Use of Information from Paricipating Hospitals and Clinicians

USE OF INFORMATION FROM PARICIPATING HOSPITALS AND CLINICIANS

Iowa Healthcare Collaborative (“IHC”) has contracted with the Iowa Department of Human Services (“IDHS”) for purposes of the State Innovation Model Project (“SIM Project”). The SIM Project is a subcontract to a prime contract between the U.S. Department of Health and Human Services, Centers for Medicare and Medicaid Services (“CMS”) and IDHS. As part of the SIM Project, IHC is providing various data analytics services to the Community and Clinical Care project (also referred to as “C3”). The C3 is working with hospitals and clinicians (each a “Provider Organization”) in its service area to have information provided by the Provider Organizations to IHC for purposes of the SIM Project (“Information”).

The permitted use and disclosure of the Information is restricted to performing services for the SIM Project. IHC will disclose the Information to the SIM Project through the use of the SIM data portal (“the Portal”).. The Portal will display, in aggregate, the Information applicable to the C3 and is to be used by the C3 only for those purposes established by the SIM Project. Depending on the number and size of reporting Provider Organizations, Information provided through the dashboard relating to a particular Provider Organization may be identifiable.

As a condition of using or disclosing the Information, each party agrees that IHC makes no representation or warranty, either implied or express, with respect to the accuracy of any data in the Portal or otherwise.

As a condition of being granted access to the Portal, SIM Project participants are to:

  • Not use or disclose the Information other than as permitted above or as otherwise required by law.
  • Use appropriate safeguards to prevent the use or disclosure of the Information that is not in accordance with the permissible uses or disclosures described above.
  • Upon becoming aware, promptly report to the IHC, the C3, and the Provider Organization that provided the Information any use or disclosure of Information that is not in accordance with the permissible uses or disclosures described above.
  • Take all appropriate actions to ensure that any agents, including subcontractors, who receive the Information will agree to the same restrictions and conditions as described above with regard to the Information.

The C3, as a condition of being granted access to the dashboard information provided by IHC, also agrees to destroy the Information upon request by either IHC or the applicable Provider Organization.

IHC is not responsible for the actions/inactions of the C3.

Any questions concerning use of the Portal should be directed to the IHC Program Lead for Data Strategies.

All other questions should be directed to the C3
