Minutes of

February 3, 2005

A meeting of the Corinth Zoning Board of appeals was held on Thursday, February 3, 2005 at the Corinth Town Hall 600 Palmer Avenue Corinth, New York and was called to order by Chairman Bill Clarke at 7:00 P.M.

Present: Bill Clarke, Sigrid Koch, Glen Tearno, Ed Byrnes, Rex Moon, Christopher Ross, Attorney Pozefsky, Red Mann Jr. Administrator and Linda Hamm Secretary.

Public Present: James Seelow, Earl Seelow, Elaine Ryder, Charles Ryder and Warren Cummins.

Order of Business: Approval of November 4, 2004 minutes

New Business: Discussion with Earl Seelow and James Seelow in regard to a variance for 62’ at the front of the property.

Mr. Seelow addressed the Zoning Board Members saying that what he is looking for is a variance at the front of the property for the land that was surveyed by David Barrass and subdivided for his son to build a new home. Mr. Seelow stated they couldn’t conform to the 200’ road frontage but that where the house was to be built there was over 300’ and if they look at the survey map, they will see that everything is in code there. Board member Rex Moon asked Mr. Seelow if he had been to the Planning Board with this request? Mr. Seelow stated he had been the Planning Board and was told that if he were filing a family subdivision that they would have nothing to do with it. I also talked with Fred and Linda from the building department. That’s why my building permit was denied.

Mr. Moon informed Mr. Seelow that his application was incomplete and he would have to go to the Planning Board because in doing the subdivision, he created a legal parcel for his son, but that Mr. Seelow’s was now in nonconformance. Mr. Moon states you must go back to the Planning Department and re file. You need to file for the preexisting property, which is yours, Mr. Seelow.

Attorney Pozefsky spoke up and let Mr. Seelow know that he believes Mr. Moon is correct and he will have to go back and re file at the Planning Board. After you file with the Planning Board, get on their agenda for this month. that meeting will be held on February 17, 2005 at 7:00P.M. Please call that office and set up a meeting. Attorney Pozefsky asks if we can go on to the next step. Mr. Seelow for your next application make sure that you have all the information possible. Make sure all your applicants are listed. Our next meeting will be on March 3, 2005 at 7:00P.M.

Mr.& Mrs. Ryder, which are neighbors, attended this meeting with concerns of several codes. Mr. Ryder stated to the board that he had written down some concerns and copied some of the codes. I ask that you take time to review this and take it into consideration. Chairman Clarke stated we would review this letter you have given us and that there is no decision that is going to be made at this meeting. We will table this until the next meeting which will be on March 3, 2005. Chairman Clarke asks if there is any other public input? Attorney Pozefsky states that you can hold the public comments this next month or hold it off for another month. The board asks Mr. Seelow if he understands now what needs to be done? Mr. James Seelow stated yes and repeated the steps back to them, and stated that if help is needed they could go to Meredithe of the LA Group or to Attorney Pozefsky.

Chairman Clarke asks if there are any other public questions. Mr. Warren cummins stated he was having a problem still with his neighbor not removing her roof from her shed. Board members asked him to explain. this has been an on going problem for over a year now. Mr. Cummins has a stock aid fence on his property line and the neighbor built a shed to hold firewood less than ten feet from the property line and the snow falls off and breaks his fence. Mr. Mann was to get this taken care of and yet it still is there. Mr. Mann stated that he had spoke with his neighbor with the shed and she stated that it would be taken down. Her boyfriend had a heart attack and would have to hire someone. Mr. Mann is returning there tomorrow and will get this taken care of.

After discussion of the proper handling of Mr. Seelow’s request for his variance, Mr. Rex Moon asks Chairman Clarke for a clear definition of the wording Lot Width and Road Frontage. Mr. Moon also suggests that the board make an amendment for this. Mr. Moon also states he thinks the zoning board should meet with the Town board for discussion.

Old Business: Review Class from Hudson Valley Community College

Chris Ross and Fred Mann attended a class at the Hudson Valley College and would like to review some of the information. Mr. Ross had copies made for all the board members. Part of the discussion was on the storm water management and what the Zoning and Planning boards should be looking for. Some of the other discussions were on Local Law filing, record keeping. This portion was also given at the class we just attended in Saratoga. This is why Linda was there, learning the importance of minutes and the keeping of files. How long the recordings and such need to be held. Some hearings and meetings, which are discussed may have continuing value for historical or other research and should be retained permanently. Chairman Clarke asked if there were any questions, anything else to be discussed?

A motion to adjourn was made by Glen Tearno and was seconded by Sigrid Koch. There was a roll call vote and all members are in favor.
