Supervisor Eppolito discussed the following topics with the Board members:

1.  Councilman Drake advised that at the last Library Board meeting the

members discussed the Post Office’s continued use of the library driveway for the ingress and egress of their vehicles. The vehicles drive over the grass between the two buildings and go the wrong direction at the Library entrance. This started during the streetscape construction this summer. Supervisor Eppolito had drafted a letter to send to the Springville Postmaster advising them to direct their delivery vehicles to begin using the Franklin Street driveway as their primary point of access. The members agreed that Supervisor Eppolito should send the letter and if the matter is not resolved, the Town will put a barrier up to block the access. A copy of the letter will be included in the Minute book.

2.  Supervisor Eppolito gave the members a copy of a draft letter that the

Orchard Park Supervisor is asking all Towns to send to Governor Cuomo regarding the Tax Cap. The letter details how the tax cap is affecting communities in their budget process and that in the absence of mandate relief and/or increased state and federal aid, local governments have begun to experienced financial stress in their efforts to comply with the current iteration of the tax cap. The letter further requests that the current Tax Cap legislation be revisited and amended in such ways as to alleviate the unforeseen negative consequences. The members agreed that Supervisor Eppolito should sign this letter. Supervisor Eppolito noted that he would not be able to travel to Albany to meet with the governor and state officials on this matter. The Board had general discussion about how the tax cap affects the budget process and that the Board may have to cut some programs to stay under the tax cap.

3.  Supervisor Eppolito thanked the Board for their support at the WEREMSC

meeting. The Board had general discussion about the questions asked at the meeting and the service provided by Rural Metro and Mercy EMS. A decision on this matter is to be made on January 6, 2016.

ITEM #2. PUBLIC COMMENT

Supervisor Eppolito opened the floor for Public Comment.

George Donhauser asked the Board if they had heard about that the

yogurt plant in Batavia was closing. With all the tax breaks, how does this happen? Supervisor Eppolito explained how and IDA project works with a review by the IDA, attorneys, and bankers and that the IDA looks at a company’s books for a sound business plan. Supervisor Eppolito advised that he expects the IDA in Batavia to do some negotiation or restructuring to get someone in there to keep the plant open.

to close Public Comment. Councilwoman King, Councilmen Krezmien, Salzler & Drake; Supervisor Eppolito, voting aye. Carried.

i) Fire Department – Hwy Supt Dains (1) thanked the Board for their

support at the WEREMSC meeting. He feels confident that the decision will be favorable, (2) elections were held at the Springville Fire Company; (3) East Concord Fire Company is hosting an extrication training class and local firemen are attending.

j) Hwy Superintendent Report - Hwy Supt Dains had filed his written report.

Hwy Supt Dains gave Supervisor Eppolito a copy of a Resolution that the

NYS Association of Town Superintendents of Highways would like the local Boards to approve. This Resolution would support increased state funding for local transportation and addresses the parity between the DOT and MTA five-year capital programs. The members will review this Resolution and it will be placed on the January Agenda.

approve the Fire Department and Highway Department Reports. Councilwoman King, Councilmen Krezmien, Salzler & Drake; Supervisor Eppolito, voting aye. Carried.

ITEM #4. NEW BUSINESS

a)  Kenneth D. Zittel letter of resignation – Supervisor Eppolito received the

resignation letter from Kenneth D. Zittel. He will be resigning his position as the Chairman/Member of the Planning Board effective December 11, 2015. Motion made by Councilman Krezmien, seconded by Councilman Drake, to accept the resignation of Kenneth Zittel with regrets. Councilwoman King, Councilmen Krezmien, Salzler & Drake; Supervisor Eppolito, voting aye. Carried. The Board thanked Ken for his service on the Planning Board and look forward to working with him as a Town Councilman.

Supervisor Eppolito informed the Board that there will be an advertisement in this week’s Journal seeking new members for the Planning Board and the Zoning Board of Appeals. Letters of interest should be forwarded to Supervisor Eppolito.

b)  Set date for Organizational Meeting – The Organizational Meeting will

be held on Tuesday, January 5th, 2015 at 6 p.m. and the regular January Town Board meeting will follow at 7 p.m.

