REGULAR MEETING

NOVEMBER 19, 2015

Mayor Moslowski called the meeting to order at 6:03 p.m. and requested the Clerk to call the roll. The following Committee Members were present: Dr. Robert A. Frascella, Ms. LoriSue H. Mount and Mayor Moslowski Jr. Also present at the dais: Dana L. Tyler, Municipal Clerk, Dianne Kelly, CFO/Administrator, Dennis A. Collins Esq. Township Attorney. Absent was Stephen J. Alexander and Robert Faber.

Following the Flag Salute, the Clerk announced that the Notice requirements of R.S. 10:4-18 for an "Annual Notice" had been satisfied by the publication of the required advertisement in the Asbury Park Press and the Messenger Press January 9, 2014 posting the notice on the Board in the Upper Freehold Township Municipal Building and filing a copy of said notice with the Municipal Clerk.

REPORTS: Committee Liaisons will each provide reports on their respective departments, monthlyreports prepared by Department Heads, listed herein, are on file in the office of the Municipal Clerk.

RESOLUTION 163-15 A RESOLUTION GRANTING A RAFFLE LICENSE TO THE KNIGHTS OF COLUMBUS COUNCIL #7333

The following Resolution was offered by Dr. Frascella, moved and seconded by Ms. Mount.

BE IT RESOLVED, that Raffle License #RL 310-15 be granted to the Knights of Columbus Council#7333 for an On-Premises Raffle, to be held at the St. John’s Catholic Church, 1282 Yardville-Allentown Road, Upper Freehold Township on December 12, 2015.

This Resolution was approved by the following vote: Dr. Frascella, aye, Ms. Mount, aye; and Mayor Moslowski Jr., aye.

CONSENT AGENDA

WHEREAS, the following resolutions having heretofore been placed on this agenda require no discussion and same having been previously reviewed by the members of the Township Committee be and are hereby adopted. The following Consent Agenda was offered by Ms. Mount moved and seconded by Dr. Frascella.

resolution 164 -15 a resolution authorizing an overpayment for truck repair be refunded to olga and mitchell seinfeld

WHEREAS, on June 6th 2008 Upper Freehold acquired a tax lien at a sale held by Barbara Pater, Collector of Taxes, Upper Freehold Township for certain property described as Block 21 Lot 3 of the Upper Freehold Township Tax Map, more commonly known as Route 526 Cream Ridge, NJ certificate #08-00003 and,

WHEREAS, the Tax Sale Certificate issued was recorded June 17, 2008 in the office of the Monmouth County Clerk in Mortgage Book OR8727, Page 5926 , and

WHEREAS, this tax sale certificate issued has been satisfied by payment in full and the Tax Collector does so certify.

NOW, THEREFORE, BE IT RESOLVED that the Mayor and Clerk be and are hereby authorized to sign the tax sale certificate for the property known as Block 21 Lot 3

on the Upper Freehold Township tax map, more commonly known as Route 526 Cream Ridge, NJ.

RESOLUTION 165-15 A RESOLUTION AUTHORIZING THE RELEASE OF A CASH MAINTENANCE BOND IN CONNECTION WITH CREAM RIDGE STORAGE – YONG S. SIM FOR PLANNING BOARD APPLICATION #07-16, BLOCK 35, LOT 12

WHEREAS, Yong S. Sim, for Planning Board Application #07-16, Block 35,
Lot 12 submitted a Maintenance Surety Bond in the amount of $107,250.00 written by Hanover Insurance Company Bond #BMY A043031 for guaranteeing the Improvements of the Site Plan for a period of two years on July 11, 2013 by Resolution 128-13, and;

WHEREAS, our Township Engineer’s Letter dated November 6, 2015 certifies that he has inspected the site and found that all required improvements previously constructed have been maintained and is in satisfactory condition and recommends the release of the Maintenance Guarantee.

NOW, THEREFORE BE IT RESOLVED that the Township Committee of Upper Freehold Township does hereby authorize the Chief Financial Officer to release this cash maintenance guarantee along with any Inspection escrow and interest provided that all fees due and owing the Municipality and/or Township Professionals are paid in full.

BE IT FURTHER RESOLVED, that a certified copy of this resolution be forwarded to the Chief Financial Officer, Planning Board, and Township Engineer.

RESOLUTION 166-15 A RESOLUTION AUTHORIZING THE ISSUANCE OF LIQUOR LICENSE #1351-33-001-005 TO SENILLINE, INC. FOR THE 2015-2016 LICENSING YEAR

BE IT RESOLVED, That the Plenary Retail Consumption License known as 1351-33-001-005, be issued to Senilline, Inc. for the 2015-2016 licensing year with the following conditions which are the same as those placed on this license at the time of transfer (5/22/97):

That an employee will be posted outdoors to ensure that patrons do not throw debris on neighboring properties.

