Transfer of Land (Safe Custody Fee) Regulations 1993
1.Title
These Regulations may be cited as the Transfer of Land (Safe Custody Fee) Regulations 1993.
2.Commencement
These Regulations come into operation on 3January 1994.
3.Objective
The objective of these Regulations is to prescribe a fee for leaving certificates of title, duplicate instruments and other documents with the Registrar for registration of a dealing to be lodged under the Transfer of Land Act 1958 by a third party.
4.Authorising provisions
These Regulations are authorised by sections 120 and 121 of the Transfer of Land Act 1958.
5.Fees
(1)There is payable a fee of $10.00 for each certificate of title, duplicate instrument or other document which has been left to be kept in safe custody with the Registrar to be used by a third party for the lodgement and registration of a subsequent instrument, application or other document.
(2)The fee is payable to the Registrar by the third party when third party lodges the subsequent instrument, application or other document.
6.Retention period

The Registrar must return a document left with the Registrar and referred to in regulation 5 as directed in writing by the person by whom, or on whose behalf it was left—
(a)within a reasonable time after the document has been used for the purpose for which it was left; or
(b)at the end of 90 days after the date on which the document was left with the Registrar if the document has not been used for the purpose for which it was left.

The Transfer of Land (Safe Custody Fee) Regulations 1993, S.R.No.220/1993 were made on 30 November 1993 by the Governor in Council under sections 120 and 121 of the Transfer of Land Act 1958, No.6399/1958 and came into operation on 3 January 1994: regulation 2.
The Transfer of Land (Safe Custody Fee) Regulations 1993 will sunset on 29November 2004: see the Subordinate Legislation (Transfer of Land (Safe Custody Fee) Regulations 1993–Extension of Operation) Regulations 2003, S.R. No. 116/2003.
