TITLE V. BUILDING AND CONSTRUCTION

CHAPTER 500: GENERAL PROVISIONS

ARTICLE I. BUILDING RESTRICTIONS ON VALLEY ROAD

SECTION 500.010: DESIGNATION OF VALLEY ROAD ─ BUILDING RESTRICTION LINE

A.  The street which begins at east City limits of Lake Ozark, Missouri, and terminates at Old School Road and more particularly described in Schedule A, on file in the office of the City Clerk, is hereby designated Valley Road.

B.  There is hereby established a building restriction line on each side of Valley Road forty (40) feet from the right-of-way boundary parallel thereto on each side of the entire length of said Valley Road. (Ord. No. 143 §§1─2, 9-7-83)

SECTION 500.020: UNLAWFUL TO CONSTRUCT OR PLACE STRUCTURE, ETC.,

CLOSER THAN BUILDING RESTRICTION LINE ALLOWS

It shall be unlawful for any new structures to be constructed or any temporary structure or trailer to be placed closer to Valley Road then the building restriction line hereinabove established. (Ord. No. 143 §3, 9-7-83)

SECTION 500.030: EXCEPTION

Those structures which are within the building restriction line limit on or before September 7, 1983, are not affected by this Article except that they may not be increased in size or be moved any closer to the Valley Road boundary lines from and after September 7, 1983. (Ord. No. 143 §4, 9-7-83)

SECTION 500.040: CITY HAS RIGHT TO ENFORCE PROVISIONS BY INJUNCTION

The City of Lake Ozark, Missouri, shall further have the right to enforce this Article by injunction. (Ord. No. 143 §6, 9-7-83)

ARTICLE II. PROPOSED STREETS ─ ACCEPTANCE AND SPECIFICATIONS

SECTION 500.050: PRESENTATION OF PROPOSED STREET ─ MINIMUM SPECIFICATIONS

All persons wishing to have streets accepted by the City of Lake Ozark shall submit their request to the Board of Aldermen for consideration. All requests must meet the minimum standards outlined herein.

Streets and Alleys.

.1.  Relationship to adjoining street systems. The arrangement of streets in new subdivisions shall make provisions for the continuation of the principal existing streets in adjoining additions (or their proper projection where adjoining property is not subdivided) insofar as they may be necessary for public requirements. The width of such street rights-of-way in new subdivisions shall be not less than the minimum street widths established herein. Alleys, when required, and street arrangement must cause no hardship to owners of adjoining property when they plat their land and seek to provide for convenient access to it. Whenever there exists a dedicated or platted half street or alley adjacent to the tract to be subdivided, the other one-half (½) of the street or alley shall be platted and dedicated as a public way.

.2.  Street names. Streets that are obviously in alignment with other already existing and named streets shall bear the names of the existing streets. Street names should not be similar to already platted street names. Streets and house numbers shall be numbered in accordance with the adopted house numbering policy of the City.

.3.  Arterial streets. Arterial streets through subdivisions shall conform to the major street plan of the Comprehensive Plan as adopted by the Planning Commission and the Governing Body.

.4.  Local streets. Local streets should be designed so as to discourage through or non-local traffic.

.5.  Cul-de-sacs. An adequate turnaround of not less than a one hundred (100) foot diameter right-of-way shall be provided at the closed end of a dead-end local street longer than one (1) lot in length. Such local street segment should not exceed six hundred (600) feet in length from the centerline of an intersection of a cross street to the center of the cul-de-sac but may be longer based on the density of platted lots as approved by the Planning Commission upon the recommendations of the City Engineer.

.6.  Right-angle intersections. Under normal conditions, streets shall be laid out to intersect, as nearly as possible, at right angles. Where topography or other conditions justify a variation from the right angle intersection, the minimum angle shall be sixty degrees (60°).

.7.  Streets adjacent to a railroad right-of-way, principal highway or arterial street. Where lots front or side but do not back on railroad rights-of-way, limited access freeways or principal highways or arterial streets, a marginal access street or frontage road may be required parallel and adjacent to the boundary of such rights-of-way. The distance from said rights-of-way shall be determined with due consideration to minimum distance required for approach connections to future grade-separated intersections.

