Overview
This user guide provides an introduction to using the electronic Designs Searchable Journal.
Types of Searches
A search of the Designs Journal can be done by (1) searching particular details of a journal such as the date it was published; or by (2) searching for publications for a particular design or class of designs.
Searching by Journal Details
Journal section
All sections of the journal indicated by ** can only be searched by Design Application Number or Design Registration Number.
Volume/Issue no.
To search for a particular issue enter the Volume and Issue separated by a slash (e.g. 15 or 15/6 respectively). Prior to September 2015 the Designs Office issued one volume per year and normally one issue of a volume was published each fortnight.
Publication date
If only the Start Date is entered then the search is for a Journal published on that date. If only an End Date is entered then all publications up to that date are selected.
Application for Extension of Period of Registration
The section displays applications with a request for extension of period of registration. The list displays the registered owner, registered date along with the registration number as shown below. Click Next to view the subsequent listings.
Application for Extension of Time
This section displays designs where a request for more time, usually at least three months,has been filed to perform a particular action. For example, an owner can request more time to respond to a notice from IP Australia. This section displays the design number and the details of the requested extension.
Applications Assigned
This section displays designs that have a new owner.
Applications Lodged
This section displays applications filed with IP Australia.
Bibliographical Data
Bibliographic data is unique data associated with an IP right (or an IP right application).
Bibliographic data includes:
- The names and addresses of people or organisations linked to the IP right (e.g. the owner (or applicant); the IP creator, the agent (if present) and the publishing authority)
- Significant dates associated with the IP right (e.g. filing, priority, publication and registration dates)
- Information that identifies the IP right and makes it discoverable (e.g. a title, an identifying number and classification details)
- Depending on the type of IP, an abstract of the description of the IP and/or a representation of the IP.
Class Listing of Designs Registered **
All major Design Offices, including Australia, classify design applications using the International Design Classification system. A class listing, also known as a classification code, provides a general indication of the goods of a design. For example, classifications include articles of clothing; furnishings; musical instruments; medical and laboratory equipment.
The searchable Journal allows for searching registered designs by class listing (classification code) for a particular date or a date range.
The search results are initially sorted numerically by application number.
Results are now displayed in order of numerical classification code.
Corrigenda
A corrigenda is a publication to correct an error made in a previous publication.
Click on the application number for further information about the corrigenda.
Designs Certified
This section displays designs that have passed the examination process and a certificate of examination has been issued to the owner. Owners of certified designs have enforceable rights.
Designs Published
This section displayslist of the published designs.
Designs Revoked **
This section displays the designs revoked. For example, screen shot below displays a list of designs revoked upto published date of 15 March 2016.
Exclusions
This section displaysexcluded designs and can be searched by selecting exclusions under Journal section. For example, see screenshot below.
Extension of Period of Registration (2003 Act) **
This section displays only those applications with extension of period of registration under 2003 Act.
Extension of Period of Registration First Renewal**
Design applications that were filed before 17 June 2004 - the date the new Designs Act 2003 came into effect - can only be renewed under the terms of the old Act.
The old Act allowed two renewal periods of five years each, in addition to the original registration of six years, for a maximum registration period of 16 years.
This section displays designs under the old Act that had the original six year registration period.
Extension of Period of Registration Second Renewal **
This section displays designs under the old Act that had a second registration period.
Extension of Period of Registration Third Renewal **
This section displays designs under the old Act that had a third registration period.
Extensions of Time Granted
This section displays applications granted with extentions of time under section 137.
Interests
A person who has an interest in a design, such as a Mortgage or a Licence, may have that interest recorded in the Designs Register.This section displays designs which have had an interest recorded.
Lapsings
This section displays design applications that are no longer active. For example, an application may lapse if registration has not been requested within six months of the priority date.
Names Registered Alterations and Amendments
This section displays design registrations where the name of the owner has changed. The new name is normally indicated within brackets.
Refusals
This section displays applications where the Registrar has refused to register the design.
Registration Proceedings **
This section displaysapplication with registration proceedings.
Registrations Ceased **
This section displaysdesign registrations that are no longer active. For example, a registration may end if the renewal fee is not paid.
This section can be searched by registration number.
Register Change Notices
The section displays applications with amendments. Any objection to the amendment must be lodged within one month of the date of the journal publication date.
Subsequent Owners Registered
The rights granted to a owner by a design are personal property and like other types of proprietary rights, are capable of assignment, licensing and of devolution by operation of law.
This section displays applications with the current owners.
Withdrawals
This section displays applications that are no longer active.
Searching by Designs details
Application/Design no(s).
Enter the application number in YYYYNNNNN format (i.e. 9 digits), where YYYY is the year. You may also use a comma (,) to separate Application numbers and a hyphen (-) to indicate a range: e.g. 200201484, 200201485, 200201495-200201500.
Registration number(s)
Designs registered in Australia before XX September 2015 were allocated a six-digit registration number.
Use a comma (,) to separate Registration numbers and a hyphen (-) to indicate a range: e.g. 360083, 347455, 120360-120375.
Classification code(s)
A class listing, also known as a classification code, provides a general indication of the goods of a design. For example, classifications include articles of clothing; furnishings; musical instruments; medical and laboratory equipment.
Enter the Classification code numbers separated by a space: e.g. 08-03 23-02F.
Keywords
To search for “John” and “Smith” enter +John +Smith, to search for “John” or “Smith” enter John Smith. Use quotes for exact phrase search e.g. "John Smith".
