THE DELL RAPIDS CITY COUNCIL HELD IN THE COUNCIL CHAMBER

ON MONDAY, July 6, 2009 AT 7:30 p.m.

The meeting was called to order by Mayor Fiegen at 7:30 p.m.

Council Members Present: Mayor Fiegen, Grovenburg, Paul, Probst, Testerman, Wiebenga, and Woolf.

Absent: Downs, Sommerfeld.

Motion by Probst to add item to New Business. Seconded by Testerman. Motion carried, 6-0.

IV. Minutes

A.  June 15, 2009 – Regular Meeting

Motion by Paul to approve minutes. Seconded by Grovenburg. Motion carried, 6-0

V. Visitors to Be Heard

Patricia Stricherz, chapter president of Operation Homefront, explained the mission of her organization that has 36 chapters nationwide. The organization offers assistance to families challenged by the deployment of troops. Stricherz extended an invitation to the City Council to attend a Toast to the Troops Dinner on July 9 at the Sioux Falls Holiday Inn Starlight Room. She also announced her intention to have a national Freedom Walk event held in Dell Rapids sometime in September.

Charlie Pleskac, owner of the Dairy Queen, announced his intention to resurface his driveway and parking lot. He requested the City to consider the improvement of the Old Highway 77 apron that abuts his property.

VI. Old Business

A.  2nd Reading Ordinance 724, Rezoning Lot 12, Block 1, Timber Ridge Addition from R-1 to R-2 – Adoption of the ordinance will allow Tony Biggar to construct an owner-occupied duplex on this property.

Motion by Probst to approve 2nd and final reading of Ordinance 724 as follows:

AN ORDINANCE OF THE CITY OF DELL RAPIDS, SOUTH DAKOTA, PROVIDING THAT THE REVISED ORDINANCES OF THE CITY OF DELL RAPIDS, SOUTH DAKOTA, BE AMENDED BY ADDING A SECTION TO BE NUMBERED 1212 PROVIDING THAT THE REAL PROPERTY DESCRIBED BELOW BE REZONED.

BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF DELL RAPIDS, SOUTH DAKOTA:

Section 1. That the Revised Ordinances of the City of Dell Rapids, South Dakota, be amended by adding a section to be numbered Section 1212, to read as follows:

“Section 1212. That the following described real property located within the zoning jurisdiction of the City of Dell Rapids, South Dakota, is hereby rezoned from R-1, Single Family Residential, to R-2, Two-Family Residential:

Lot 12 in Block 1 of Timber Ridge Addition to the City of Dell Rapids, Minnehaha County, South Dakota.”

Section 2. That the Official Zoning Map of the City of Dell Rapids, South Dakota, as amended by Ordinance No. 369, be changed accordingly.

VII. New Business

A.  Resolution #07-06-09-18, Approve Plat for Maria Crisp Addition – Mark Crisp presented a plat map that revises the former Kenefick’s Subdivision and renames it the Maria Crisp Addition.

Motion by Wiebenga to approve Resolution as follows:

RESOLUTION #07-06-09-18

A RESOLUTION APPROVING THE PLAT OF MARIA CRISP ADDITION TO THE CITY OF DELL RAPIDS, MINNEHAHA COUNTY, SOUTH DAKOTA.

WHEREAS, there has been submitted to the City of Dell Rapids, South Dakota, a Plat of Maria Crisp Addition to the City of Dell Rapids, Minnehaha County, South Dakota; and

WHEREAS, the territory contained within the plat lies within the City limits of the City; and

WHEREAS, the plat has been examined and approved by the City Planning Commission and City Council of the City, and is in compliance with applicable law.

NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Dell Rapids, South Dakota that the plat known and described as Tracts 1, 2, and 3 of Maria Crisp Addition to the City of Dell Rapids, Minnehaha County, South Dakota, is approved, and that the Municipal Finance Officer of the City of Dell Rapids, South Dakota is hereby directed to endorse on such plat a copy of this Resolution, and certify the same thereon.

B.  1st Reading, Ordinance 725: Rezoning request, Tract 2, Maria Crisp Addition – Mark Crisp requested a zoning change on Tract 2 from I-1 (Light Industrial) to B-2 (General Business) in order to improve or sell a residential home on this property. Bank financing or extensive remodeling cannot take place on a residential home grandfathered into an I-1 zone.

Motion by Woolf to approve 1st reading of Ordinance 725 as follows:

C.  Sheriff’s Deputy Trevor Osmer: Neighborhood Watch – Deputy Osmer reviewed past efforts of the Dell Rapids community to institute neighborhood watches for crime prevention and detection. He reminded the City Council that any resident interested in participating in a neighborhood watch can reach the Minnehaha County Sheriff at 367-4300. No Council action was required.

D.  Dell Rapids Volunteer Fire Department Progress Report – Fire Chief Doug Geraets expressed appreciation for the City Council and the City Staff in pursuing steps to construct a new fire station for the Volunteer Fire Department. Geraets asked about the lot location and a purchase agreement for property. The City Staff has received clearance from the EPA and State DENR to conclude a transaction for property along West 4th Street. 2010 continues to be the target date for construction. No Council action was required.

E.  Declare Surplus Vehicles, Volunteer Fire Dept.: 1996 Chevrolet Tanker/Tender; 2002 International Pumper – Fire Chief Geraets reviewed the Fire Department vehicles that are scheduled to be replaced. Geraets requested that a tanker/tender and a pumper be listed as surplus property by the City of Dell Rapids. Geraets has investigated preliminary appraisal values for these vehicles.

Motion by Woolf to approve action. Seconded by Probst. Motion carried, 6-0.

F.  2009-20010 Transit Bus Operating Grant Request thru Inter-Lakes Community Action Partnership – The City Council reviewed two options proposed by Inter-Lakes Community Action Partnership prior to an annual operating grant application being submitted by ICAP on July 15. Option #1 continued the Dell Rapids schedule of operation of three days per week for a local match of $6,950.38. Option #2 would add a 7-hour day each week for a local match of $9,630.72. The Council discussed various factors related to operating the transit bus in Dell Rapids. Council member Woolf provided his experience as a transit driver.

Motion by Paul to accept Option #1 and continue the transit schedule at three days per week. Seconded by Testerman. Motion carried 5-0, with Woolf abstaining.

VIII. City Administrator Report

·  The Public Works Director and the City Engineer have determined that 2.5 blocks of Westview Drive and Fairway Drive are first priority in an asphalt overlay project to happen this year. The City is investigating an ongoing street improvement strategy that will extend surface life on residential streets.

·  The City Council has requested a plan to keep the swimming pool open closer to Labor Day, and the swimming pool manager has indicated that she may have staff available at least through August 23. The public schools open August 18. As the lifeguard staff becomes familiar with their school activities, the City can determine if the pool can be open for the Labor Day weekend.

·  May ’09 Sales Tax receipts as recorded by the State Department of Revenue is about $4,000 less than was received for May ’08. Annual receipts to-date for ’09 are running about $16,000 behind receipts reported for ’08.

·  The Council was requested to review an installation charge for electric service provided at Veterans Park. No action was expected at this time.

·  The Council was requested to authorize a comparison of insurance quotes for some selected activities. The Council directed the City Staff to research this issue further.