.8.  Half-streets. The dedication of one-half (½) of a right-of-way (half-streets) shall be prohibited except where no lots front on such half-street.

.9.  Alleys. Alleys may be required in commercial, industrial and residential areas. Dead-end alleys shall be avoided, whenever possible, but if unavoidable, such alleys shall be provided with adequate turnaround facilities at the dead end. Alleys should be avoided in residential areas except where alleys of adjoining subdivisions would be closed or shut off by failing to provide alleys in the adjoining subdivision.

.10.  Minimum requirements. The right-of-way grades and widths for streets and alleys, in order to be dedicated and accepted, shall conform to the designation in the Comprehensive Plan and shall not be less than the minimum for each classification as follows:

When existing or anticipated traffic on arterial and collector streets warrants greater widths of rights-of-way, the additional width shall be dedicated. The minimum gradient on any street shall be five-tenths percent (0.50%), unless impractical, in which case the absolute minimum gradient shall be no less than thirty-two hundredths percent (0.32%). Street widths are measured from the back of the curb to the back of the curb.

The paved surface of the road shall be constructed as follows:

  1. A thickness of four (4) inches of rock base (rolled).
  2. Three (3) inch thickness of fine finish grade of rock.
  3. A three (3) inch base coat of asphaltic concrete.
  4. A one (1) inch cap or finish coat.

The curb and gutter shall be constructed as follows:

  1. The width of the curb and gutter shall be twenty-four (24) inches.
  1. The width of the curb shall be six (6) inches.
  1. The width of the gutter shall be eighteen (18) inches.

.11.  Street alignment. Minimum horizontal and vertical alignment on all streets except in unusual cases shall be as follows:

.11.a.  Minimum horizontal radii at the centerline:

.11.a.1.  Arterial streets 500 feet

.11.a.2.  Collector streets 300 feet

.11.a.3.  Local streets 100 feet

.11.b.  Minimum sigh distance on vertical curves:

.11.b.1.  Arterial streets 350 feet

.11.b.2.  Collector streets 250 feet

.11.b.3.  Local streets 150 feet

.12.  Street alignment. On streets with reverse curves, a reasonable tangent shall be provided between curves to permit a smooth flow of traffic.

.13.  Street layout. Proposed streets shall conform to topography as nearly as possible to reduce drainage problems and grades. (Ord. No. 93 §1, 2-20-75; Ord. No. 97-6 §§1─2, 2-25-97; Ord. No. 2001-14 §1, 8-28-01)

ARTICLE III. NUMBERING OF BUILDINGS

SECTION 500.060: DESIGNATION OF STREET NUMBERS

The designation of all street numbers for dwelling units and places of business on all public and private streets shall be assigned by the City in accordance with procedures adopted by the City of Lake Ozark, Missouri. The Planning Department shall keep a record of all numbers assigned under this Article. (Ord. No. 2000-24 §1, 10-24-00)

SECTION 500.070: POSTING OF STREET NUMBERS

A.  The owner or occupant or person in charge of any house or building to which a number has been assigned will be notified by the City of the number assigned to the same at any time after the adoption of this Article.

B.  Within sixty (60) days after the receipt of such notification, the owner or occupant or person in charge of a house or building to which a number has been assigned shall affix the number to the structure if said structure is visible from the road. If said structure is not visible from the roadway, numbers shall be affixed to a sign or number post in such a way that the address can clearly be seen from the roadway.

C.  It shall be the duty of such owner or occupant or person in charge thereof upon affixing the new number to remove any other number(s) which might be mistaken for, or confused with, the number assigned to said structure.

D.  Each principal building shall display the number assigned toward the street on which structure is addressed and adjacent to the entrance. In case a principal building is occupied by more than one (1) business or dwelling unit, each separate front entrance shall display a separate address or unit number.

