CALENDAR PROTOCOLS FOR JUDGE ROSA FIGAROLA (UF 203)

(5) Minute Motion Calendar: Thursday 9:00-9:30 AM

To set a case on the five (5) minute motion calendar, the Motion and the Notice of Hearing must be electronically filed by attorneys with the Clerk of Court at the Miami-Dade Children’s Courthouse. If self-represented, motions may be filed with the assistance of the Family Court Self Help Program,located atLawson E. Thomas Courthouse Center, 175 NW 1st Avenue, 24th Floor, Miami, FL 33128. The original motion must be filed with the Clerk of Court at the Children’s Courthouse, located at 155 NW 3rdStreet, Miami, FL 33128, and a courtesy copydelivered to the assigned UFC Judge’s Mailbox at the Children’s Courthouse Resource Center, Room #1335. Courtesy copies must be submitted upon filing the Motion and Notice of Hearing with 7 business days notice.

CANCELLATIONS: Counsel that schedules a hearing must file a Notice of Cancellation with the Clerk of Courts if the hearing that has been requested is cancelled, with a courtesy copy sent to the Judge’s Chambers.

To set Uncontested Final Hearings, a Notice of Hearing must be filed with 7 businessdays notice with the Clerk of Court at the Miami-Dade Children’s Courthouse, located at 155 N.W. 3rd Street, Miami, FL 33128. Self-representedlitigants may obtain assistance from the Family Court SelfHelp Program,located at Lawson E. Thomas Courthouse Center, 175 N.W 1stAvenue, 24th Floor, Miami, FL 33128, but must file the Notice of Hearing with the Clerk of Court at the Children’s Courthouse. Courtesy copies of the documents filed must be delivered to the assigned UFC Judge’s Mailbox at the Children’s Courthouse Resource Center, Room #1335, upon filing of the original Notice of Hearing.

Attorneys must bring a paper copy of the signed settlement agreement to the Uncontested Hearing.

Emergency Procedures Information:

Emergency Motions must first be filed with the Clerk of Court at the Miami-Dade Children’s Courthouse, located at 155 NW 3rdStreet, Miami, FL 33128. The Emergency Motion and Request for Hearing must be electronically filed (e-filed) by attorneys. Self-represented litigants may seek assistance from the Family Court SelfHelp Program, located at the Lawson E. Thomas Courthouse Center, located at 175 NW 1stAvenue, 24th Floor, Miami, FL 33128, or come in person to the Clerk of Court, located at the Children’s Courthouse. All motions must be filed at the Children’s Courthouse. Courtesy copies of the Emergency Motion and Request for Hearing must be delivered to the assignedUFC Judge’s Mailbox at the Children’s Courthouse Resource Center, Room #1335, upon filing. The Judge will review the Motion, and the Judicial Assistant will follow-up accordingly with scheduling.

Special Sets:

Motions and Requests for Hearing for any matter requiring a special set hearing must be electronically filed with the Clerk of Court. Self-represented litigants may seek assistance from the Family Court SelfHelp Program, located at the Lawson E. Thomas Courthouse Center, 175 NW 1st Avenue, 24th Floor, Miami, FL 33128, or may file the Motion and Request forHearing with the Clerk of Court, located at Miami-Dade Children’s Courthouse, 155 NW 3rdStreet, Miami, FL 33128. All Motions and Requests for Hearing must be filed at the Children’s Courthouse. A courtesy copy of the Motion and Request for Hearing should be delivered to the assigned UFC Judge’s Mailbox at the Children’s Courthouse Resource Center, Room #1335, upon filing of the motion.

Modifications of Placement in Dependency Cases:

Motions for Modification of Placement (MOP) filed in Dependency cases will be handled in the same manner as UFC Shelter Hearings. They will be heard on the daily 1:30 pm UFC Shelter Hearing Calendar, in Courtroom #10-2, by the UFC Judge assigned to Shelter Hearing coverage for the week.

The moving party must file a copy of the Motion and Affidavit for MOP with the Clerk of Court, and email a copy to both the weekly Shelter Hearing Judge and the assigned UFC Judge, as well as to Eileen Suero, AOC UFC Program Coordinator, . Note that filing the Motion for MOP with the Clerk of Court only is not sufficient for purposes of having the case heard on calendar.

The moving party must notice all parties to appear. In order for all parties to have sufficient advance notice of the hearing, the Motion for MOP must be filed no later than 10:00 am for it to be heard on the same day, otherwise it will be calendared for the following day’s UFC Shelter Hearing Calendar, at 1:30 pm.

Emergency Dependency/Delinquency Hearings:

Should an emergency hearing need to be scheduled in a Dependency/Delinquency UFC matter such that it cannot wait to be heard during the UFC Judge’s weekly UFC Delinquency Calendar, then it shall be scheduled during one of the following designated weekly timeslots:

Mondays & Fridays at 1:15 pm

Tuesdays, Wednesdays, & Thursdays at 9:15 am

The agency partner requesting the emergency hearing shall contact the UFC Judge’s JA to request a hearing time during one of the designated timeslots.

The UFC JA shall send email notice to all system partners of the emergency hearing. The UFC Division Director will maintain this distribution list and provide it to all UFC JAs.
