.

To maintain positive control, the manager or assistant will make periodic checks of the pool to insure the rules are being observed and that only authorized persons are at the pool. The manager, assistants or Board of Directors has the authority to suspend any individual from the pool for 1 to 14 days or levy a fine or both depending upon the severity of the incident. Any incident which the manager feels warrants more severe action shall be referred to the Board of Directors for disposition, and may result in a warning or a citation.

  1. Guests must be accompanied by a homeowner, unless prior arrangements have been made with the manager, and said homeowner shall advise the assistant on duty as to the status of said guest.
  1. Swimming suits are the only proper attire for swimming in the pool.
  1. Bobby pins and hair pins are to be removed from hair before using the pool.
  1. Bicycles, tricycles, skate boards, skates or play equipment other than small rings and masks are not allowed in the pool area. Appropriate play equipment, such as inflatable toys, balls, and floats, may be allowed in the pool. Items which might inflict injury, such as hard balls and Frisbees, are not allowed. The assistant on duty shall determine the appropriateness of all play equipment, and may limit the use of any or all said equipment should prevailing conditions warrant.
  1. Persons with open cuts, sores, infectious disease or recent vaccinations are not allowed in the pool.
  1. Food is not allowed in the pool area and drinks in glass containers are prohibited.
  1. Playing of any games that involve horse play or could present a danger to others is prohibited. (i.e. gator, marco polo, chicken fighting, etc.)
  1. Playing or hanging on the safety rope is forbidden.
  1. No throwing of debris or foreign matter in the pool or pool area.
  1. Children under 15 years of age or children unable to swim must be accompanied by a parent or authorized person 21 years old or older.
  1. Directions of authorized personnel must be obeyed at all times.
  1. Children who are not toilet trained are not allowed in the pool.
  1. Climbing the pool fence and/or swinging on the pool fence gate is prohibited at all times.
  1. Chewing gum is not allowed in the pool area.
  1. Excessive water splashing is prohibited.
  1. Obscene language will not be permitted.
  1. Radios, disc players and televisions are prohibited in the pool area at all times. The only allowable items permitted in the pool area are personal iPod type devices, provided that same are used with earphones.
  1. CLUBHOUSE

Any ACTIVITY WHICH IS AGAINST Federal, State or local law is specifically prohibited in the Clubhouse or any common area. Specific examples are: (a) possession or use of any restricted drug or controlled substance; (b) persons below the legal drinking age in Alabama possessing or consuming alcoholic beverages. Only street attire is allowed on the upper floor of the Clubhouse.

  1. ADULT LOUNGE

All permanent residents and their quests are permitted use of the Adult Lounge, during approved hours.

