Instructions

Pursuant to the restrictions set forth in Section 5 of the Student Conduct Code, informal or alternative dispute resolutions may be used at any time during the resolution process, including prior to and during the investigation stage.Informal or alternative processes include but are not limited to facilitated dialogue, mediation, and restorative justice.

In all cases, informal or alternative processes may only be used when both the Complainant and the Respondent (where a Respondent is identified) voluntarily agree to pursue an informal or alternative resolution.

Additionally, before allowing parties to use informal or alternative processes, the Director of Student Conduct and the Title IX Coordinator must determine that an informal or alternative approach is consistent with the University’s obligations – under the law, institutional policies, and institutional values – to stop the behavior, end the harassment, prevent the harassment from happening again, and address or remedy its effects.

If parties do not reach an agreement in an informal or alternative process, they may pursue whatever formal process was initially available to them. In other words, they do not waive their right to pursue formal resolution simply by participating in an informal or alternative process.

NOTE: Informal or alternative processes will not be used to resolve allegations or matters of sexual assault or sexual violence. Requests for informal resolutions may be directed to the Director of Student Conduct or the Title IX Coordinator.

In writing, explain the reasons you believe that an informal resolution would be effective to resolve the underlying matter. Be as specific as possible and provide information that you believe supports your request. (NOTE: any information you share here will also be retained in case it is relevant to the underlying investigation.)

Note: Filing arequestis a University procedure, not a civil or criminal procedure. Briefs containing legal argument will not be accepted as part of your request.

Step 3: Timely Delivery to the Decision-maker

Submit this form to the Decision-maker as soon as possible during the Formal Process.
