Part 1—Preliminary
1Purpose
The main purpose of this Act is to amend the University of Ballarat Act 2010 to change the name of the University of Ballarat to Federation University Australia.
2Commencement
This Act comes into operation on 1 January 2014.

In this Act, the University of Ballarat Act 2010 is called the Principal Act.

4Change of name of Principal Act
s. 4
In the title to the Principal Act for "University of Ballarat" substitute "Federation University Australia".
5Preamble
(1)In the sixth paragraph of the Preamble to the Principal Act for the "The University is" substitute "The University was".
(2)At the end of the Preamble to the Principal Act insert—
"In 2013 the University of Ballarat resolved to request that its name be changed from the University of Ballarat to Federation University Australia to reflect its broadened focus beyond central and western Victoria.
Following that resolution, this Act was amended by the University of Ballarat Amendment (Federation University Australia) Act 2013(the "2013 Act") to change the name of the University of Ballarat to Federation University Australia. The 2013 Act also changed the name of this Act to reflect the new name of the University.
Federation University Australia is based on a federated network of campuses in regional Victoria, partner-provider institutions across Australia and overseas as well as national and international research collaborations. The Universityaims to offer agile, relevant and work-ready technical, academic and research programs over the full breadth of the Australian Qualifications Framework. Federation University Australia is regional in outlook, national in scope and international in reach.
Federation University Australia is resolute in its commitment to regional, rural and remote students. It is determined to improve the participation of indigenous and Torres Strait Islander people in tertiary education. It is rigorous in its promotion of international principles. Accordingly, inclusion, access, support and empathy are its core values.".
6Purposes

In section 1 of the Principal Act—
(a)in paragraph (a)after "the University of Ballarat" insert "(now named Federation University Australia)";
(b) at the foot of paragraph (a) insert—
'Note
Amendments to this Act by the University of Ballarat Amendment (Federation University Australia) Act 2013 changed the name of the University from "University of Ballarat" to "Federation University Australia".'.
7Definitions
(1)In section 3 of the Principal Act in the definition of University for "the University of Ballarat" substitute "Federation University Australia".
(2)In section 3 of the Principal Act in the definition of Visitor for "acting Visitor;" substitute "acting Visitor.".
(3) In section 3 of the Principal Act the definitions of Ballarat region and Wimmera region are repealed.
8University of Ballarat
s. 8
(1)For the heading to section 4 of the Principal Act substitute—
"Federation University Australia".
(2)After section 4(1) of the Principal Act insert—
'(1A) By amendments to this Act made by the University of Ballarat Amendment (Federation University Australia) Act 2013, the name of the University is changed from "University of Ballarat" to "Federation University Australia".'.
(3)In section 4(2)(b) of the Principal Actfor 'the"University of Ballarat"'substitute'"Federation University Australia"'.
9Acquisition of land
In section 36(3)(a) of the Principal Act for "University of Ballarat Act 2010" substitute "Federation University Australia Act 2010".
10New Division 4 of Part 8 inserted
After Division 3 of Part 8 of the Principal Act insert—

79University is same body despite change of name
(1)Despite the change of the name of the University to Federation University Australia, the University is the same body as the University of Ballarat in existence immediately before the commencement of the University of Ballarat Amendment (Federation University Australia) Act 2013 and no decision, matter or thing is affected because of that change of name.
(2)Any power exercised before 1 January 2014 under the name "University of Ballarat" is taken, on and after that date, to have been exercised under the name "Federation University Australia".
(3)On and after 1 January 2014, the Council of the University of Ballarat continues in operation as the Council of Federation University Australia according to the terms of appointment that applied immediately before that date.

(4)The affixing of the common seal of the University of Ballarat before 1 January 2014 is taken, on and after that date, to have been the affixing of the common seal of Federation University Australia.
80Superseded references
On and after1 January 2014, in any Act (other than this Act) or in any subordinate instrument or in any other document of any kind, unless the context otherwise requires—
(a)a reference to the University of Ballarat Act 2010 is taken to be a reference to the Federation University Australia Act 2010; and
(b) a reference to the University of Ballarat is taken to be a reference to Federation University Australia—
so far as it relates to any period after that date.
81Persons enrolled as student of University of Ballarat
On 1 January 2014, each person who is enrolled as a student of the University of Ballarat immediately before that date is taken to be enrolled as a student of Federation University Australia on the same terms thatapplied immediately before 1January 2014to that person as a student of the University of Ballarat.
82Conferral of degrees and granting of other awards—persons entitled to degree or other award before 1 January 2014
s. 10
(1)On and after 1 January 2014, any degree conferred by the Council on a person who, before that date, has fulfilled the conditions prescribed under the university statutes and university regulations for admission to that degree must be conferred in the name of the University of Ballarat.
(2) On and after 1 January 2014, any diploma, certificate, licence or other award granted by the Council to a person who, before that date, has fulfilled the conditions prescribed under the university statutes and university regulations for the granting of that diploma, certificate, licence or award must be granted in the name of the University of Ballarat.
83Conferral of degrees and granting of other awards—persons enrolled as student of University of Ballarat
(1)For a period of 6 years commencing on 1January 2014, the Council may confer a degree or grant a diploma, certificate, licence or other award in the name of the University of Ballarat if—
(a)the person being admitted to that degree or being granted that diploma, certificate, licence or award—
(i) was, immediately before 1January 2014, enrolled as a student of the University of Ballarat in a course leading to that degree, diploma, certificate, licence or award; and
(ii)fulfilled the prescribed conditions after that date; and
(b) had the person fulfilled the prescribed conditions before that date, the Council would have had the power, under the university statutes and university regulations in force at that time, to confer that degree or grant that diploma, certificate, licence or award in the name of the University of Ballarat; and

(c)subject to subsection (2), the person has requested in writing that the degree, diploma, certificate, licence or award be conferred or granted in the name of the University of Ballarat.
(2) A request under subsection (1)(c) must be submitted to the University within the time and be in the form determined by the Council.
(3)The Council must ensure that each person who is able to make a request under subsection (1)(c) is notified of that ability in accordance with subsection (4).
(4)A notification under subsection (3) must—
(a)be in the manner determined by the Council; and
(b)allow sufficient time for the person notified to make the request in accordance with subsection (2).
(5)In this section—
prescribed conditions, in relation to a degree or a diploma, certificate, licence or other award, means the conditions prescribed under the university statutes and university regulations that must be fulfilled for that degree to be conferred or for that diploma, certificate, licence or award to be granted (as the case may be).

84Use of common seal of University of Ballarat
The common seal of the University of Ballarat may be used for the purposes of conferring a degree or granting a diploma, certificate, licence or other award in the name of the University of Ballarat in accordance with section 82 or 83.'.

11Education and Training Reform Act 2006
s. 11
In section 1.1.3(1) of the Education and Training Reform Act 2006 in the definition of university with a TAFE division for "University of Ballarat" substitute "Federation University Australia".
12State Employees Retirement Benefits Act 1979
In Schedule 2 to the State Employees Retirement Benefits Act 1979—
(a)after "Deakin University" insert "Federation University Australia";
(b)omit "University of Ballarat".
13State Superannuation Act 1988
In Schedule 2 to the State Superannuation Act 1988—
(a)after "Deakin University" insert "Federation University Australia";
(b)omit "University of Ballarat".

Part 4—General
14Repeal of amending Act
s. 14
This Act is repealed on 1 January 2015.
Note
The repeal of this Act does not affect the continuing operation of the amendments made by it (see section 15(1) of the Interpretation of Legislation Act 1984).