Since there will be Court on January 4th, 2015, the Board would need to re-

appoint Town Prosecutor Deborah M. Barone Prosecutor prior to that Court date. Motion made by Councilman Krezmien, seconded by Councilman Salzler, to appoint Deborah M. Barone as the Town Attorney and Town Prosecutor. Councilwoman King, Councilmen Krezmien, Salzler & Drake; Supervisor Eppolito, voting aye. Carried.

c)  Authorize Town Bookkeeper to make year ending entries with the

approval of the Town Supervisor – Report to be given Town Board – Motion made by Councilman Krezmien, seconded by Councilman Salzler, to authorize Bookkeeper Ciszak to make year ending entries with the approval of the Town Supervisor. Councilwoman King, Councilmen Krezmien, Salzler & Drake; Supervisor Eppolito, voting aye. Carried.

ITEM #5. OLD BUSINESS

a)  FEMA/Erie County Resolution – Supervisor Eppolito had given the

members a copy of this Resolution for their review.

Councilman Salzler moved the adoption of Resolution 20, seconded by Councilman Krezmien:

FEMA’s Region 2 Hazard Mitigation Plan Resolution

WHEREAS, the Town of Concord with the assistance of URS Corporation, has gathered information and prepared the Erie County New York Multi-jurisdictional Hazard Mitigation Plan Update (the Plan), and

WHEREAS, this Plan has been prepared in accordance with the Disaster Mitigation Act of 2000, and

WHEREAS, the Town of Concord is a local unit of government that has afforded the citizens an opportunity to comment and provide input in the Plan and the actions in the Plan, and

WHEREAS, the Town of Concord has reviewed the Plan and affirms that the Plan will be updated no less than every five years, and

NOW, THEREFORE, BE IT RESOLVED by the Town Board that Concord adopts the Erie County New York Multi-jurisdictional Hazard Mitigation Plan Update as this jurisdiction’s Natural Hazard Mitigation Plan, and resolves to execute the actions in the Plan.

ITEM #7. EXECUTIVE SESSION

There was nothing for Executive Session.

ITEM #8. COUNCILMAN NOTES

a)  Councilwoman King brought the Board up to date with concerns from

the Senior Citizen Advisory Board meeting:

(1)  The parking lot lights are not coming on correctly.

Councilman Salzler and Hwy Supt Dains will look at the manual and see if the timer can be set correctly. Councilman Salzler noted that he thought the security lights by

the doors were to be on at all times.

(2)  The status of the floor rugs. Supervisor Eppolito will have

Bookkeeper Ciszak look into the status.

(3)  There are still some issues with Time Warner that need to be

resolved.

(4)  Jennifer Manitone is doing a good job and that the Senior

Center building has been quite busy.

(5)  The Occupancy Capacity Sign has not yet been posted.

Supervisor Eppolito has the sign and will follow through.

(6)  Volunteers are needed.

(7)  Councilman Salzler also noted that the one day there was snow

on the ground the heat sensor on the driveway did not seem to be working correctly. It may be that the sun was shining on the device and making it so the equipment is not coming on appropriately. He had discussed this with Aaron at Mark Alianello’s office and the contractor will be notified.

(8)  Supervisor Eppolito noted that the shed was delivered to the

Senior Center so the snow blower can be stored on the property.

(9)  Councilman Salzler noted that calls have been placed to Aaron

at Alianello’s Office with problems. Calls should first be directed to Councilman Salzler so that he can see if it is something that he can solve before the engineer’s office is contacted.

b)  Hwy Supt Dains informed the Board that Sunnking picked up the E-

Waste. The E-Waste shed is now locked, and closed until further notice. A sign has been placed on the shed notifying residents of the closing. MRC does have an E-Waste facility in Sardinia. There will also be an E-Waste Drop-off at the Parkdale Elementary School in East Aurora on Saturday, January 23rd, from 9 a.m. to 9 p.m. The school is located at 141 Girard Avenue, East Aurora.

c)  The “swearing in” ceremony for the newly elected officials will be

held on Tuesday, January 5th, at 5:30 p.m.

d)  Since this is Councilwoman King’s last Board meeting, Supervisor

Eppolito thanked her for her service. The Board will miss her. The Town owes her a lot for all of her work on the Senior Center Project. Councilwoman King will remain a member of the Concord IDA.
