2011 SKATEPARK USER ASSUMPTION OF RISK, WAIVER AND RELEASE

In consideration of receiving permission from the Town of Foxborough to enter upon the premises of the Foxborough Skateboard Park, located off of South Street, Foxborough, Massachusetts (hereinafter referred to as “the Premises”), and to participant, and his or her parents or legal guardians if under the age of 18 years (hereinafter referred collectively as “the Participant”), hereby releases the Town of Foxborough, its agents, officers and employees (hereinafter referred to as “the Town”), from any and all liability, and waive any and all claims, demands, and actions, arising out of or related to any loss, damage, or injury, including death that may be sustained by the Participant, or any property of Participant, while on the Premises.

The Participant acknowledges that he or she is duly aware of the risks and hazards inherent upon entering the Premises and/or participating in skateboarding and other activities on the Premises, including but not limited to, the use of rollerblades and BMX bicycles. The Participant hereby voluntarily assumes all risks of loss, damage or injury, including death, which may be sustained by the Participant, or any property of Participant, while on the Premises.

The Participant hereby agrees to indemnity and hold harmless the Town against loss from any and all claims, demands or actions in law or equity brought by or on behalf of the Participant, or by anyone else in connection with the Participant’s presence or actions on the Premises, even if arising from the Town’s negligence, to the fullest extent permitted by law.

The Participant hereby acknowledges that this Waiver and Release shall be binding upon his or her heirs, personal representatives or assigns, that he or she has read this entire document, that he or she understands that it affects his or her legal rights, and that he agrees to be bound by its terms.

The registration fee goes towards the Foxboro Recreation Department’s administrative and incidental expenses, and is not an entrance fee or a fee for the use of our facilities.

RULES AND REGULATIONS

1. All participants’ must be pre-registered at the Recreation Department and must wear registration badge at all times while inside the Park. Badges are non-transferable. Park pass can be obtained at the recreation building or call 543-7255

2. The Skate Park is a “SKATE AT YOUR OWN RISK” Facility, designed for Skateboarders, In-Line Skaters, BMX biking and Scooters only. No motorized vehicles or other wheeled devices allowed within SkatePark.

3. Safety equipment: Wearing helmets are requiredat all times on skating surfaces. Knee, elbow pads and wrist guards are strongly recommended and should be used at all times. Absence of helmet will result in revocation of pass.

4. Skating when wet, raining or during routine maintenance is prohibited.

5. The SkatePark will be open only during the posted hours. In the Town of Foxborough, a no-trespassing ordinance will be enforced after the park is closed. The Recreation Board has the right to close the park at its discretion without prior notification.

6. Saturday and Sunday, 9:00 -12:00 noon is reserved for children 12 years of age and younger along with their parents or guardian.

7. An adult must accompany children under the age of 9.

8. Graffiti in the SkatePark is illegal and removal will necessitate closing.

9. No Smoking

10. No alcoholic beverages.

11. No littering. Pickup any litter, even if it is not your own. Closing of park could result.

12. No glass containers.

13. No food, beverages, coolers or backpacks on skating surfaces.

14. No spectators or non-participants permitted on skating surfaces except for parents and adult supervisors.

15. This park has been designed for all skill levels. Be courteous to other park patrons.

16. Profanity and/or reckless behavior will not be tolerated.

17. Any violation of these rules will result in a permanent revocation of skating pass.

Hours of Operation

1. Closed while School is in session

2. School days 3:00p.m. to 8:30 p.m.

3. Non-school days 9:00 a.m. to 8:30 p.m.

4. Saturdays and Sundays 9:00 a.m. - 12 noon reserved for 12 and under and parents or guardians

5. The Recreation Department has priority for use of this park during its summer programs
