Rules of Origin / Article 5 and 6 to Protocol III and Annex II / Products wholly obtained in, and obtained in the Parties, incorporating materials, which have not been wholly obtained there, provided that such materials have undergone sufficient working or processing, are determined as originating products under the Agreement.
Standards-related measures / Article 9 / The WTO Agreement on TBT governs the rights and obligations of the Parties on standards or technical regulations and related measures. Each Party, upon the request of the other Party, shall provide information on standards, technical regulations and related issues. The Parties will enter into negotiations to conclude agreements for mutual recognition in the field of conformity assessment.
SPS measures / Article 12 / The Parties shall not apply their SPS regulations as an arbitrary or unjustifiable discrimination or a disguised restriction on intra-trade. The Parties shall apply their sanitary measures within the spirit of the provisions of the GATT and other relevant WTO agreements.
Safeguard mechanisms (intra-trade) / Articles 13, 17, 19-20, 22 and 26 / Safeguard measures are provided for, inter alia: concern for infant industries or certain sectors undergoing restructuring or facing serious difficulties during the transition period; serious injury to domestic producers or disturbance on the market of like or directly competitive products; serious disturbance in any sector of the economy or difficulties which could bring about serious deterioration in the economic situation of a region; a serious shortage of an essential product; and balance of payment difficulties.
Anti-dumping and countervailing measures / Article 18 / These areas are governed by Article VI of GATT 1994 and the rules established by agreements related to that Article.
Subsidies and state aid / Article 25 / The Parties shall ensure transparency and conformity in the provision of state-aid according to their respective Agreements with the European Communities and WTO/GATT 1994.
Customs-related procedures / Protocol III / This Protocol defines the concept of originating products and methods of administrative cooperation in the customs authorities of the Parties as well as establishing a Customs Sub-Committee.
IPR / Article 27 / This issue is governed by TRIPS and other international agreements.
GovernmentProcurement / Article 28 / Both Parties must grant each other’s companies access to contract award procedures and treatment no less favourable than that accorded to companies of any other coun try.
Competition / Article 21 / The Parties will adjust state monopolies so that by the end of the fourth year following the entry into force of the Agreement, no discrimination regarding the conditions under which goods are procured and marketed will exist between nationals of the Parties.
Investment / Article 14 / The Parties will co-operate to achieve a progressive liberalization and mutual opening of their markets for investments and trade in services. They will also discuss opportunities for cooperation in the Joint Committee.
General exceptions / Article 31 and Article 32 / The Agreement includes both security and general exceptions, but no reservations. The Agreement shall not prevent the Parties from taking measures to prevent the disclosure of information contrary to its essential security interests; to protect its essential security interests or implement international obligations or national policies; relating to the traffic in arms, ammunition and implements of war and to such traffic in other goods, materials and services to supply a military establishment; relating to the non-proliferation of NBC weapons; or in time of war or threat of war. General exceptions are justified on grounds of public morality, public policy or public security; the protection of health and life of humans, animals or plants; the protection of national treasures possessing artistic, historic or archaeological value; or the protection of intellectual, industrial and commercial property.
Accession / None / There is no provision in the Agreement allowing other countries to accede to the Agreement.
Dispute resolution / Article 29 and Protocol III (Article 33) / The Joint Committee has the authority to take decisions in cases, including disputes, provided for in this Agreement.
Relation with other trade agreements / Articles 9, 12, 18, 25-27, and 16. / Rights and obligations relating to standards and SPS measures, subsidies, anti-dumping and countervailing measures, balance of payments issues, and intellectual property shall be governed by the relevant WTO, GATT, IMF Agreement or the Agreements with the EU. The Agreement does not prevent the establishment of trade agreements with third parties.
Institutional provisions / Articles 22, 29 and 30 and Protocol III. / The Agreement establishes a Joint Committee responsible for the implementation and administration of the Agreement. It also sets up a Customs Sub-Committee.