That employees will be posted outdoors at closing to insure that patrons do not disturb area residents nor infringe on their peace and right to quiet enjoyment of life.

BE IT FURTHER RESOLVED, That a copy of this resolution be forwarded to the Director of the Division of Alcohol and Beverage Control and the Licensee.

DISCUSSION:

Monmouth County Engineer, Mr. Joseph Ettore and his team were present to provide the Township Committee with an update on the Sharon Station Road project. Currently they are experiencing difficulty obtaining the necessary permits from the NJ Department of Environmental Protection which is currently e delaying the project. Monmouth County has upgraded the bridge support and there is a strong need to improve the traffic and safety on that road.

The Township Committee has authorized CFO/Administrator Kelly to write a letter of hardship to the NJ Department of Environmental Protection to assist in obtaining the permits.

Monmouth County is also repairing the bridge on Harvey Road due to stress fractures that was caused by d over weight vehicles on it. It will be some time before it is completed.

Amazon Traffic on Route 539 – currently the jurisdiction is joint between Mercer and Monmouth County. The location is in Robbinsville, Mercer County, therefore it is difficult to force jurisdiction in Monmouth County. Currently there are meetings set up with all the parties involved, trying to cooperate and provide a solution for all that are effected. Robbinsville has police officers out trying to help the traffic flow better. It is casuing a major traffic impact on Lynwood Estates in Upper Freehold along with homes on Route 539.

Lt.. Howell – Robbinsville Police Department has 5 officers a day at the location to try to assist with the traffic delays.

Officer Chris Nitti was present stating that they are doing all they can to help, Amazon had 500 employees and for the holidays they are up to 5000 employees. They are working on trying to provide incentives to the employes to car poole, along with off site busing available. Amazon is currently trying to tweek the works shifts.

Committeewoman Mount thanked everyone for coming to the meeting. There is no simple solution and our hands are tied, the numbers keep growing, and there is nothing in place to recifity the situation. Not sure what would work, dedicated lane but the congestion is affecting this area hard, what is being done for emergency services to be able to respond. Is there a way we can spread out the congestion. Time is of the essence.

PRIVILEGE OF PUBLIC:

Mr. Pinto, 9 Denise Drive –Stated he was involeved from the beginning and was present regarding the hearings for the Matrix Warehouses and it was proved then that the traffic pattern wouldn’t work. There are currently big traffic problems. The Matrix developers knew there would be a problem.

Stephanie Granite, 1349 Old York Road – This is crazy, we can’t get out of our driveway, we can’t get anywhere.

Robert Korn, 11 Denise Drive – There are all kinds of traffic issues; we need to find a long term solution.

Karen Lalla, 9 Jennings Drive –Something needs to be done, the traffic is awful, there have been 3 accidents in 2 days.

Jamie Clark, 4 Roberts Ct. – Thanked the Township Committee for having them to discuss the traffic issue. How do we make sure that something gets done so next year there isn’t the same problem?

Adam Redlich, 9 Elisha – Suggested that red and blue placard cards be handed out to the employees at Amazon to make them go different directions or leave at certain times. The Robbinsville Police officer explained that they were making and stealing handicapped placards so they can park closer, he didn’t think that was a solution that would work. He stated that they are trying to make it better.

Laura Foley, 1 Denise Drive – Suggested that maybe Amazon can ask the employees to get off at exit 7 to help with the traffic flow, or apply pressure for employees to take an alternate route? A possible solution is do not block the box?

Karen Layla, 9 Jennings Drive – Thanked the Township Committee for allowing the residents to come and speak regarding the Amazon traffic. Something needs to be done about the traffic, sooner than later.

Karen Doherty, 5 Elisha Drive – There is a lot of volume on the Road, is it possible to make the employees go out to Gordon Road? It may help because it is a longer road.

Christine Cadigan,3 Lonnie Drive – She works in the Attendance office in the High School and stated a lot of the children are late and losing credit. They are getting stuck in the traffic.

Denise Coiante, 33 Cliffwood – The Amazon employees should take exit 7, 195 is gridlocked and maybe this would help. All the activity is making the drivers more aggressive.

Mr Murphy, 49 Cliffwood – You are trying your best, and it has gotten worse. Find a way to put the traffic back on 195 and find another route. Matrix did a bad traffic study. There should have been steps taken to protect the residents…. What is the Township going to do.