  1. Reservations of the Adult Lounge, including the kitchen, bathrooms or the Adult Pool Room, may be made by a homeowner in accordance with Lease Agreement for this purpose. Lease of Adult Lounge, kitchen and bathrooms $50.00 deposit. Lease of Adult Pool Room $50.00 deposit. Lease of Adult Lounge and Adult Pool Room $100.00 deposit. These are the only parts of the Clubhouse which may be reserved and the homeowner must restrict his party to these areas. The deck adjacent to the Adult Lounge may not be used.
  2. A $50.00 cash deposit must be made at the time reservation is approved. The deposit(s) will be refunded if there are no violations and the facilities are thoroughly cleaned and undamaged by Noon of the day following the reserved activity, unless it is necessary to clean earlier due to another reservation. All decisions regarding violations and/or proper cleaning shall be made by the assistant in charge. This includes the area around the Clubhouse and the parking lot. Arrangements for entering the Clubhouse for the clean up should be made with the manager at the time of reservation.
  3. Arrangements for a special closing time, other than the scheduled closing time, should be made with the manager at the time of reservation.
  4. Reservations will be made through the manager on a first come first serve basis. Reservations may be made during normal working hours the first ten days of each month for the following month, except that wedding receptions can be planned further in advance. In order to give all homeowners the opportunity to use the facility, after the homeowner has reserved the Adult Lounge three times in one year, he/she must wait until after the above ten-day period for additional reservations, after which time he/she may reserve it as often as desired that dates are available. Reservations for the benefit of the Association will have priority so long as they are registered with the manager before reservations are opened to homeowner as above. Once a homeowner makes reservations, it is guaranteed and the Association will not take precedence.
  5. The homeowner making the reservation must be present for the duration of the party.
  6. Private parties must be restricted to 60 persons.
  7. Conditions for teen parties are contained in the Clubhouse Lease Agreement
  8. The homeowner leasing the Adult Lounge is responsible for the key. If the key is lost, the homeowner will be charged the replacement cost.
  1. TEEN ROOM
  2. This room is for the use of 6 through 18 year old members of homeowner’s families during Clubhouse hours.
  3. Guests of these teen residents will be limited to 4 per homeowner family. Guests are limited to the Teen Room on Saturday and Sunday only from September 1st to May 31st.
  4. Homeowner’s children have priority over guests in the use of the Teen Room facilities.
  5. Young residents and their guests are responsible for giving the furnishings reasonable care, and leaving the room in a neat condition.
  6. No alcoholic beverages shall be permitted by anyone in this room.
  7. No wet bathing suits will be allowed in the Teen Room.
  8. No smoking will be allowed in the Teen Room.
  9. No obscene language will be permitted.
  1. BILLIARD ROOM
  2. Use limited to Homeowners and their guest persons 19 years of age or older. Except young people, 16 or older will be allowed when playing at a table with an adult homeowner.
  3. Guests, except house guests, must be accompanied by the owner, or a member of the owner’s family.
  4. An owner and his guests will limit themselves to the use of one table when other members are present and wish to play on the other table.
  5. Any substance (i.e., powder on hands) other than pool chalk is prohibited.
  1. COMMONG AREA
  2. GARBAGE
  3. Garbage should be left by the street on garbage day by 7:30 AM, and returned to the garbage bin within 12 hours after pick-up. Garbage cans and recycle bins can not be left in the carport or shrubbery.
  4. Members shall place garbage in sealed polyethylene bags and place in garbage cans with tight fitting lids, in trash bins, which are located next to carports, or under decks. The garbage bin doors are to be kept closed.
  5. Pickups of a special nature should be discussed with the manager.
  1. CARPORTS
  2. Carports shall be kept in a neat and clean condition and shall be limited to the use of motorized vehicles, bicycles, boats and fold-down campers only. Camper length must not exceed the length of the carport.
  3. Unsightly, inoperable vehicles may not be stored in carports.
  4. Small flower pots are allowed provided the size, shape, and color are well as choices of plants are approved by the Board. Any pot that interferes with a neighbor’s use of their carport will be removed.
  1. UNDER DECK AREA
  2. This area shall be kept in a neat and clean condition.
  3. No animals are to be housed in this area.
  1. PATIO/DECK COVERS
  2. Patio and deck covers should be kept neat, clean and in orderly repair or replaced if deteriorating.
  1. PRIVATE ROADS AND PARKING
  2. All members, their families and guests will observe the 10 mile per hour speed limit.
  3. Temporary parking for not more than 7 days will be allowed within the confines of Vestavia Knolls common area parking for the purpose of cleaning, packing, repairing, etc. of the following vehicles: campers, camper bodies, motor homes, boats, trailers, etc. No vehicle of the tractor/trailer type, and no vehicle having more than four wheels, except motor homes, shall be parked within any area of the confines of Vestavia Knolls at any time. The Board of Directors or its authorized representative(s) are empowered to remove any such vehicles by any lawful means, and the owner(s) and/or operator(s) of any such vehicles(s) shall be responsible for any costs incurred in the removal of said vehicle(s) and shall pay any such charges within five days after notice of same. Any unpaid charges shall constitute a lien against the property of the said owner(s) and/or operator(s) in the same manner as set forth above.
