LOCATION:Township Municipal Building – 33351 Richmond Street, Lucan, Ontario

PURPOSE:To consider a proposed amendment to the Zoning By-law to permit a second dwelling on a farm for a temporary period of time.

The proposed amendment would permit the construction of a second single unit dwelling situated on lands lying on the east side of Richmond Street(Highway 4) being Lot 17, Concession I. The applicants wish to continue to reside in the existing dwelling while a new dwelling is being constructed. The subject lands are a farm parcel having a lot area of 40 hectares (98.8 ac), a frontage of 403 metres (1,322 ft) along Richmond Street (Highway 4) and a depth of 1,000 metres (3,280 ft). It is occupied by an existing dwelling and two drivesheds.

The subject lands are zoned General Agricultural (A1), which permits a maximum of one (1) single unit dwelling per lot. The proposed Temporary Use By-law would permit the construction of a new dwelling whilethe existing dwelling remains until such time as it ceases to be occupied or within three (3) years (whichever occurs first). At that time, the existing dwelling would have to be removed from the lands. An agreement between the Township and the applicants may be considered to address these issues and other terms and conditions under which the existing dwelling would continue to be permitted and subsequently removed. The proposed By-law would be in effect for a period not to exceed three (3) years. The General Agricultural (A1) zoning of the lands would otherwise remain in effect.

The subject lands are designated 'Agricultural Area' in the County of Middlesex Official Plan and are designated 'Agricultural' in the Township of Lucan Biddulph Official Plan.

ANY PERSON may attend the public meeting and/or make a written or verbal representation either in support of, or in opposition to, the proposed amendment. IF A PERSON OR PUBLIC BODY does not make oral submissions at a public meeting or make written submissions to the Council of the Township of Lucan Biddulph before the by-law is passed, the person or public body is not entitled to appeal the decision of the Council of the Township of Lucan Biddulph to the Ontario Municipal Board. IF A PERSON OR PUBLIC BODY does not make oral submissions at a public meeting or make written submissions to the Council of the Township of Lucan Biddulph before the by-law is passed, the person or public body may not be added as a party to the hearing of an appeal before the Ontario Municipal Board unless, in the opinion of the Board, there are reasonable grounds to do so.