E.  Numbers indicating the official address for each principal building or each front entrance to such building shall be posted in a manner so as to be legible and distinguishable from the street on which the property is located, with numerals painted or applied of a contrasting color to the background, of not less than three (3) inches in height in residential areas, and not less than four (4) inches in height in commercial areas. Script lettering or similar unconventional type styles are not permitted. If a building or dwelling is situated in such a way that the numerals cannot be easily seen from the roadway in front of said structure, then a sigh or number post must be installed in front of the structure and placed in such a way that is it easily seen from the roadway. SECTION 500.080: NEW STRUCTURES─NUMBERING

A.  Numbers will be assigned to each proposed lot or tract on the recorded copies of final subdivision plats by the Planning Department.

B.  No building permit shall be issued for any principal building until the owner or developer has procured from the Planning Department the official address of the premises. Final approval of a certificate of occupancy of any principal building erected or repaired after the effective date of this Article shall be withheld until permanent and proper numbers have been displayed in accordance with the requirements of the Section above. SECTION 500.090: PENALTY

In the event that the owner or occupant or person in charge of any house or building refuses to comply with the terms of this Article by failing to affix the number assigned in the manner prescribed herein within sixty (60) days after notification, or by failing within sixty (60) days to remove any old numbers affixed to such house, house entrance or elsewhere which may be confused with the number assigned hereto he shall be punishable by fine of not less than ten dollars ($10.00) for each day that the violation exists. CHAPTER 501: BUILDING PERMITS

SECTION 501.010: DESIGNATED COORDINATING AUTHORITY TO ISSUE BUILDING PERMITS WITHIN THE CORPORATE LIMITS OF THE CITY OF LAKE OZARK, MISSOURI.

A.  Pursuant to the authority granted by the referenced laws of the State of Missouri, the City of Lake Ozark does hereby and shall afterwards exercise the coordinating function within its corporate limits for all construction permitting, the issuance of the same, the general inspection, and with the exception of such recognized fire related inspections referenced above, shall collect such fees as set forth herein for the same,

B.  The Lake Ozark Fire Protection District shall by agreement conduct all fire related inspections within the City of Lake Ozark, including fire sprinkler systems, where applicable, smoke alarms, ingress and egress, fire suppression systems, fire walls, dry hydrants and such other similar inspections, and further:

B.1.  The Lake Ozark Fire Protection District agrees to collect its own fees and to charge no more than fifty percent (50 %) of the City of Lake Ozark permit costs on commercial projects and a flat fee of $150 per single family residential unit (excluding remodels), with duplexes and triplexes considered as one unit for such inspections as recognized as fire related inspections designated herein.

B.2.  The City of Lake Ozark shall hereafter deliver to the Fire District within three days a copy of building plans for their approval or disapproval, provided that the Fire District shall conduct such review and convey in writing their approval or disapproval to the City Planning Department within seven days of the date of permit application for residential permits and 15 days for commercial projects.

B.3.  It shall be agreed that certification by the Fire District of compliance to the adopted fire codes (2006 International Fire Code, until such time as they are superseded by subsequently adopted newer version fire codes) shall be a requirement for the issuance of a City of Lake Ozark occupancy permit for both residential and commercial permittees. Applications for occupancy must be made in writing to the City of Lake Ozark, such applications shall be forwarded to the fire district within three days, and the fire district shall issue in writing its approval or disapproval of such applications within seven days of the date of the application.

B.4.  It is also agreed that such certificate shall not be unreasonably withheld.

B.5.  The City of Lake Ozark does not recognize, convey or confer any authority over its water delivery system, line sizes or maintenance of fire plugs to the Lake Ozark Fire Protection District, nor provide for any inspection or fees by the Fire District for the same, however, the City of Lake Ozark agrees to work closely with the District for placement of hydrants to newly permitted commercial applications.

C.  The City of Lake Ozark herein adopts the 2006 International Building Code, the 2006 International Fire Code (excluding sprinkler systems for one and two family residential dwellings), the 2006 International Plumbing Code, the 2006 International Mechanical Code, the 2006 International Residential Code, and the 2005 National Electrical Code.