  4. No vehicle is to remain in any parking space other than the carport unless vehicle is in good operating order. Vehicles in disrepair and/or inoperable will be removed, at the owner’s expense, from the common area after a seven day written warning. Vehicles in disrepair and/or inoperable will be removed, at the owner’s expense, from the carports after a thirty day written warning.
  5. Parking on the grass or in non-parking areas, including in front of carports, is prohibited.
  6. Driving a motor vehicle on the grass or sidewalk is prohibited.
  7. Motorized vehicles, (i.e. motorcycles, mopeds, go-carts etc.) shall not be driven on Vestavia Knolls property except for ingress or egress of residence.
  8. Bicycles brought to the Clubhouse, tennis court, swimming pool, or playground areas shall be parked upright in the main Clubhouse parking lot.
  1. PETS
  2. Animals must be kept on a leash in common areas at all times.
  3. Curbing of pets is restricted to the areas shown on attached diagram.
  4. Homeowners are responsible for removing any stool deposited by their pet in any area other than the designated pet walks. Homeowner will not allow pets to urinate on any shrubs or plants.
  5. Dogs running at large will be reported to the proper authorities and homeowners will be cited or fined as appropriate.
  6. Animals are not allowed in Clubhouse, on the playground, tennis court or in the pool enclosure.
  1. GARDENING
  2. Except in the patio areas and under decks, no planting other than annuals shall be done without prior approval by the Association Board of Directors on their designate as provided in the declarations.
  3. The Board of Directors reserves the right to require any homeowner to trim or remove trees or plantings that extend beyond the patio area or beyond 8 feet in height or where branches or roots may endanger property or interfere with exterior maintenance of homes. Planting will be allowed to bloom, but must be trimmed as soon as reasonably possible thereafter.
  4. Homeowners are responsible for any damage done by trees, shrubs or any plantings in their patio area. The planting of new trees or replacement of existing trees is prohibited.
  5. No plantings will be allowed to grow on any non-masonry surface.
  1. EXTERIOR ADDITIONS AND ALTERATIONS
  2. No exterior additions may be made without prior written approval by the Association Board of Directors or their designate as provided in the declarations. Decisions will be made on a case-by-case basis.
  3. Patio covers, exterior aerials, attic vents, window air conditioners, window fans, etc. are considered “exterior additions”.
  4. The hanging, displaying or attaching of any object on the exterior of any structure, including the storage bins, garbage bins and patios where visible from the common area, without prior written approval of the Board of Directors, is prohibited. The American flag is an exception to this rule.
  5. No alterations or changes, of any type, to any exterior structure, fence, window, door, surface, façade, attachment, or any other exterior portion of any townhouse may be made without written approval by the Association Board of directors or their designate as proved in the declarations. Decisions will be made on a case-by-case basis.
  1. OTHER AREAS
  2. Ball playing, and other games, involving more than three persons shall be limited to the area behind Building #8 or the field beside Building #20, which is on the right as you enter the complex.
  3. No personal property of any description shall be allowed to remain in the common area, unless prior approval for same is obtained from the Board of Directors.
  4. No cooking, grilling or similar activity will be allowed in any part of the common area.
  1. RESPONSIBILITY FOR DAMAGE
  2. Any owner will be responsible for damage to any part of the Clubhouse or common area, including outside of buildings, carports and patios caused by him, his guests, his agents, or any member of his family.
  3. In the case of the above, the owner will authorize the Association to repair the damage. The owner will then repay the Association the amount actually expended for such repairs.
  4. Repair and replacement, if necessary of patio fences and decks are homeowners’ responsibility. Any needed repairs or replacement of fences and/or decks not repaired by homeowner within 30 days after notification may be repaired by the Association and the homeowner will be billed the actual cost. The Board of Directors shall make all decisions regarding the necessity of repair and/or replacement.
  5. The owner will pay the above charges on receipt of a bill from the Association. If not paid within 15 days of receipt of the bill from the Association, the charge will be considered delinquent.
  1. SALE OR RENTAL OF TOWNHOUSE UNIT
  2. All persons who purchase a townhouse unit at Vestavia Knolls are required to give a copy of the recoded deed to the manager. All owners who rent their homes are required to give notification in written form to the manager. All homeowners planning to sell shall notify the manager. All persons owning a townhouse unit at Vestavia Knolls are required to obtain and keep in full force and effect at all times a Termite Bond, and to give a copy of said termite bond to the manager.
  3. Renters will have full use of the facilities subject to the same restrictions as members.
  4. The owner who has rented his townhouse gives up his privileges as a member of the Association as to the use of the facilities but retains his voting rights, subject to those restrictions outlined in the Declarations.
  1. CONDUCTY AT MEETINGS OF THE BOARD OF DIRECTOERS

Presently, homeowners have the opportunity to express their opinions on any subject both prior to the regular meeting of the Board of Directors, and then again immediately before adjournment. No interruptions of any type will be tolerated at any other times, and any Director may issue a Warning to any offending homeowner or other person, and also issue a Citation when appropriate.
