AN ACT relating to cancer research.

Be it enacted by the General Assembly of the Commonwealth of Kentucky:

SECTION 1. A NEW SECTION OF KRS CHAPTER 164 IS CREATED TO READ AS FOLLOWS:

(1) Contingent upon available funding, the James Graham Brown Cancer Center at the University of Louisville and the Lucille P. Markey Cancer Center at the University of Kentucky shall jointly establish and maintain a cancer tissue registry for cancer tissue donation for research purposes. Costs for establishing and maintaining a cancer tissue registry may be funded by state general fund appropriations, federal or private funds or grants, or other public or private funds.

(2) The cancer research registry may be established or maintained by a registry gatekeeper who shall be responsible for the operations, maintenance, privacy, and security of the registry. Gatekeeper functions may be performed by a private or public non-profit entity approved by the deans of the medical schools at the University of Louisville and the University of Kentucky. The gatekeeper shall specify timely access to the registry by relevant parties in accordance with federal and state laws and regulations relating to cancer tissue donation, procurement, and research.

(3) The Brown Cancer Center and the Markey Cancer Center, or the registry gatekeeper, shall establish an ongoing collaboration with the Cabinet for Health and Family Services, the Kentucky Medical Association, the Lung Cancer Research Program, the Kentucky Cancer Caucus, the American Society of Clinical Oncology, the Kentucky Chapter of the American Cancer Society, other federally recognized cancer research entities that operate in Kentucky, and related entities, to establish strategies for an individual to designate donor status and entry into the registry. Strategies shall include, but not be limited to, donor designation at the time of surgery, online and other registration, and removal or exit from the registry.

(4) The Brown Cancer Center and the Markey Cancer Center, or the registry gatekeeper, shall report by August 1, 2007 and annually thereafter to the Governor and the Legislative Research Commission on the effectiveness of the operation of the registry, including but not limited to advances in cancer research and public awareness and educational efforts relating to the cancer tissue registry.

(5) Nothing in this section shall be construed to permit stem cell research.
