Good Afternoon – There was a report completed by the Ministry of Environment and Climate Change on Blue Lake which states “If the model is reflective of phosphorous cycling in Blue Lake, the model predicts the lake is nearing its phosphorous related development capacity as the lake can sustain only 7 seasonal, 4 extended seasonal or 2 permanent residences before reaching the background of +50% phosphorous objective. Careful consideration should be given to further development on Blue Lake for the above reasons”. The Planner has reviewed this information and Blue Lake is not currently deemed at capacity. If the lake is deemed at capacity in the future then the 300 metre setback would be required on any newly created lots. Thanks Tara. This is extremely helpful and relevant. I interpret this to mean that the 300 metre setback would only be applicable to a new lot, but not applicable to an existing lot, based on the current capacity of cottages/lots on the lake. In this case (existing lot), what would be the setback from the shoreline for a cottage or home and/or septic system?
Do you have record of currently how many seasonal vs. extended seasonal vs. permanent residences are located on the lake? I expect this is very relevant to understanding the capacity of the lake.
I expect the study completed by the Ministry of Environment and Climate Change on Blue Lake would be relevant to anyone considering severing a lot on the lake to create a new lot. In this case, would the retained parcel keep the old setbacks and the new parcel be susceptible to the “capacity” setbacks, or is there still lots of “capacity” on Blue Lake even with another severance?
Based on the current zoning regulations, is parcel 29 (attached) currently severable.
I expect all of the above are questions you will continue to get. If we are able to provide the answers on the auction website, I expect your call volume will diminish and give us some better understanding of the “potential” or “non-potential” of what we are selling for the Tooley Estate.

I have discussed your inquiry with the Planner and advise the setback from the high water mark of Blue Lake for an existing lot for a dwelling or septic would be 30 metres. Blue Lake has not yet been deemed at capacity. It is hard to determine when a lake will be deemed at capacity because it is unknown as to when development applications will be received.. The creation of a new lot through severance would result in the new lot (severed or undeveloped lot if retained) with the septic setback of 300m. This would not apply to the existing lot. There are several considerations when looking at the creation of new lots including access, lot size, frontage, etc. I trust this is the information you require.
